HomeMy WebLinkAbout1986-220 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 86-220 A RESOLUTION OF THE CITY OF SAN BERNARDINO VACATING MILL STREET BETWEEN TIPPECANOE AVENUE AND CALIFORNIA STREET; SANTA FE STREET BETWEEN TIPPECANOE AVENUE AND FAIRFAX DRIVE; SULLIVAN STREET BETWEEN TIPPECANOE AVENUE AND FAIRFAX DRIVE; ERWIN STREET BETWEEN SULLIVAN STREET AND SANTA FE STREET; FAIRFAX DRIVE BETWEEN A POINT APPROXIMATELY 150 FEET SOUTH OF SULLIVAN STREET AND A POINT APPROXIMATELY 150 FEET NORTH OF SANTA FE STREET, THAT CERTAIN UNNAMED STREET BETWEEN SANTA FE STREET AND SULLIVAN STREET, EAST OF FAIRFAX DRIVE AND A POINT APPROXIMATE- LY 140 FEET EAST THEREOF; THAT CERTAIN ALLEY BETWEEN SULLIVAN STREET AND A POINT APPROXIMATELY 140 FEET NORTH OF SANTA FE STREET, IN THE CITY OF SAN BERNARDINO AND RESERVING A PUBLIC UTILITY EASEMENT WITHIN A PORTION OF MILL STREET, EAST OF TIPPECANOE AVENUE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1: The Mayor and Common Council of the City of San Bernardino, having heard the evidence offered in relation to the proposed vacation of Mill Street between Tippecanoe Avenue and California Street; Santa Fe Street between Tippecanoe Avenue and Fairfax Drive; Sullivan Street between Tippecanoe Avenue and Fairfax Drive; Erwin Street between Sullivan Street and Santa Fe Street; Fairfax Drive between a point approximately 150 feet South of Sullivan Street and a point approximately 150 feet North of Santa Fe Street, that certain unnamed street between Santa Fe Street and Sullivan Street, East of Fairfax Drive and a point approximately 140 feet East thereof; that certain alley between Sullivan Street and a point approximately 140 feet North of Santa Fe Street, more particularly described in City Resolution of Intention No. 86-189, hereby find from all of the evidence submitted that such streets and alleys, proposed to be vacated by said Resolution, are unnecessary for present or prospective street purposes. 1 1 SECTION 2. The Mayor and Common Council of said City do 2 hereby vacate Mill Street between Tippecanoe Avenue and 3 California Street; Santa Fe Street between Tippecanoe Avenue 4 and Fairfax Drive; Sullivan Street between Tippecanoe Avenue 5 and Fairfax Drive; Erwin Street between Sullivan Street and 6 Santa Fe Street; Fairfax Drive between a point approximately 7 150 feet South of Sullivan Street and a point approximately 150 8 feet North of Santa Fe Street, that certain unnamed street 9 between Santa Fe Street and Sullivan Street, East of Fairfax 10 Drive and a point approximately 140 feet East thereof; that 11 certain alley between Sullivan Street and a point approximately 12 140 feet North of Santa Fe Street, San Bernardino, Cal ifornia, 13 more particularly described as follows: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 All those streets and alleys as delineated on Tract No. 3309 as per plat recorded in Book 44 of Map s, p age 100, r e cor d s 0 f sa i d Co u n ty 1 y i n g East of the East line of Tippecanoe Avenue and that portion of Mill Street lyiOg between a point 50 feet East of the center line of Tippecanoe Avenue and the West line of California Street. And is also described in said Resolution No. 86-189. SECTION 3. This Resolution shall reserve, and nothing herein shall in any way affect or disturb each and every existing easement for sanitary sewer and appurtenant facilities and for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is further reserved for present and future general public utility purposes and for this City an easement reasonably necessary to locate sanitary sewer, public utility and appurtenant facilities over, in, under or across said Mill Street along with the right to 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 use, install, maintain, repair, replace or renew such facilities and those reserved by Resolution of Intention No. 86-189. SECTION 4. The City Clerk of the City of San Bernardino shall cause a certified copy of this Resol ution to be recorded in the office of the County Recorder of the County of San Bernardino. I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San Bernardino at a meeting thereof held on the reqular 16th day of 1986, by the following June vote, to-wi t: AYES: Council Members Estrada.
