RESOLUTION NO. 86-214
A RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO
SOUTHERN CALIFORNIA EDISON COMPANY, A CORPORATION, OVER CITY OWNED PROPERTY
LOCATED ON THE WEST SIDE OF WATERMAN, SOUTH OF MARSHALL BOULEVARD.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDIN
AS FOLLOWS:

SECTION ONE: That the City of San Bernardino execute a Grant of Easement
9 to Southern California Edison Company, a corporation, for transmission of elect
10 rical energy and appurtenant facilities.

SECTION TWO: That the Grant of Easement referred to herein, a copy of
12 which is attached hereto, marked Exhibit "A", and is hereby referred to and
13 made a part hereof as fully as though set forth at length herein, is hereby
14 approved.
15 SECTION THREE: That the Mayor and City Clerk of the City of San Bernardino
16 are hereby authorized and directed to execute said Gr~nt of Easement on behalf
17 of the City of San Bernardino.
18 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the
19 Mayor and Common Council of the City of San Bernardino at a

CITY OF SAN BERNARDINO, a municipal corporation (hereinafter referred to as "Grantor"), hereby grants
to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter referred to
as "Grantee"), an easement and right of way to construct, use, maintain, operate, alter, add to, repair,
replace, reconstruct, inspect and remove at any time and from time to time underground electrical supply
systems and communication system5 (hereinafter referred to as "system5"), consisting of wires, underground
conduits, cables, vaults, manholes, handho1es, and including above-ground enclosures, markers and concrete
pads and other appurtenant fixtures and equipment necessary or useful for distributing electrical ene~y
and for trangnittlng intelligence by electrical means, in, on, over, under, across and along that certaln
real property in the County of San Bernardino, State of California, described as follows:
STRIP NO.2: 14 feet wide
BEGINNING at the above-rnentloned Point "A"; thence Southerly and parallel with said
1 ine, 14 feet.
Two strips of land, lying within Lot 13, Block 3, Tract No. 1809, GARDEN ESTATES UNIT NO.2, as
plat recorded in Book 26, page 22 of Maps, in the Office of the Recorder of said County;
centerlines of said strips of land described as follows:
STRIP NO.1: 6 feet wide
BEGINNING at a point in the Easterly 1 ine,
Northeast corner of said Lot 13, 27 feet; thence Westerly and parallel
lot, 51 feet; thence Southerly and parallel with said Easterly line, 9 feet
. referred to as Point "A".

Grantor agrees for itself, its heirs and assigns,. not to erect, place or maintain, nor to pennit the ~
erection, placement or maintenance of any building, planter boxes, earth fill or other structures except ~
walls and fences on the above described real property. The Grantee, and its contractors, agents and CfI
employees, shall have the right to trim or cut tree roots as may endanger or interfere with said systems P
and shall have free access to said systems and every part thereof, at all times, for the purpose of n
exercising the rights herein granted; provided, however, that in making any excavation on said property of ~ ~
the Grantor, the Grantee shall make the same in such manner as will cause the least injury to the surface i ~
of VI~~d around such excavation, and shall replace the earth so removed by it and restore the surface : ~
