HomeMy WebLinkAbout1986-205 l 1 RESOLUTION NO. 86-205 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF TWO ALLEYS LOCATED NORTH OF 3 13TH STREET BETWEEN "E" STREET AND ACACIA STREET, AND RESERVING PUBLIC UTILITY EASEMENTS UPON A PORTION THEREOF. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council of the 7 City of San Bernardino hereby declares its intention to order 8 the vacation of two alleys located North of 13th Street between 9 "E" Street and Acacia Street, in said City, which said portion 10 is more particularly described as follows: 11 Those certain alleys located between the West line 12 of "E" Street and the East line of Acacia Street, 13 and from the North line of 13th Street, and a point 14 approximately 200 feet North thereof as delineated 15 on the map of Sunset Heights Subdivision as per plat 16 recorded in Book 17 of Maps, page 32 ot.records of 17 San Bernardino County, State of California. 18 SECTION 2. That the Mayor and Common Council of the 19 City of San Bernardino, in vacating the above described alleys, 20 elects to proceed under and in accordance with the provisions 21 of the "Public Streets, Highways and Services Vacation Law", 22 being Division 9, Part 3, of the Streets and Highways Code 23 of the State of California. 24 SECTION 3. That the hour of 9:00 A.M. on the 7th day 25 of July, 1986, in the Council Chamber of the City Hall, San 26 Bernardino, California, be, and the same hereby is fixed as the 27 time and place when and where all persons interested in or 28 objecting to the proposed vacation may appear before the said ,... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Mayor and Common Council and offer evidence in relation thereto. For further particulars as to the proposed vacation of the hereinbefore described alleys, reference is made to that certain map marked IIPlan No. 700711 approved June 2, 1986, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities and for public utility purposes belonging ei ther to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and for this City an easement reasonably necessary to locate such sanitary sewer and public utility facilities, over, in, under or across said alleys. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street V a cat ion to b e p 0 s t e d a s r e qui red by the' II Pub 1 i cSt r e e t s , Highways and Services Vacation Lawll. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published once a week for two successive weeks in The Sun, a newspaper published and circulated in the City of San Bernardino, prior to the date of the above public hearing.
