HomeMy WebLinkAbout1986-144 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 86-144 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF THAT CERTAIN UNNAMED EAST/WEST STREET LOCATED AT THE SOUTHERLY TERMINUS OF VARSITY AVENUE, AND RESERVING AN EASEMENT FOR SEWER FACILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of that certain unnamed east/west street located at the Southerly terminus of Varsity Avenue, in said City, which said portion is more particularly described as follows: Those portions of that certain unnamed East/West Street located at the Southerly terminus of Varsity Avenue, described as follows: That portion of Section 18, Township 1 North, Range 4 West, San Bernardino Base and Meridian if the lines of the Government Survey map approved by the United States Surveyor General dated June 21, 1872, were extended over the Rancho Mus~upiabe, as per plat thereof recorded in Book 7 of Maps, Page 23, records of said County, described as follows: Commencing at the Southeast corner of said Section 18; thence North 89019150" Vlest along the South line of said Section 18, a distance of 607.42 feet to an intersection with the Westerly right of way line of Devil Canyon (State Street) Road as said Road is described in the Quitclaim Deed from the San Bernardino County Flood Control District, a body politic and corporate recorded June 21, 1957, in Book 4262, Page 156, Official Records in the office of the County Recorder of said County, said road being. 60.00 feet wide; thence North 20052150" East along the Westerly right-of-way, a distance of 417.52 feet to an intersection with the right-of-way 1 i ne of the Barstow Freeway; thence South 400 18102" West, a di stance of 135.34 feet; thence North 200 52150" East, a distance of 134.74 feet to the beg inn i n 9 0 f a ta n 9 e n t cur v e ; the nee a 1 0 n 9 sa i d curve concave to the Northwest with a radius of 1125 feet and a central angle of 35038'45" a distance of 699.90 feet; thence South 71009'25" West a distance 1 r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 of 120.00 feet to the True Point of Beginning; said point being on a non-tangent curve, concave South- westerly and having a radius of 50.00 feet, the radial line from the point of beginning is South 710 0912511 West; thence Northwesterly and ~~esterly along s aid cur vet h r 0 ugh ace n t r a 1 a n g 1 e 0 f 1 2 60 5 2 1 1 2 II, a distance of 110.715 feet to the beginning of a reverse curve concave to the Northwest, having a radius of 50.00 feet; thence Westerly along said curve through a central angle of 3605211211, a distance of 32.18 feet; thence South 7100912511 West, a distance of 137.15 feet to the beg.inning of a tangent curve concave Northerly, having a radius of 20.00 feet; thence Northerly along said curve through a central angle of 900 a distance of 31.42 feet to Point IIAII; thence South 7100912511 West, a distance of 60.00 feet to Point liB II and being the beginning of a non-tangent curve concave to the Northwest having a radius of 20.00 feet a radial 1 i n e 0 f s aid cur v eat s aid poi n t b ear s Sou t h .'710 0912511 West; thence Southerly and Southwesterly a 1 0 n g sa i d cur vet h r 0 ugh ace n t r a 1 an g 1 e 0 f 900 , a di stance of 31.42 feet; thence South 7100912511 West, a distance of 140.00 feet to the beginnng of a tangent curve concave to the North, having a radius of 50.00 feet; thence Westerly along said curve t h r 0 ugh ace n t r a 1 a n g 1 e 0 f 3 60 5 2 1 1 2 II, a d i s tan ceo f 32.18 feet to the beginning of a reverse curve concave to the Northeast, having a radius of 50.00 feet; thence Westerly, Southerly and Easterly along said curve, through a central angle.<of 25304412411, a distance of 221.43 feet to the beginning of a reverse curve concave to the Southeast having a radius of 50.00 feet; thence Easterly along said curve through a central angle of 3605211211, a di stance of 32.18 feet; thence North 7100912511 East, a distance of 377.15 feet to the beginning of a tangent curve concave to the South, having a radius of 50.00 feet; thence Easterly along said curve t h r 0 ugh ace n t r a 1 a n g 1 e 0 f 3 60 5 2 1 1 2 II, a d i s tan ceo f 32.18 feet to the beginning of a reverse curve concave to the Northwest having a radius of 50.00 feet; thence Easterly and Northerly along said curve through a central angle of 1260 5211211, a di stance of 110.715 feet to the True Point of Beginning. EXCEPTING THEREFROt~ that portion thereof lying between a line drawn South 1805013511 East from Point II All and a 1 i ne drawn South 1805013511 East from Point IIBII. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion 2 of sa ids t r e e t, e 1 e c t s to pro c e e dun de ran din a c cor d an c e wit h the provisions of the "Public Streets~ Highways and Services Vacation Law", being Division 9, Part 3, of the Streets and Highways Code of the State of California. SECTION 3. That the hour of 9:00 A.M. on the 19th day of May, 1986, in the Council Chamber of the City Hall, San Bernardino, California, be, and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the said ~1 a y 0 ran d Com m 0 n C 0 u n c i 1 and 0 f fer e v ide n c e i n r e 1 a t ion thereto. For further particulars as to the proposed vacation of the hereinbefore described portion of said street, reference is made to that certain map marked "Plan No. 6941" approved April 21, 1986, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appur~enant facilities and there is hereby reserved for this City an easement reasonably necessary to locate such sanitary sewers in, over, under and across the real property hereinabove described and to use, maintain, repair, replace or renew such facilities. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as ..required by the "Public Streets, Highways and Services Vacation Lawll. SECTION 6.
