At that time, staff was directed to negotiate the sale of a portion of the subject property to the City of Sen Bernardino Water Department. The agency purchased the property to provide the Water Department with the land necessary to construct a water filtration facility, and to provide single family housing in accordance with the designated land use. Several proposals were considered by the Planning Commission which received overwhelming opposition from residents in the surrounding area. By acquiring the subject property, the Agency is now able to facilitate the Water Department facility, and a future single family housing development to complement the surrounding neighborhood. IL is proposed that the REDEVELOPMENT AGSHCY OF THE CITY OF SAH BERNARDIRO ("Agency") sell to THE CITY OF SAH BERftARDIftO WATER DEPARTMBNT ("Developer") that certain parcel of real property identified as APR 149-11-019, 020, 021, 022, 023 & 024, located at 2730 ftorth "E" Street, as net forth in the map attached as Exhibit A. BACKGROUND The aub~ect property contains 30,060 square feet and is unimproved. The Developer proposes to purchase the property and improve it wader the terms of the Disposition Agreement. COST TO THE AGSHCY The original and continuing cost of the agreement to the Agency, including land acquisition costa, clearance costa, relocation costa, the costs of any improvements to be provided by the Agency, plus the expected interest on any loans or bonds to finance the agrement are provided below: Purchase Price $130,204.27 ® TOTAL COST: X130.204.27 ESTIMATED VALUE The estimated value of the interest to be conveyed or leased, determined at the highest uses permitted is $1.66/s.f. or $50,000. The estimate of fair market value was derived from a review of five (5) comparablea is the surrounding area. PURCHASE PRICE The purchase price of the aub~ect property is $75,000 cash, which exceeds the $50,000 established fair market value. A copy of the form of Disposition Agreement and Grant of Easement Agreement is available upon request and set forth as attached in Exhibits B & C. San Bernardino, California (the 8 "City") is a municipal corporation and a charter city duly 9 created and existing pursuant to the Constitution and laws o! the 10 State of Calilornia; and 11 12 WHEREAS, the Community Development Commission o! the 13 City o! San Bernardino (the "Commission") on behal! o! the 14 Redevelopment Agency o! the City of San Bernardino (the 15 "Agrncy")~ is a redevelopment agency, a public body, corporate 16 and politic o! the State of Calilornia, organized and existing 17 pursuant to the Community Redevelopment Law (Part 1 0! Division 18 24) commencing with Section 33000 0! the Health and Safety Code 19 0! the State of California (the "Act)"; and 20 21 WHEREAS, the Redevelopment Plan for the Uptown ~ Redevelopment Project (the "Redevelopment Plan") was previously 23 approved and adopted by the Mayor and Common Council o! the City 24 of San Bernardino by Ordinance No. MC-527, dated June 18, 1986; ~ and 26 27 WHEREAS, Section 33391 0! the Act provides that a ~ redevelopment agency may acquire any real or personal property -1- /~i 0 0 1 within a redavalopmant project area or for the purposes o! 2 redavalopmant and Section 33430 of the Act provides that a 9 rsdwelopmant agency may dispose of any real or personal property 4 within a redevelopment project area or for the purposes of 5 redevelopment; and 6 ~ WHEREAS, the Agency and the City desire to enter into 8 a certain Disposition Agreement (the "Agreement"), a copy of 9 which is attached hereto as Exhibit "A" and incorporated herein 10 by reference, pursuant to which, among other matters, the City 11 would acquire lrom the Agency certain real property (the 12 "Property") which is described in Exhibit "A" to the Agreement. 13 The Property is located in close proximity to the area which is 14 subject to the Redevelopment Plan (the "Project Area"). The 15 acquisition of the Property would ba for use by the San 16 Bernardino Water Department in order to provide water services to 17 the area surrounding the Property, and the Property shall be used in conformity with the Redevelopment Plan; and 18 19 ~ WHEREAS, the Agency and the City desire to enter into 21 a certain Grant of Basement ("Easement"), a copy of which is ~ attached hereto as Exhibit "B" and incorporated herein by ~ reference, pursuant to which, the City would acquire from the 24 Agency an easement for ingress and egress across certain real ~ property which is described in Exhibit "B" to the Easement, until ~ such time as the City accepts the dedication of Acacia Street; 27 and 28 /// _Z_ 0 0 1 WHEREAS, the Agency Sta!! has prepared and sade 2 available for public inspection a certain Summary Report (the g "Summary") concerning the proposed Agreement and Easement, as 4 required by Health and Safety Coda Section 33433, a copy o! which 5 is on file with the Agency and is incorporated herein by 6 reference; and 7 8 WHEREAS, the City Statf has duly noticed and conducted 9 a public hearing in accordance with the requirements o! Health 10 and Safety Coda Section 33433 concerning the proposed sale o! the 11 property by the Agency to the City pursuant to the proposed 12 Agreement and the proposed grant o! an easement for ingress and 13 egress by the Agency to the City pursuant to the proposed 14 Easement; and ',, ® 15 16 WHEREAS, the City has duly noticed and conducted a 17 public hearing in accordance with the requirements o! The Council finds and determines that 5 the use o! the Property as described in the proposed Agreement is 6 within the scope, terms and provisions of the Redevelopment Plan. 7 8 ~,CTION 2. The Council finds and determines that 9 the consideration to be paid by the City !or the Property is not 10 less than the lair market value o! the Property. I1 12 SECTION 3. The City has held a public hearing on 13 the disposition o! the Property and the grant o! an easement in 14 accordance with Health and Safety Code Sections 33431 and 334333 ® 15 and hereby accepts and approves the Summary as prepared by Agency 16 staff. 17 18 LSECTiON 4. The Council hereby approves the proposed 19 Agreement and the conveyance o! the Agency's interest in the ~ Property to the City. San Bernardino (the "Commission") on behalf of the 9 Redevelopment Agency of the City of San Bernardino (the 10 "Agency"), is a redevelopment agency, a public body, corporate 11 and politic of the State of California, organized and existing 12 pursuant to the Community Redevelopment Law (Part 1 of Division 1$ 24) commencing with Section 33000 of the Health and Safety Cods 14 0! the State o! California (the "Act)"; and © 15 16 WHEREAS, the Redevelopment Plan for the Uptown 17 Redevelopment Project (the "Redevelopment Plan") was previously 18 approved and adopted by the Mayor and Common Council of the City lg of San Bernardino by Ordinance No. MC-527, dated Jura 18, 1986; ~ and 21 ~ WHEREAS, Section 33391 of the Act provides that a ~ redevelopment agency may acquire any real or personal property 24 within a redevelopment project area or for the purposes of ~ redevelopment and Section 33430 of the Act provides that a ~ redevelopment agency may dispose of any real or personal proparL,ty 27 within a redevelopment project area or for the purposes of ~ redevelopment; and -1- o a 1 WHEREAS, the Agency and the City of San Bernardino (the 2 "City") desire to enter into a certain Disposition Agreement (the $ "Agreement"), a copy of which is attached hereto as Exhibit "A" 4 and incorporated herein by reference, pursuant to which, among 5 other matters, the City would acquire from the Agency certain 6 real property (the "Property") which is described in Exhibit "A" ~ to the Agreement. The Property is located in close proximity to 8 the area which is subject to the Redevelopment Plan (the "Project 9 Area"). The acquisition of the Property would bs for use by the 10 San Bernardino Water Department in order to provide water 11 services to the area surrounding the Property, and the Property 12 shall be used in conformity with the Redevelopment Plan; and iS 14 WHEREAS, the Agency and the City desire to enter into Q 15 a certain Grant of Easement ("Easement"), a copy o! which is 16 attached hereto as Exhibit "B" and incorporated herein by 17 reference, pursuant to which, the City would acquire from the 18 Agency an easement for ingress and egress across certain real 19 property which is described in Exhibit "A" to the Easement, until ~ such time as the City accepts the dedication of Acacia Street; 21 and ~ WHEREAS, the Agency Staff has prepared and made ~ available !or public inspection a certain Summary Report (the ,i ~ ~ "Summary") concerning the proposed Agreement and Easement, as f 26 required by Health and Salety Coda Section 33433, a copy of which 27 is on Tile with the Agency and is incorporated herein by ~ reference; and I ~ a -2- 1 ® ~ ~ 1 WHEREAS, the City Staff has duly noticed and conducted 2 a public hearinq in accordance with the requirements of Health 3 and Salsty Coda Section 33433 concerning the proposed sale of the 4 Property by the Agency to the City pursuant to the proposed 5 Agreement and the proposed grant of an easement !or ingress and 6 egress by the Agency to the City pursuant to the proposed ~ Easement; and 8 9 WHEREAS, the City has duly noticed and conducted a 10 public hearinq in accordance with the requirements o!
