BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Arrow Power Sweeping is the lowest 7 responsible bidder for providing Sweeping Services for Central 8 City Mall Surface Parking Spaces and Three-Level Parking Structure 9 in accordance with Plan No. 7085, for the total annual amount of 10 $42,000.00, a contract is awarded to said bidder accordingly, but 11 such award shall be effective only upon the contract being fully 12 executed by the parties; all other bids therefor are hereby 13 rejected; and the Mayor is hereby authorized and directed to 14 execute said contract on behalf of the City; a copy of the 15 contract is attached hereto, marked Exhibit "A" and incorporated 16 herein by reference as fully as though set fprth at length. 17 SECTION 2. Execution and Amendments. NOTICE INVITING BIDS NOTICE IS HEREBY GIVEN that the City of San Bernardino will receive bids or proposals for: Provision of Sweeping Services for Central City Mall Surface Parking Spaces and Three-Level Parking Structure. Deliver all bids to the Public Works Office, Room 405, City Hall, 300 N. "0" Street, San Bernardino, California, with the specification title and number clearly marked on the outside of the envelope. " , Said bids or proposals will be received up to the hour of 2:00 p.m. on Auqust 4 , 1987, at which time all of said bids or proposals will be publicly opened, examined and declared in the Public Works Conference Room in the Convention Center. No bid will be received unless it is made on a proposal form furnished by the City. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract, if his bid is approved by the Mayor and Common Council and the Mayor is authorized to execute the contract. In the event the bidder re- fuses to execute said contract, the use by the public of the improvements will be delayed, and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder agree that the above sum of 10% shall be paid to the City upon the condition above set forth as liquidated damages and not as a forfeiture. All bonds furnished pursuant to this notice must be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. .. . Action by the Mayor and Common Council in approving a bid proposal and authorizing the Mayor to execute a contract shall be deemed to obligate the bidder to proceed in accordance with the bid bond to execute the contract and provide required documentation (e.g., insurance policies and performance bond) to the City. No work shall be undertaken toward the completion of the contract, nor subcontracts entered into, until the contract has been fully executed by both the Contractor and the City. The Contractor will be required to adhere to the Federal Minimum Wage ($3.35) for payment for per diem wages for each workman needed in execution of this contract under the jurisdiction of the Mayor and Common Council of the City of San Bernardino. It shall be mandatory upon the contractor to whom the contract is awarded and upon any sub-contractor under him to pay not less than said specified rates to all laborers, workmen, and mechanics employed by them in the execu- tion of the contract, and to prevent discrimination in the employment of persons because of race, creed, color, national origin, sex, age, or marital status. . . ~ . The Contractor may substitute securities for any monies withheld by the Agency to ensure performance under the contract as provided for in Section 4590 of the California Government Code and Section 10263 of the California Public Contract Code. The term of the contract will continue from July 1, 1987 to the termination date of June 30, 1988, renewable for up to two (2) additional one year periods by mutual agreement by the City and Contractor. Bid prices to be adjusted by mutual agree- ment, by the City and Contractor, based on cost of living increases. Bids will be based on the period from 7-1-87 to 6-30-88. Payments to the Contractor will be prorated from the date of the Notice to Proceed. The City of San Bernardino reserves the right to reject any and all bids. No bidder may withdraw his bid within 30 calendar days from the date of the bid opening. Specifications may be obtained from the Public Works Office, Convention Center, City Hall, 300 North 11011 Street, San Bernardino, California, 92418, upon a non- refundable payment of $2.00 for each set. Plans are available for review by the bidder by contacting the Public Works Office, City Hall, 300 North "011 Street, San Bernardino, California, 92418. A mandatory pre-bid field review for all prospective bidders will be conducted on July 28 , 1987, at 10:00 a.m. The review will commence at the Public Buildings Office in the basement of City Hall. Attendance is a prerequisite to submitting a bid. All bidders shall be pre-qualified prior to submitting a bid. Pre-aualification shall consist of completing the Pre-qualification Form, attached as Appendix IIAII, and submitting it to the Public Buildings Division Office in the basement of City Hall, seven (7) calendar days prior to bid opening. These forms will be reviewed by the Public Buildings Superintendent, whose decision shall be final. No bid will be received from a bidder who has not been pre-qualified. Owner - The City of San Bernardino. Board - The Mayor and Common Council of the City of San Bernardino. Engineer - The Director of Public Works/City Engineer for the City of San Bernardino. . Supervisor - The Superintendent of Public Buildings, or his authorized representative. Notice Advertising for Bids - Notice Inviting Bids. Standard Specifications - Standard Specifications for Public Works Construction. Heavy Items of Work - Any item of work that could disrupt the opera- tion of the facility or present a safety hazard to employees or the public, such as steam cleaning the pedestrian access points. Other terms appearing in the Standard Specifications, and these Special Provisions, shall have the intent and meaning specified in Section 1-2, IIDEFINITIONS," in the Standard Specifications. In case of conflict between the Standard Specifications, and these Special Provisions, the Special Provisions shall take precedence over and be used in lieu of such conflicting portions. SP - 1 SECTION 2 2-1 PROPOSAL REQUIREMENTS AND CONDITIONS 2-1.01 GENERAL -- Bids must be submitted on the proposal form contained herein. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract if his proposal is approved and the Mayor is authorized to exe- cute the contract. In the event the bidder, whose proposal is approved, re- fuses to execute said contract, the use by the public of the improvements will be delayed and the public will suffer great damage. SECTION 3 3-1 AWARD AND EXECUTION OF CONTRACT 3-1.01 GENERAL -- Action on the contract is expected to be taken by the Mayor and Common Council at thpir regularly scheduled meeting of . _ Auqust 17 , 1987. The bidder whose proposal is approved by the Mayor and Common Council, with the Mayor authorized to execute the contract, shall file with the Engineer all required bonds and insurance policies, and execute the contract within 10 calendar days after receiving notification of the approval. Failure to file the stipulated documents and execute the con- tract within the prescribed time shall constitute good and sufficient grounds for recession of the award and payment of 10% of the bid to the City as liquidated damages. Action by the Mayor and Common Council in approving a bid proposal and authorizing the Mayor to execute a contract shall be deemed to obligate the bidder to proceed in accordance with the bid bond to execute the contract and provide required documentation (e.g., insurance policies and performance bond) to the City. No work shall be undertaken toward the com- pletion of the contract, nor subcontracts entered into, until the contract has been fully executed by both the Contractor and City. 3-1.02 CONTRACT BONDS --The Payment and Faithful Performance Bonds shall be filed with the Engineer before the Contract is executed by the City in accordance with Section 2-4, "CONTRACT BONDS," of the Standard Specifications. In lieu of the Bond as referenced above, the Contractor may deposit with the City, a cash amount equal to $500 VI ten percent (10%) of the total amount bid for the first year's maintenanc~, whichever is greater. The amount so deposited shall be retained by the City of San Bernardino and will be returned to the contractor upon completion of the term of the contract. There will be no interest paid to the Contractor on the amount so deposited. SP - 2 SECTION 5 5-1 LEGAL REQUIREMENTS 5-1.01 LIABILITY INSURANCE -- The Contractor's attention is directed to Section 7-3, IILiability Insurance,1I of the Standard Specifications, pro- viding that the Contractor shall furnish the City with a policy or certifi- cate of liability insurance as prescribed therein, prior to execution of the contract. Following is the required minimum limits of insurance: Bodily Injury. . $250,000 each person $500,000 each occurrence $500,000 aggregate products and completed operations $100,000 each occurrence $250,000 aggregate Property Damage A combined single limit policy with aggregate limits in the amount of $1,000,000 will be considered equivalent to the required minimum limits. SP - 4 5-1.02 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's attention is directed to Section 7-4, "WORKMEN'S COMPENSATION INSURANCE," of the Standard Specifications, providing that the Contractor shall file a signed Certificate of Workmen's Compensation Insurance before execution of the contract. . 5-1.03 PAYMENT OF WAGE RATE -- The Contractor will be required to adhere to the Federal Minimum Wage ($3.35) for payment of per diem wages for each workman needed in execution of this contract. The Supervisor shall have the right to interview any workman on the project site in order to verify payment of said wages. Also, the City retains the right to examine the Contractor's payroll records to determine if wage rates indicated are being paid. 5-1.04 SAFETY REQUIREMENTS --All work performed under this contract shall be performed in such manner as to provide maximum safety to the public and the safety standards outlined by CAL-OSHA. The Supervisor reserves the right to issue restraint or cease and desist orders to the Contractor when unsafe or harmful acts are observed or reported relative to the performance of the work under this contract. I . 5-1.05 HAZARDOUS CONDITIONS -- The Contractor shall maintain all work sites free of hazards to persons and/or property resulting from his operations. Any hazardous condition noted by the Contractor, which is not a result of his operations, shall immediately be reported to the Public Buildings Divi- sion at (714) 384-5244 or (714) 833-5044. 5-1.05 ANTI-KICKBACK ~- The Contractor shall comply with the Copeland Anti-Kickback Act and regulations of the Secretary of Labor (29 CFR, Part 3) which are herein incorporated by reference. . . . . SP - 5 SECTION 6 GENERAL 6-1.01 HOURS OF LABOR -- All items of work shall be accomplished between the hours of 11:00 P.M. and 7:00 A.M. 6-1.02 EXTRA WORK -- Any extra work done shall conform to the provisions in Section 3.3 of the Standard Specifications. However, equipment rental rates shall conform to State of California Business and Transportation Agency, Department of Transportation, Division of Construction, "LABOR SURCHARGE AND EQUIPMENT RENTAL RATES," latest edition, unless the extra work is done for a negotiated price. 6-1.03 PAYMENTS -- Payment will be made to the Contractor on or about the first day of each consecutive month during the term of the contract in an amount equal to the total amount bid, divided by the total number of months encompassed by the contract term. The first payments may be pro-rated in accordance with the actual portion of the month worked. 6-1.04 PAYMENTS WITHHELD -- The City may withhold payment to such extent as may be necessary to protect the City from loss due to the follow- ing reasons: 1. Defective work not corrected. 2. Claims filed or reasonable evidence indicating probable filing of claims. When the above reasons are removed, payment shall be made for the amount withheld. 6-1.05 SUBCONTRACTORS -- No Subcontractor will be recognized as such. All persons engaged in the work will be considered as employees of the Contractor; and the Contractor shall be held directly responsible for their work. 6-1.06 PRE-QUALIFICATION OF BIDDERS -- All prospective bidders shall complete the Pre-qualification Form for Bidders, attached as Appendix "A", and submit to the Public Buildings Superintendent for approval prior to tne bid opening. No bid will be accepted from a bidder that has not been pre-qualified by completion of the form and approval by the Public Buildings Superintendent. A Pre-qualification Form for Bidders, approved by the Public Buildings Superintendent, shall be included in the bid proposal. 6-1.07 PAYMENT -- Full compensation for conforming to the requirements of Section 6 shall be considered as included in the prices paid for the various contract items of work involved and no additional compensation will be allowed therefor. SP - 6 SECTION 7 DESCRIPTION OF WORK 7-1.01 GENERAL -- It is the intent of these Special Provisions that the sweeping services provided hereinafter shall be adequate to maintain these facilities in a safe and attractive condition. All services shall be provided in a good workmanlike manner, consistent with the standards of the industry. 7-1.02 DESCRIPTION OF FACILITIES -- Sweeping services are to be pro- vided for the following facilities: 1. Central City Mall - 2,516 Surface Parking Spaces. 2. Three-Level - 1,170 Space Parking Structure. 3. Vehicular Entrances to Surface Parking Spaces and Parking Structure. 4. "E" Street Pedestrian Bridge. 5. Pedestrian Entrances (9) to Central City Mall. 6. All Pedestrian Areas within the Central City Parking Lots and Three-Level Structure including all stairways. 7-1.03 SUPPLIES AND EQUIPMENT -- All supplies and equipment required to accomplish the items of work specified herein shall be provided by the Contractor. SP - 7 SECTION 8 TECHNICAL SPECIFICATIONS 8-1.01 DESCRIPTION -- The Central City Mall parking lots provide 2,516 surface parking spaces, with curbed islands for planting. The 3-level parking structure provides 1170 parking spaces. The nine entrances are those vehicular access points to the Mall parking facilities. All pedestrian areas around the Mall are included in this contract, including the IIEII Street pedestrian bridge. 8-1.02 ITEMS OF WORK -- The following listed items of work shall be accomplished on a daily basis, Monday through Sunday, including the holidays that the Mall is open for business.
