INVOICE FOR WATER DAMAGE CLEANUP - CALIFORNIA THEATRE OF THE
PERFORMING ARTS LOCATED AT 562 WEST 4' STREET (CENTRAL CITY NORTH
REDEVELOPMENT PROJECT AREA)

On June 23, 2008, the California Theatre of the Performing Arts ("Theatre") on-site manager
discovered a water flow in the 2nd floor men's restroom apparently caused by a malfunctioning urinal
valve. The flow of water exceeded the urinal drain capacity which then overflowed the urinal basin
and flowed onto the restroom floor to the floor drain which also malfunctioned. The water then soaked
through the floor along the walls and through the ceiling and onto the carpeting of the 1St floor.
To prevent further damage to the floors, walls and ceilings of the Theatre, the Agency immediately
called ACR Services, located at 1330 West 25th Street, San Bernardino, CA, a certified water
extraction company familiar with the Theatre to extract the water and remove moisture from the
building. Additionally, the Agency obtained a hygienist, Jovec Consulting, to test the building for
Coliform and E. Coli bacteria and other possible hazardous substances and organisms.
The original cost estimate was within the Agency's $25,000 purchase order authority, but because of
the extent of the water flow that was unseen inside walls and inside the ceilings and because harmful
bacteria was found in the carpeting and along the base of the walls, these areas had to be sanitized, the
final invoice exceeds the $25,000 limit.
Current Issue:
The Agency's purchasing policy requires any contract or payment exceeding the $25,000 amount be
referred to the Redevelopment Committee for its consideration and recommendation to the Community
Development Commission of the City of San Bernardino for its consideration for payment.
In a separate action, Agency Staff and Agency Counsel will be analyzing the circumstances and the
cause of the water flows and malfunctions so that the problems are addressed and corrected and future
events of this nature are minimized.
Environmental Impact:
The Theatre has been sanitized and certified safe for occupancy and use by Jovec Consulting.
Fiscal Impact:
The $27,308.30 invoice for the removal of water and to sanitize the Theatre is within the amount
budgeted in the Agency's contractual service budget line item.
