Description) Finance: Council Notes: Agenda Item No. ~ IfJI O'6~ 04- O~ CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution of the City of San Bernardino amending Resolution No. 2007-345 Section 2, B, Compensation and Section 2, Y. Holidays, between the City and the Management/Confidential employees. Back2round: The City Negotiation Team and members of the Advisory Committee from San Bernardino Confidential/Management Association (SBCMA) met and discussed ways to assist with the City's financial deficit for the 2008-2009 fiscal years' budget. As a result of the SBCMA's commitment to help the City during this financial crisis they have agreed to the following: NON-SAFETY MEMBERS Effective August 1, 2008 through June 30, 2009, all non-safety members of the Management/Confidential group agree to a five percent (5%) reduction in pay based on the current approved monthly salary. All step/merit increases will continue to be processed as normal. The short-term salary reduction will be administered each payroll period and reflected on the members semi-monthly payroll check. In return for the salary reduction, members, except for those employed in the City Attorney's Office, will receive eighty-eight (88) hours of time off. The hours should be scheduled off with respective department heads and used prior to January 1,2010. Any remaining hours are not subject to cash out and will be forfeited. Should the City adopt any closure dates, this time off may be applied. FIRE MANAGEMENT MEMBERS Effective August 1,2008 through June 30, 2009, all safety members who work a 24 hour shift, will only accrue 69 hours of Holiday time. The Holiday accrual rate will be reduced from 15.75 per month to 6.28 hours per month. The net result is the reduction of five (5) shifts of holiday time for each member. Savings will be visible in the reduction of overtime costs. Additionally, all 40 hour per week Fire Management Safety members have proposed utilizing 80 hours of Voluntary Time Off (VTO) prior to June 30, 2009. The net result will be approximately a five percent (5%) savings. This is not reflected in the Resolution. The City is continuing ongoing discussions with the Police Management Association (PMA) regarding the City's budget deficit. Human Resources will keep the Mayor and Common Council updated on the progress with the PMA. The City and SBCMA agree to meet and discuss extending the agreement pending review of the financial status of the City of San Bernardino for FY 2008-10, prior to July 1, 2009. It is recommended that the above be adopted. Financial Imoact: Approximately $613,500 in budget savings in FY 2008-09. Recommendation: Adopt Resolution. Holidays as follows: 9 10 "SECTION 2. B. COMPENSATION 11 7. Short-term Salary Reduction a. HOLIDAYS All participants shall receive the following paid holidays: Two (2) Floating Holidays (18 holiday hours) Holidays listed above shall be allowed on a Monday, if any such holiday falls on Sunday, and shall be allowed on the preceding Friday, if such holiday falls on a Saturday, for all employees except those covered by other provisions herein. If the Christmas and New Year holidays occur on Mondays, these holidays and the holiday eves will be observed on Mondays and Tuesdays. Non-safety employees shall accrue nine (9) hours of holiday time per holiday. Two (2) floating holidays will equal 18 holiday hours and will be placed into the employee's holiday account at the beginning of each calendar year. HOLIDAYS BETWEEN THE CITY AND MANAGEMENT/CONFIDENTIAL EMPLOYEES. 3 4 5 If a holiday falls on a nine - (9) or ten - (IO) hour work day, the employee will be paid eight (8) hours holiday pay. The employee may supplement the holiday with accrued vacation, holiday account time, or no pay. The employee will be paid nine (9) hours holiday 6 7 pay. 8 If new employees elect to "draw down" from the holiday account, the hours used will be deducted from the sixteen (16) holiday account hours they receive upon the completion of six (6) months of continuous service. Effective January 1,2006, employees may draw down from the eighteen (18) hours holiday account upon completion of six (6) months of continuous 9 10 11 service. 12 In the event of the employee's failure for any reason to take such holiday account hours during the term of this Resolution, the employees shall be paid for hislher holiday account balance, upon separation from the City. Effective January 1, 2006, non-shift employees may accrue a total balance of a maximum of 126 hours. Effective January I, 2006, safety employees will accrue nine (9) hours per holiday. Holidays earned in any twelve-month period are not accumulative beyond the total number of holidays allowed each year by this pay plan. Employees may not exceed a balance of 126 hours at any time. Police Management Police Safety Management members may sell back up to one quarter (25%) of their annual holiday leave. Maximum sell back will be 28 hours. Eligible employees shall notify the Finance Department by August I, of hislher request for sell back for the prior fiscal year ending June 30.
