Subject:
Resolution awarding a contract to Kalban, Inc. For the Construction of ADA Access and
Sidewalks at Various Locations (SS-B 2007-08), per Project Plan No. 12295.
Background:
Construction of accessibility improvements at various locations is an annual Capital
Improvement Program (CIP), targeting high priority areas first such as schools, churches,
medical centers, parks and areas of high public-foot traffic. The City's website also allows the
public to suggest locations where disabled access improvements are needed. On average,
approximately $500,000 worth of ADA access ramps and associated improvements are
completed annually. Additional access improvements are also constructed as part of other CIP
projects and through conditions imposed on development.
This project will consist of removing asphalt, curbs and gutters, and sidewalk to construct new
ADA access sidewalks and ramps.
Plans and specifications for this project were completed and the project was opened to public
bidding on May 14, 2008. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online,
Construction Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area
Chamber of Commerce.

STAFF REPORT - Continued
Based on review of the sealed competitive bids received, staff has determined that Kalban, Inc.
of Sun Valley, the apparent low bidder, has met the minimum requirements of the specifications
and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the
referenced contract to Kalban, Inc. in the amount of$294,359.
The estimated project costs are as follows:
Construction Cost Basic Bid $ 294,359.00
Contract Management and Inspection (Approx. 15% $ 44,153.85
Contingencies (Approx. 20% $ 61,487.15
Estimated Total Project Cost $ 400,000.00
If approved, this project is expected to begin construction in September of 2008 and be
completed by December of 2008.
Financial Impact:
Sufficient funds are in Account No 129-367-5504-7202 (SS-B) "Construction of ADA Access
Ramps and Sidewalk."
Recommendation:
Adopt Resolution.

3 BERNARDINO AWARDING A CONTRACT TO KALBAN, INC. FOR THE
CONSTRUCTION OF ADA ACCESS AND SIDEWALKS AT VARIOUS LOCATIONS
4 (SS-B 2007/08), PER PROJECT PLAN NO. 12295.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Kalban, Inc., 9075 Glen Oaks Blvd., Sun Valley, CA 91352, is the
8
lowest responsible bidder for the Construction of ADA Access and Sidewalks at Various
9
10 Locations (SS-B 2007/08), per Project Plan No. 12295. A contract is awarded accordingly to
11 said bidder in a total amount of $294,359.00, with a contingency amount of $61,487.15, but
12 such award shall be effective only upon being fully executed by both parties. All other bids,
13 therefore, are hereby rejected. The City Manager is hereby authorized and directed to execute
14 said contract on behalf of the City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set forth at length.

17 SECTION 2. This contract and any amendment or modifications thereto shall not take
18 effect or become operative until fully signed and executed by the parties and no party shall be
19 obligated hereunder until the time of such full execution. No oral agreements, amendments,
20 modifications or waivers are intended or authorized and shall not be implied from any act or
21 course of conduct of any party.
22 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
23
within sixty (60) days of passage of this resolution.
