RESOLUTION NO. 87-207
2 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND
DETERMINING THE FEES AND CHARGES TO BE CHARGED FOR THE COLLECTION
3 AND DISPOSAL OF REFUSE, AND REPEALING RESOLUTION NO. 83-245
AND AMENDMENTS THERETO.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The fees and charges set forth herein shall
7
apply to refuse collection services provided by the City.

SECTION 2.
A minimum twenty-five dollar ($25.00) deposit
8
9 shall be required for each new commercial refuse account. Said
10 deposit must be paid prior to the City commencing refuse collectior
11 service. This deposit shall be retained by City and applied
12 to any closing bill upon termination of service. Any excess
13 amount above the closing bill shall be refunded.
14 SECTION 3. Collection and Disposal of Refuse - Single Family
15 residences. For collection and disposal of refuse the owner,
16 or authorized agent, of any single-family residential premises,
17 or portions thereof, located within the territorial limits of
18 the City of San Bernardino, shall pay the following fees:
19 $7.00 per month for regular curbside or alley service,
20 $7.60 per month for service where containers must be
21 removed from below ground level.

SECTION 4. Collection and Disposal of Refuse - Multiple
23 Dwellings, Apartments, Etc. For collection and disposal of
24 refuse the owner, or authorized agent, of any apartment house,
25
court, mobile home park, trailer court, duplex or other multiple
26 dwelling unit complex shall pay the following fees~

It shall be the duty of the Director of Public Services
to determine the number of units actually used, or capable or
being used, for housekeeping purposes and to adjust the assessment
for such use accordingly.
SECTION 5. Collection and Disposal of Refuse - Hotels,
Off ices, "Rtc-.
(a) For collection of refuse the owner, or authorized agent,
of any hotel, office building, restaurant, shop, store, hospital,
auto court, motel or other similar place shall pay the following
fees, based on the placement for collection at not more than
two (2) thirty-two (32) gallon containers per collection:

SECTION 6. Collection and Disposal of Refuse utilizing
bins and automatic loading equipment. When refuse collection
is performed by means of bins and City automatic loading equipment

1 the monthly fee shall be as follows for each collection per
2 week. A monthly rental fee shall be charged for the use of
3 City-owned bins and shall be in addition to the collection and
4 disposal fee.

(b) All fees pursuant to this Section shall be reviewed
15 periodically and, on the basis of findings, monthly fees shall
16 be adjusted to maintain conformance with the fee schedule set
17 forth in Subsection (a) above, except that monthly fees shall
18 not be adjusted in relation to temporary variations of refuse
19 due to seasonal factors, where such variations from the average
20 do not extend beyond a three-month period.

(c) When a City-owned bin is requested for use on a temporar
22 basis, a special delivery charge of ten dollars ($10.00) shall
23 be made for each such bin, in addition to the regular monthly
24 bin rental fee; said monthly rental fee shall be prorated for
25 the period of such use, in increments of not less than one (1)
26 week. A service fee equal to twenty-five percent (25%) of the
27 regular monthly collection and disposal fee for the size of
28 bin so-utilized shall be charged for each time the bin is serviced

compaction-type containers with a capacity 3 - 8 cubic yards.

When the service performed by the City is the collection and

disposal of refuse placed for collection in City-approved

compaction-type containers having a capacity from three'C(3)
to eight (8) cubic yards, the monthly fee, for one time per
week collection, shall be as

compaction-type containers and commercial drop-bodies.
(a) When the service performed by the City is the collection
and disposal of refuse placed for collection in City-approved
compaction-type containers or commercial droR-bodies, having a ca-
pacity of 10, 20, 30 or 40 cubic yards, the fee for each time
of collection shall be as listed below. A monthly rental fee
shall be charged for the use of City-owned containers and shall

be in addition to the collection and disposal fee.

(b) In the event the City is required to pay a disposal
charge for construction material, or other refuse which is
classified as "Hard to Handle", the amount of any such additional
disposal charge, or for weight charges in excess of eight (8)
tons, shall be a debt of the customer and shall be added to
the base fee due the City.
SECTION 9. The Director of Public Services, upon request,
may provide for the special collection and removal of refuse
from any place or premises at any time, in addition to or beyond
the regular collection service schedule, or in a manner different
from normal collection practice and procedures. The rate for
any such special service shall be thirty dollars ($30.00) per
hour with a minimum charge of seven dollars and fifty cents
($7.50).
SECTION 10. All fees and charges set forth in this resolu-
tion shall be collected monthly.
SECTION 11. Any service for the collec€ion and disposal
of refuse as set forth in this reslution may be discontinued
by the Director of Public Services if any fees or charges, as
levied herein, are not paid within ninety (90) days from the
date said assessment is billed.
SECTION 12. The Hayor and Common Council may exempt from
the fee provisions and charges of this resolution certain non-
profit events in the public interest. The exemption shall be
subject to any conditions imposed by the Director of Public
Services.
SECTION 13. The Director of Public Services may provide
collection and disposal service without charge in emergency

1 situations and when Ie in the opinion of the Director, such action
2 is necessary to correct fire hazards, or other conditions which
3 present an imminent threat to health and safety.

SECTION 14. Resolution No. 83-245 and amendments thereto
5 and any other resolution in conflict herewith are hereby repealed.

SECTION 15. This resolution shall be effective
