HomeMy WebLinkAbout1987-206 1 RESOLUTION NO. 87-206 2 RESOLUTION OF THE CITY OF SAN BERnARDINO IHPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN 3 BERNARDINO FOR THE COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE. (1093 W. 5TH STREET, 1404 H. COLORADO, 1456 N. COLORADO, 450 E. 4 HOLDEN, 1327 vil. KINGtJf~1\N, 2691 N. PENNSYLVA.NIA, 2478 FJ.. ST. ELMO). 5 BE IT RESOLVED BY THE ~ffiYOR AND COr.~~ON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. The City of San Bernardino, pursuant to its 8 authority under San Bernardino Municipal Code Chapter 15.28, and 9 other laws, did lawfully cause public nuisance abatements on the 10 real property described in Exhibi t ".A.", a ttached hereto and 11 incorporated herein by reference as though fully set forth. The 12 last known owners of record as to each such parcel are also 13 specified in Exhibit !lA" 14 Due notice was given to the person or persons having an 15 interest in said property and a hearing was held by the Board 16 of Building Commissioners to hear protests and to assess the costs 17 of said abatements on said property. The Board of Building 18 Commissioners has entered its order determining the costs to be 19 reasonable and proper and imposing a lien upon the land involved. 20 Notice of the right to appeal to the Mayor and Common Council has 21 been issued to all affected property holders. The Board of Build- 22 ing Commissioners now request that the Mayor and Common Council 23 confirm the imposition of the lien. 24 SECTION 2. The matter having now come before the Mayor and 25 Common Council for confirmation of the imposition of the lien 26 imposed, the following costs are found to have been duly incurred 27 by the City pursuant to proceedings under said provisions of the 28 * * * * * * * * * * 1 San Bernardino Municipal Code and the final statements of costs on 2 file with the City Clerk are hereby confirmed and adopted as 3 special assessments: 8 Assessment Assessor's Address Amount of No. No. Assessment 1 138 201 26 1093 w. 5th St. $15,731.00 2 143 301 13 1404 N. If said s~~ is not fully paid to the City Clerk, 12 City Hall, San Bernardino, within five (5) days after the adoption 13 of this resolution as to any such individual parcel, then said sum 14 shall be and become a lien on said property pursuant to said 15 Municipal Code provisions and applicable laws and shall be 16 collected as a special assessment thereon. 17 SECTION 4. In the event said sum is nof paid as hereinabove 18 provided, the City Clerk is hereby directed to file a certified 19 copy of this resolution with the Auditor of the County of San 20 Bernardino, State of California, directing that said sum be 21 entered as lien charges against said property as it appears on the 22 current assessment rolls, to be collected at the same time and in 23 the same manner, subject to the same penalties and interest upon 24 delinquencies, as the general taxes for the City of San Bernardino 25 are collected. 26 The City Clerk shall also present for recording appropriate 27 notices of the imposition of these liens with the County Recorder. 28 * * * * * * * * * * - 2 - 28 1 I HEREBY CERTIFY that the foregoing resolution was duly 2 adopted by the Mayor and Common Council of the City of San Ber- 3 nardino at a regular meeting thereof, held on 4 the day of 15th June , 1987, by the 5 following vote, to wit: 6 AYES: Council Members Estrada, Reilly, Flores, 7 Maudsley, Minor, Pope-Ludlam, Miller 8 NAYS: None 9 ABSENT: None 10 11 ~~~Jt; // Ci ty Clerk 12 13 14 The foregoing resolution is hereby approved this day of June , 1987. 15 16 ..~' ,'/"-.
