RESOLUTION NO. _87-205
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO J & R LANDSCAPE MAINTENANCE COMPANY, INC. FOR
3 MAINTENANCE OF LANDSCAPING AND IRRIGATION SYSTEM IN SECCOMBE LAKE
STATE URBAN RECREATION AREA.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. J & R Landscape Maintenance Company, Inc.
7 is the lowest responsible bidder for maintenance of landscaping
8 and irrigation system in See combe Lake State Urban Recreation Area,
9 in accordance with Plan No. 7172, for the total amount of
10 $53,400.00, and a contract is awarded to said bidder accordingly,
11 but such award shall be effective only upon the contract being
12 fully executed by the parties; all other bids therefor are hereby
13 rejected; and the Mayor is hereby authorized and directed to
14 execute said contract on behalf of the City; a copy of the contract
15 is attached hereto, marked Exhibit IIAII and incorporated herein by
16 reference as fully as though set forth at leD~th.

SECTION 2. This contract and any amendments or
18 modifications thereto shall not take effect or become operative
19 until fully signed and executed by the parties and no party shall
20 be obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are intended
22 or authorized and shall not be implied from any act or course of
23 conduct of any party.
