Recommended motion:

increase revenue account #001-000-4670 (EDA revenue reimbursement) by

Subject:
Resolution authorizing an agreement with Strategic Education Services to provide
legislative services for the City, Water Department, and Economic Development Agency
Background:
This item is a companion to the item concerning the agreement with David Turch and
Associates (DTA). The DTA agreement will provide legislative services related to the
federal government; this agreement would result in similar services provided concerning
state government.
The City has not previously retained a firm to assist in state legislative matters.
Legislative coordination has been handled by staff in the Mayor's Office and City
Administrator's Office. These efforts have largely consisted of preparing letters for the
Mayor's signature concerning particular bills, and monitoring the status of those bills.
During the goal-setting process in 1998, the Mayor and Council identified a need to have
a more proactive legislative affairs program at both the state and federal levels (see
Governance Action Item #11, page 5 of the September 1999 Goals Update). Based upon
that discussion, staff began the process of reviewing proposals from several legislative
consultants. Four firms were considered:
• Joe Gonsalves & Son
• D.J. Smith
• JEA Associates
• Strategic Education Services
The Mayor's Office and City Administrator Fred Wilson have interviewed the firms over
the past few months. Staff is recommending that Council approve the agreement with
Strategic Education Services (SES) because it is believed that they can provide bi-
partisan access to and influence with local legislators, legislative leadership, and the
Governor's office. Additionally, the City's legislative representatives were contacted to
provide feedback on the firms. As a result of this process, approval of an agreement with
Strategic Education Services (SES) is recommended.
As the agreement indicates, SES will provide the following services:
• Work with City officials to develop a legislative agenda that promotes the goals and
objectives of the City of San Bernardino, the City of San Bernardino Water
Department, and the Economic Development Agency.
• Monitor and provide information regarding legislation under consideration by the
California Legislature, including tracking items concerning the state budget.

• Testify before committees of the California State Senate and Assembly. Such
testimony will be given only upon prior written approval of the Mayor or his/her
designee.
• Represent the City before specified state agencies, boards and commissions.
• Provide twice-monthly legislative update reports on significant California legislation
and budget issues pertinent to City officials.
Financial Impact:
The monthly retainer fee for the services of SES is $3000. The contract start date is
anticipated to be December 7, 1999. Total retainer costs for the remaining (7) months in
FY 1999-00 are anticipated to be $21,000. Additionally, the firm shall be reimbursed for
out of pocket expenses and costs (i.e. pre-approved travel or other expenses) incurred on
or behalf of the City, the Water Department and the Economic Development Agency, up
to a maximum of$1,000 for the term of the agreement. Total retainer and reimbursement
costs for FY 1999-00 are estimated to be $22,000. The contract costs are to be shared
equally by the City, the Water Department, and the Economic Development Agency.
This agreement is virtually identical to the joint funding agreement related to the David
Turch item.
The City will be responsible for administering the contract and paying the contractor.
The Economic Development Agency and the Water Department will reimburse the City
for their portion of the contract costs. A budget amendment will be needed to reflect the
following: 1) FY 1999-00 contract cost of$22,000 to be paid out of Account #001-092-
5502 (Non-Departmental professional/contractual services) and, 2) the $7,333
reimbursement from the Water Department and the $7,333 in revenue reimbursement
from EDA for their portion of the contract costs. Net cost to the City's General Fund for
FY 1999-00 is $7,334.
Recommendations:
It is recommended that the Mayor and Common Council:
1. Adopt the resolution authorizing the execution of an agreement between the City,
Community Development Commission, and Board of Water Commissioners to jointly
fund the agreement with Strategic Education Services.
2. Authorize the Director of Finance to amend the FY 1999-00 budget and increase
Account #001-902-5502 (Non-Departmental/professional contractual) by $22,000 to
reflect the FY 1999-00 cost of the contract; and increase revenue account #001-000-
4670 (EDA revenue reimbursement) by $7,333 and revenue account #001-000-4673
(Water Department revenue reimbursement by $7,333 to reflect the reimbursement to
be received from the Water Department and EDA for their portion of the contract
cost.
3. Adopt the resolution authorizing the execution of an agreement with Strategic
Education Services.
It is recommended that the Community Development Commission:
1. Adopt the resolution authorizing the execution of an agreement between the City,
Community Development Commission, and Board of Water Commissioners to jointly
fund the agreement with Strategic Education Services.

I AGREEMENT TO JOINTLY FUND CONSULTING SERVICES
2 This Agreement is entered into this day of , 1999, by and
3 between the City f San Bernardino ("City"),ty ( ty ), the Board of Water Commissioners of the City of
4
San Bernardino ("Water Department"), and the Community Development Commission of the
5
6 City of San Bernardino ("EDA").
7 RECITALS
8 This Agreement is made with reference to the following:
9 1. The parties have determined that it is advantageous to and in the best interest of
10 the Parties to engage a professional consultant for representation in Sacramento, CA., for the
11 purposes of working with City officials to develop a legislative agenda that promotes the goals
12
and objectives of the City of San Bernardino, the City of San Bernardino Water Department,
13
14 and the Economic Development Agency; Monitoring and providing information regarding
15 legislation under consideration by the California Legislature, including tracking items
16 concerning the state budget; and representing the City before specified state agencies, boards
17 and commissions.
18 2. Pursuant to an informal understanding between the parties the Mayor's Office
19 has retained the firm of Strategic Education Services.
20
3. The Parties desire to share in the costs of said Consultant.
21
22 NOW, THEREFORE, THE PARTIES HERETO DO AGREE AS FOLLOWS:
23 1. TERM OF CONTRACT. This Contract shall be for a period of one (1) year
24 commencing on the date first above shown, and terminating one (1) year thereafter, unless
25 otherwise extended by both parties. This Contract may be terminated by any party giving thirty
26 (30) days written notice prior to the end of any year of the term, to the other parties.

1 2. COMPENSATION AND METHOD OF PAYMENT. Mayor's Office has
2 agreed to pay CONSULTANT $36,000 for the term of the Agreement, payable in twelve (12)
3 monthly installments of$3,000. In addition, the fee for services will cover all basic expenses
4 incurred in Sacramento by the CONSULTANT on behalf of the CITY. Upon written approval
5
6
of the Mayor or his/her designee, the CITY shall reimburse the CONSULTANT for such pre-
7 approved travel expenses incurred in attending meetings outside the Sacramento area. The
8 maximum amount to paid by any Party shall not exceed Twelve Thousand Dollars, plus one-
9 third of all out-of-pocket expenses and costs as described in this paragraph. Strategic
10 Education Services shall be reimbursed for out-of-pocket expenses and costs incurred on San
11 Bemardino's behalf, up to a maximum of$1000 annually. Strategic Education Services shall
12
bill San Bernardino monthly for such expenses. The City of San Bernardino shall be
13
14 responsible for payment of invoices upon receipt, and shall be reimbursed one-third from the
15 remaining Parties in arrears. No other expenditures made by CONTRACTOR shall be
16 reimbursed by CITY without the prior written approval of the Mayor or his/her designee.
17 When specific project assignments are given by the Mayor of the City of San
18 Bernardino, the Agency Administrator of the City of San Bernardino, the General Manager of
19 the Water Department or the Executive Director of the Redevelopment Agency, which go
20
beyond the scope of the regular services of Consultant, payment shall be wholly the
21
22 responsibility of the Party making said assignments.

1 SERVICES AGREEMENT
2 THIS AGREEMENT is entered into this day of December 1999, by
3 and between Strategic Education Services (SES), ("CONSULTANT") and the City of San

Bernardino ("CITY").

6 WITNESSETH:
7 WHEREAS, the Mayor and Common Council have determined that it is
8 advantageous and in the best interest of the City of San Bernardino to engage a professional
9 consultant for representation on State Legislative matters; and
10 WHEREAS, the CITY desires to retain the services of the CONSULTANT for the
11
12 purpose of providing legislative advocacy and governmental affairs in matters affecting cities
in California;
13
14 WHEREAS, CONSULTANT possesses the professional skills and ability to provide
{ 15 legislative services for the CITY;
16 NOW, THEREFORE, the parties hereto agree as follows:
17 1. SCOPE OF SERVICES.
18 For the remuneration stipulated, the CONSULTANT will provide the following professional
19
services:
20
21 a. San Bernardino hereby engages the services of CONSULTANT to advise,
22 counsel and represent San Bernardino with, principally, but not limited to its
23 affairs with the Legislative and Executive Branches of the State Government.
24 CONSULTANT agrees to promote and represent the best interests of San
25 Bernardino by acting as liaison between the City and members of Senate and
26
Assembly and other State agencies and State officials. In this capacity,
27

1 CONSULTANT will be responsible for, but is not limited to providing San
2 Bernardino with a State legislative action agenda to be used as a basis for all
3
4 State funding requests; identifying and pursuing State funding programs for
5 San Bernardino programs.
6 b. Monitor and provide information regarding legislation under consideration by
7 the Califomia Legislature, including tracking items concerning the state
8 budget.
9 C. Testify before committees of the California State Senate and Assembly. Such
10 testimony will be given only upon prior written approval of the Mayor or
11
his/her designee.

13 d. Represent the City before specified state agencies, boards and commissions.
14 e. Provide twice-monthly legislative update reports on significant California
15 legislation and budget issues pertinent to City officials.
16 2. COMPENSATION AND EXPENSES.
17 a. For the service delineated above, CITY shall pay the CONSULTANT $36,000 for the
18 term of the Agreement, payable in twelve (12) monthly installments of $3,000. The fee for
19
20 services will cover all basic expenses incurred in Sacramento by the CONSULTANT on
behalf of the CITY.

22 b. Upon prior written approval of the Mayor or his/her designee, the CITY shall
23 reimburse the CONSULTANT for such pre-approved travel expenses incurred in attending
24 meetings outside the Sacramento area.
25 C. The CITY will be billed on a monthly basis for out of pocket expenses and costs
26
incurred by CONSULTANT in the course of providing services to CITY pursuant to this
27

1 Agreement up to $1,000 annually. No other expenditures made by CONTRACTOR shall be
2 reimbursed by CITY without the prior written approval of the Mayor or his/her designee.
3 3. TERM; SEVERABILITY.

5 The term of this Agreement shall commence January 1, 2000, and shall continue
6 through December 31, 2000. This Agreement may be terminated at any time by thirty (3 0)
7 days written notice by either party. The terms of this contract shall remain in force unless
8 mutually amended. The duration of this contract may be extended with the written consent of
9 both parties.
10 4, INDEMNITY.

12 CONSULTANT shall indemnify, defend and hold harmless the CITY, its officers,
employees and agents (including, without limitation, reasonable costs of defense and
13
14 reasonable attorneys' fees) arising out of or related to CITY'S performance of this
15 Agreement, except that such duty to indemnify, defend and hold harmless shall not apply
16 where injury to person or property is caused by CITY'S willful misconduct or negligence.
17 CITY shall indemnify, defend and hold harmless the CONSULTANT, its officers, employees
18 and agents (including, without limitation, reasonable costs of defense and reasonable
19
20 attorney's fees) arising out of or related to CONSULTANT'S performance of this Agreement,
21 except that such duty to indemnify, defend and hold harmless shall not apply where injury to
22 person or property is caused by CONSULTANT'S willful misconduct or negligence. The
23 costs, salary and expenses of the City Attorney and members of his office in enforcing this
24 Agreement on Behalf of the CITY shall be considered as "attorneys' fees" for the purposes of
25 this paragraph.

1 5. INSURANCE.
2 While not restricting or limiting the forgoing, during the term of this Agreement,
3 CONTRACTOR shall maintain in effect olicies of comprehensive P p public, general and
4
5 automobile liability insurance, in the amount of $1,000,000.00 combined single limit, and
6 statutory worker's compensation coverage, and shall file copies of said policies with the
7 CITY'S Risk Manager prior to undertaking any work under this Agreement. CITY shall be
8 set forth as an additional named insured in each policy of insurance provided hereunder. The
9 Certificate of Insurance furnished to the City shall require the insurer to notify CITY of any
10 change or termination in the policy.

6. NON-DISCRIMINATION.

13 In the performance of this Agreement and in the hiring and recruitment of employees,
14 CONSULTANT shall not discriminate on the basis of race, creed, color, religion, sex physical
15 handicap, ethnic background or country of origin.
16 7. NO EMPLOYMENT.
17 CONTRACTOR shall perform work tasks provided by this Agreement but for all
18 intents and purposes CONTRACTOR shall be an independent contractor and not an agent or
19
employee of the CITY.

8. NOTICES.

22 Any notice to be given pursuant to this Agreement shall be deposited with the United
23 Postal Service, postage prepaid and addressed as follows:

SN Chavez joined SES after more than 20 years of progressively more responsible positions
in policy, finance and administration with the California Legislature and local agencies.
In the California Legislature Bill Chavez served as Chief of Staff to Senate Majority Leader
Richard Polanco, Staff Director of the Senate Democratic Caucus. He worked as a program
analyst with the Legislative Analyst's Office and served as a consultant for a number of
assembiy policy committees.
From 1990; to 1995 Chavez served Ps Administrator of Governrnenta! Relations for the Los
Angeles County Office of Education (LACOE), a county office which serves 1.7 million K-12
students or more than 27% of all students in the State of California. LACOE manages
payrol! and accounting for 132 district and joi-t power agencies. LACGE performs the
treasurers functicn for these agencies.
Cha-vez was a founding member of the Ch cano-Latino Youth Leadership Project and
currently serves on Los Angeles Ihtzyor Richard Riordan's Task Force on Primary Centers, the
Flnends of Camp Sacramento Board cf Drrectcrs and the University o` California at Santa
Cruz Foundation.
Bill has 3 B.A. degree with honors in Po!itics from Merrill College at the University of
California at Santa Cruz and has multiple credits from the University of Southern California's
Graduate School of Education.
Chavez is married to Nancy and has two sons: Nichoras, ace six, and Henri, age four.

DALE F. SHIMASARI
Dr. Shimasaki ;oined SES after more than twenty years experience in state, federal and local
education and budget policy shaping roles.
In the California Legislature, Dr. Shimasaki served for three years in the Office of the
Legislative Analyst, two years as Principle Consultant for the Assembly Budget Committee
and six years as Chief Consultant to Speaker of the Assembly, Willie L, Brown, Jr. From
1992 through 1996 Dr. Shimasaki served as Director of Research and Director of
Governmental Relations for the City College of San Francisco,
Dr. Shimasaki has held numerous posts in research and special studies during his professional
career, including positions as Instructor at the University of California at Berkeley, San
Francisco State University and City College of San Francisco. He has served as advisor and
researcher for the Congressional Budget Office and the Chancellor's Budget and Program
P,evievv Committee at the University of California.
On leave from his educational policy and financial management duties, Dr. Shimasaki has
served for the past two years as Executive Director of the Civil Liberties Public Education
Fund, a federal board appointed by the President of the United States to educate the public
regarding the incarceration of Japanese Americans during world War N.
A certified personal financial planner, Dr. Shimasaki has authored numerous reports and
academic papers on education policy and finance including "The Implementation of Voter
Approved Entitlement for K-12 Education: Budgetary Responses to Proposit:on 98", and
"Sources of Growth in Local Government Employment: California 1964-1978 , published in
The American Economic Review.
Dr. Shimasaki received his B.A. in Economics from the University of California, Berkeley and
Was awarded a Master of Public Policy degree from the UC Berkeley School of Public Policy in
1978. In 1994 he received his Ph.D. in Education Administration from the UC Berkeley
School of Education.
