Staff Report
SUBJECT:
Resolution Authorizing Execution of an Agreement and Grant Deed --- Sale of City and Water
Department Property located on the Northwest Corner of University Parkway and Kendall Drive.
BACKGROUND:
The subject property consists of three parcels ofland totaling 6.6 acres, located at the northwest
corner of University Parkway and Kendall Drive. Parcel A (0151-241-03 and 0151-241-12) was
acquired in June 1921, from the Muscupiabe Land and Water Company by the Water
Department. The City acquired Parcel B (0266-115-14) in February 1965, from John R. Munn,
Trustee.
The Board of Water Commissioners approved the sale of the Water Departments portion of this
land in July 1999. The Water Department acquired an appraisal and a review appraisal of this
property, with the final determination of fair market value estimated at $566,000. Although the
property is 6.6 acres, only about 132,256 square feet of this is developable. The City owned
portion, which is 10,538 square feet, lies entirely within the developable area. The proceeds of
the sale will be proportioned accordingly.
On August 16,1999, this office was authorized to proceed with the sale of this property and on
September 20, 1999, Resolution No. 1999-241 giving a "Notice inviting Bids" was adopted. A
Notice was also published in the Sun Newspaper. Only one written bid was received, from
Howard Berkson, in the amount of $566,000 and was accompanied by the required 10% bid
deposit in the amount of $56,600.00
On November I, 1999, with the absence of oral bids, the bid of $566,000 was awarded to
Howard Berkson. The attached Resolution authorizes the execution of an Agreement and Grant
Deed relative to the sale of this property. Upon approval and execution, the documents will be
placed into escrow. The closing costs will be split between the City and the buyer, as is
customary.
FINANCIAL IMPACT:
Sale proceeds of $566,000 will be proportioned as follows: $52,690, less proportionate closing
costs, will go to the City, account number 001-000-4925 (Sale of property). This is based on the
appraised value of the City's portion of property. The remainder of $513,310, less proportionate
closing costs, will be transferred to the Water Department. The buyer will also reimburse one-
half of the appraisal costs, which is $1,350, to the Water Department.
RECOMMENDATION:
Staff recommends that the attached Resolution, approving execution of a Purchase and Sales
Agreement and Grant Deed be approved.

3 AUTHORIZING THE EXECUTION OF A PURCHASE AND SALES AGREEMENT
AND THE EXECUTION OF A GRANT DEED FOR THE SALE OF CITY PROPERTY
4 GENERALLY LOCATED ON THE NORTHWEST CORNER OF UNIVERSITY
PARKWAY AND KENDALL DRIVE IN THE CITY OF SAN BERNARDINO.

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the Mayor of the City of San Bernardino is hereby directed
9 and authorized to execute on behalf of said City, a Purchase and Sales Agreement, a
10 copy of which attached hereto as Exhibit "A", and a Grant Deed, a copy of which is

attached hereto as Exhibit "8", for the sale of certain City property located on the
northwest corner of University Parkway and Kendall Drive, in said City, and more fully
described in detail in said Exhibit "A" and said Exhibit "B".

SECTION 2. That the amount of Five Hundred Thirteen Thousand Three
16 Hundred Ten Dollars ($513,310) from the sale proceeds of Five Hundred Sixty Six
17 Thousand Dollars ($566,000), less proportionate closing costs, be transferred to the Water
18
Department upon the close of escrow.
