Municipal Election be consolidated with the November 2, 1999 Consolidated
Election conducted by the County of San Bernardino.

Resolution Requesting that the City's General Election in the Seventh Ward be
consolidated with the March 7, 2000 Presidential Primary Election Conducted by
the County of San Bernardino.
BACKGROUND:
On November 2, 1999, the voters of the City of San Bernardino approved Measure X, which
amended the City Charter by adding Section 14-B concerning Consolidated General Elections.
Section 14"B provides that whenever a County-wide election is scheduled to be held within sixty
(60) days after the date which a City General election would otherwise be held, the City shall
consolidate the City General election with the County-wide election.
Offices up for election on November 2, 1999 were: Members of the Common Council from the
Third, Fifth, Sixth, Seventh Wards; City Clerk; City Treasurer; and City Attorney. No candidate
for the Seventh Ward Council seat received a majority of votes in the primary election; therefore,
the two candidates receiving the highest number of votes, Wendy J. McCammack and Jim
Mulvihill, will face a run-off election.
The County Registrar of Voters Office will be conducting the Presidential Primary Election on
March 7, 2000. Pursuant to the Elections Code, a request to consolidate an election must be filed
at least 88 days prior to the election; therefore, the attached Resolution is presented for the City
Council to request the consolidation of the run-off election in the Seventh Ward with the election
being conducted by the County. December 10, 1999 is the 88th day prior to the March 7 election
and is the last day when we can file this request to consolidate the run-off election
Pursuant to newly-approved Section 14-B of the City Charter, the successful candidate elected in
the consolidated general election shall take office on April 3, 2000, which is the date of the first
Council meeting of the month following the month in which the consolidated general election
shall be held.
FINANCIAL IMPACT:
The County Registrar of Voters estimates that the run-off election will cost between $5,500 to
$7,000.00. Our 1999-2000 Fiscal Year budget included $87,000 for the November 1999
election. The Registrar of Voters' office indicates that final costs for the November 1999

election will not be ready until February 2000. We anticipate that the $87,000 already allocated
in the current budget might be sufficient to cover the costs of both the primary and run-off
elections; however, if a budget amendment is required, we will submit it when it is determined
that there are not sufficient funds in the current budget to cover both elections.
Recommendation:

Bernardino adopted Resolution 1999-297 - Requesting that the City of San
Bernardino's General Election in the Seventh Ward be consolidated with the
March 7, 2000, Presidential Primary Election conducted by the County of San
Bernardino.
Enclosed is one (1) certified copy of the resolution, one each for your files. I
respectfully request that appropriate action be taken to have the County Board of
Supervisors approve the City's request for consolidation.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO REQUESTING THAT THE CITY OF SAN BERNARDINO'S
GENERAL ELECTION IN THE SEVENTH WARD BE CONSOLIDATED WITH
THE MARCH 7, 2000, PRESIDENTIAL PRIMARY ELECTION CONDUCTED BY
THE COUNTY OF SAN BERNARDINO,
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
A. On November 2, 1999, the voters of the City of San Bernardino
voted to amend the City Charter to add Section 14-B concerning Consolidated
General Election. Section 14-B provides that whenever a County-wide election is
scheduled to be held within sixty (60) days after the date which a City general
election would otherwise be held, the City shall consolidate the City' general
election with the County-wide election
B. On November 2, 1999, a primary election was held for the
nomination of candidates for the following offices:
1.
Member of the Common Council from the Third Ward;
2.
Member of the Common Council from the Fifth Ward;
3.
Member of the Common Council from the Sixth Ward;
4.
Member of the Common Council from the Seventh Ward;
5.

City Treasurer

C. No candidate for Member of the Common Council from the
Seventh Ward received a majority of votes in the primary election; therefore, the
two candidates receiving the highest number of votes will face a run-off election
on March 7, 2000.
D.
It is desirable that the City of San Bernardino's general
election in the Seventh Ward be consolidated with the presidential primary
election to be conducted by the County of San Bernardino on Tuesday, March 7,
2000; that within the Seventh Ward of the City of San Bernardino the precincts,
polling places and election officers for the two elections be the same; that the
Registrar of Voters of the County of San Bernardino canvass the returns of the
City election; and that the presidential primary election and the City's general
election be held in all respects as if there were only one election.
SECTION 2. Municinal General Election Called. A municipal general election is
called and will be held in the Seventh Ward of the City of San Bernardino on Tuesday,
March 7, 2000, for the purpose of electing a candidate for the following office: Member
of the Common Council from the Seventh Ward.
SECTION 3. ReQuest for Consolidation of Elections.
Pursuant to Section
10403 of the Elections Code, the Mayor and Common Council of the City of San
Bernardino request that the Board of Supervisors of the County of San Bernardino

consolidate the City's municipal general election in the Seventh Ward with the
presidential primary election to be held on Tuesday, March 7,2000.
The polls for said election shall be open at 7:00 a.m. of the day of said election
and shall remain open continuously from said time until 8:00 p.m. of the same day when
said polls shall be closed, except as provided in Section 14401 of the California Elections
Code.
SECTION 4. Canvass of Returns. The Registrar of Voters of the County of San
Bernardino is hereby authorized to canvass the returns of the municipal ~eneral election
in all respects as if there were only one election with only one form of ballot. Results of
the municipal general election shall be certified to the Mayor and Common Council of the
City of San Bernardino.
SECTION 5. Procedure to Resolve a Tie Vote. In the event of a tie vote, the
City Clerk shall forthwith summon the candidates who have received the tie votes,
whether upon the canvass of the returns by the Registrar of Voters or upon recount by a
court, to appear before her at the City Clerk's Office at City Hall at a time to be
designated by her. The City Clerk shall at that time and place determine the tie by lot.
SECTION 6. Notice of Election. The City Clerk is hereby directed to publish a
notice of the municipal general election which shall contain the following:

A. The time of the election.
B. The office to be filled, specifying full term or short term.
C. The hours the polls will be open.
SECTION 7. Conduct of Election. The municipal general election called by this
resolution shall be held in such precincts and at such polling places as shall be determined
by the Registrar of Voters of the County of San Bernardino. The Board of Supervisors of
the County of San Bernardino is hereby requested to issue instructions to the Registrar of
Voters to take all steps necessary for the holding of the consolidated election. The Mayor
is hereby authorized to execute a contract for the services necessary for conducting the
municipal general election. The City of San Bernardino recognizes that additional costs
will be incurred by the County by reasons of this consolidation and agrees to reimburse
the County for any such costs.
SECTION 8. Filing of Resolution. The City Clerk of the City of San Bernardino
is directed to me a certified copy of this resolution with the Board of Supervisors of the
County of San Bernardino.
