RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A LEASE WITH ROBERT WHITESIDE FOR PREMISES
LOCATED AT 4222 NORTH SIERRA WAY FOR USE AS A POLICE COMMUNITY
SERVICE OFFICE OR OTHER LAWFUL PURPOSE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is

hereby authorized and directed to execute on behalf of said
City a Lease with Robert Whiteside for premises located at
4222 North Sierra Way for use as a police community service
office or other lawful purpose, a copy of which is attached
hereto, marked Exhibit "A" and incorporated herein by
reference as fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a

THIS LEASE is made and entered into this ~oc~ day of

~~~~ 1987, by and between ROBERT WHITESIDE
("Landlord") and the CITY OF SAN BERNARDINO ("city"), a
municipal corporation.

Landlord and City agree as follows:

1.
Recitals.
A. Landlord is the owner of the premises described
10 as 4222 North Sierra Way in the City of San Bernardino and
11 desires to lease said premises to City for use as a community
12 service office by the Police Department of the City of San
13 Bernardino, and for other lawful purposes as determined by the
14 city.

B. City desires to lease the premises from Landlord
16 pursuant to the provisions stated herein.

2.
Description of Premises. Landlord leases to City,
18 and City lets from Landlord, as herein provided, the premises
19 located at 4222 North Sierra Way, City of San Bernardino,
20 County of San Bernardino, State of California, and appurtenant
2] rights. City shall have full and unimpaired access to the
22 premises at all times and the nonexclusive right to use common
23 areas, including parking areas.

Term. The term of this lease shall be mont~-to-
25 month beginning April 1, 1987.

4.
Rent.
City agrees to pay Landlord the sum of TWO
HUNDRED
SEVENTY FIVE DOLLARS ($275.00) per month.
City shall
28 not be liable for any other costs or expenses except as agreed

to herein. Monthly rental payments shall be made in advance
and mailed to 4214 North Sierra Way, San Bernardino,
California 92407.
5. Use of Premises. The leased premises shall be used
as and for a community police center or for any other lawful
public purposes.

PaYment of utilities. City shall pay for all
electrical and telephone services furnished the premises for

11 lease.
12 7. Dutv to Maintain and Repair Premises. City shall
13 maintain all internal portions of the premises in good
14 condition and shall keep windows and doors in good repair. The
15 Landlord shall be responsible for the exterior of the
16 building, except windows and doors. City shall be liable for
17 any damage to windows and doors and for any damage above
18 ordinary wear and tear to the interior of the premises
19 resulting from the act or omission of the City or its
20 authorized representatives, but not from other persons.
21 8. Fixtures. City shall have the right to install such
22 fixtures as are necessary for the proposed use of the
23 premises, and such fixtures shall not become a part of the
24 real property.
25 9. Alterations of Premises. City may make such repairs
26 and improvements as are required to fit the premises for the
27 proposed use.
10. Fire Insurance. Landlord agrees to procure and
the term of this lease. Landlord shall pay for gas, water, and
rubbish removal furnished the premises for the term of this

1 maintain in force during the term of this lease and any
2 extension thereof, at its expense, fire insurance on the real
3 property in an amount sufficient to protect Landlord's
4 interests.
5 11. Siqns. City may erect or display on the leased
6 premises, any sign or advertising matter depicting the public
7 use of the premises.
8 12. Office Furniture. etc. All office furniture and
9 equipment, listed on the attached addendum, Exhibit 1 hereto,
10 shall be included in the lease at no additional cost to City.
11 Maintenance of the office furniture and equipment shall be at
12 the expense of the City.
13 13. Hold Harmless. City shall hold Landlord harmless
14 from all damages arising out of any injury to any person or
15 property occurring in, on or about the premises, except the
16 Landlord shall be liable to City for damage resulting from the
17 acts or omissions of Landlord or his authorized
18 representatives, and Landlord shall hold City harmless from
19 all damages arising out of any damage caused by him or his
20 authorized representatives.
21 14. Termination. Either party may terminate this lease
22 for any reason by giving two weeks' advance written notice to
23 the other party, and this lease shall terminate two weeks
24 thereafter.
25 15. Amendment. This lease may be amended or modified
26 only by written agreement signed by both parties and failure
27 on the part of either party to enforce any provision of this
28 lease shall not be construed as a waiver of the right to

1 compel enforcement of such provision or provisions, nor act to
2 release any surety from its obligations under this lease.
3 16. Notices. All notices herein required shall be in
4 writing and delivered in person or sent by certified mail,
5 postage prepared, return receipt requested, addressed as
6 follows:
