STAFF REPORT
Subiect:
Authorization to establish a Forty (40) M.P.H. Speed Limit on 5th Street between Waterman
Avenue and Pedley Road.
Backnound:
The City received a request from the County of San Bernardino to evaluate the speed limit on 5th
Street between Waterman Avenue and Pedley Road. The County and the City of San Bernardino
share jurisdiction of 5th Street within this area per the attached drawing. A speed limit has not
been adopted by either jurisdiction, making the maximum speed limit, within this section of 5th
Street, fifty-five (55) miles per hour.
There is a special education school and an elementary school located on the south side of 5th
Street. Due to this special situation, both County and City staff have agreed to evaluate the
speed limit. Consequently, an engineering and traffic survey was completed.
Two speed surveys were conducted in this area of 5th Street in accordance with State Guidelines.
One approximately six-hundred (600) feet east of Waterman Avenue and the other
approximately five-hundred (500) feet east of Cooley Avenue. The surveys measured the
critical speeds at forty-nine (49) and fifty (50) miles per hour respectively. This suggests that the
speed limit should be lowered to forty-five (45) or fifty (50) miles per hour. However, due to the
special circumstances created by the adjacent schools and pedestrian activity in the area, it is
recommended that the speed limit be lowered further to forty (40) miles per hour. The area
west of Waterman Avenue is already posted with a forty- (40) mile per hour speed limit. The
County Traffic Engineer concurs with this recommendation and is in the process of requesting
Board of Supervisors' authorization to lower the speed limit.
This item was continued from the February 7, 2000 City Council meeting to determine if the
recommended forty (40) mile per hour speed limit will be legally enforceable, since it is lower
than the critical speed. Speed zones are more often established at the first, even, five mile
increment below the critical speed.
City Attorney and Engineering Staff met and it was confirmed that the recommended speed limit
is enforceable. It was also agreed that the justification for the recommended speed zone will be
attached to the .. Request for Council Action". Consequently, attached is the engineering and
traffic survey justifying the forty (40) mile per hour speed limit as well as an excerpt from the
1996 version of the Caltrans Traffic Manual regarding procedures for establishing/changing
speed zones.

Financial Impact:
The estimated cost of $ 200.00 for the installation of the speed limit signs will come from
General Fund AccQunt No. 001-307-5111 (signing and striping materials). This action is
considered routine and there will be no major impact to the account.
Recommendation:
Adopt Ordinance establishing a forty-(40) mile per hour speed limit on 5th Street between
Waterman Avenue and Pedley Road.

The foregoing data were collected according to the methodology
for Engineering and Traffic Surveys prescribed in Section
8-03.3(B) (2) (c) of the Traffic Manual of the Department of
Transportation of the State of California. Measurements were made
by means of a radar device under conditions designed to determine
the actual speed of unimpeded traffic. Such conditions included,
without limitation, the absence of concentrated law enforcement or
other activity just prior to or while taking the speed
measurements that might alter the speed of traffic; the selection
of location(s) is/are representative of the entire speed zone; the
absence of inclement or unusual weather conditions; ~nd the
inconspicuous placement of the surveyor and his/her equipment to
enable traffic to be accurately surveyed in both directions.

Evaluation: 49.4 critical speed suggests a 45 or 50 m.p.h. speed limit. However,
due to the schools in the area, and for consistency, the area west of Waterman Av.
has 40 m.p.h. speed limit, it is recommended that the speed limit be further lowered
to 40 m.p.h. The County has jurisdiction over a large portion of this road. They
concur with this recommendation. Furthermore the Board of Supervisors has approved
the recommendation to establish a 40 m.p.h. speed limit.

11. Speed Trap -
Section 40802(b) provides thatprimafacie
speed limits established under Sections
22352(b)(l), 22354, 22357, 22358 and
22358.3 may not be enforced by radar unless
the speed limit has been justified by an
engineering and traffic survey within the last
five years.
Under Section 40802(b) an engineering
an<\ traffic survey is required where
enforcement involves the use of radar or
other electronic speed measuring devices.
Local streets and roads, as defmed in Section
40802(b), primarily serving abutting
residential property, are exempt from this
requirement
. Only one person is required for the field
work. Speeds can be read directly from
a radar meter.
. Devices, other than radar, capable of
accurately distinguishing and measuring
the unimpeded speed of free flowing
vehicles unaffected by platoon movement
may be used. Special application of
devices other than radar are particu1arly
appropriate on low volume facilities.
. A location should be selected where
prevailing speeds are representative of
the entire speed zone section. H speeds
vary on a given route, more than one
speed zone section may be required, with
separate measurements for each section.
Locations for measurements should be
chosen so as to minimize the effects of
traffic signals or stop signs.
. Speed measurements should be taken
during off-peak hours on weekdays. H
there is difficulty in obtaining the desired
quantity, speed measurements may
betaken during any period with free
flowing traffic. The weather should be
fair with no unusual conditions
prevailing. The surveyor and equipment
must not affect the traffic speeds. For
this reason, an unmarked car is
recommended, and the radar speed meter
located as inconspicuously as possible.
The meter should be placed to survey
traffic in both directions, and it should
not make an angle greater than 15 degrees
with the roadway centerline.
. In order for the sample to be
representative of the actual traffic flow,
the minimum sample should be 100
vehicles in each survey. In no case should
the sample contain less than 50 vehicles.
. Short speed zones of less than 0.8 kID
should be avoided, except in transition
areas.

B. Engineering and Traffic Surveys
Section 627 of the Vehicle Code defines the
term engineering and traffic survey and lists its
requirements. Section 627 states: "An engineering
and traffic survey shall include, among other
requirements deemed necessary by the Department
of Transportation, consideration of all of the
following: prevailing speeds as determined by
traffic engineering measurements; accident
records; and highway , traffic, and roadside
conditions not readily apparent to the driver."
The Engineering and Traffic Survey should
contain sufficient information to document that
the conditions of cve Section 627 have been
complied with and that other conditions not readily
apparent to a motorist are properly identified.
Prevailing speeds are determined by a speed
zone survey. Guidelines for a speed zone survey
include:
. The intent of the speed measurements is
to determine the actual speed of the
unimpeded traffic. The speed of traffic
should not be altered by concentrated
law enforcement, or other means, just
prior to, or while taking the speed
measurements.

. Section 22358.5 of the Vehicle Code
states that it is the intent of the Legislature
that physical conditions such as width,
curvature, grade and surface conditions,
or any other condition readily apparent
to the driver, in the absence of other
factors, would not require special
downward speed zoning.
Following are two methods of conducting
engineering and traffic surveys to be used to
establish or justify prima facie speed limits. These
methods are presented as required by the Vehicle
Code.
1. State Highways - The engineering and
traffic survey for State highways is made
under the direction of the District Traffic
Engineer. The data shall include:

10.52 OF THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH A
FORTY MILE PER HOUR SPEED LIMIT ON FIFTH STREET BETWEEN
WATERMAN AVENUE AND PEDLEY ROAD.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
SECTION 1. Section 10.52.030 of the San Bernardino
Municipal Code is amended to read:
"10.52.030 FORTY MILES PER HOUR
In accordance with and pursuant to the authority of
9 Sections 22357, 22358, and 22360, of the California
10 Vehicle Code, the Mayor and Common Council do hereby
11 determine and declare upon the basis of an engineering

and traffic
survey that a prima
