DEVELOPMENT DEPARTMENT OF TIlE CITY OF SAB BERRARDINO STAFF REPORT "K" STREET SEWER LINE EXTENSIONS The City of San Bernardino Department of Public Works has requested $49,000 in CDBG funds to construct two (2) sewer line extensions on "K" Street, between the Lytle Creek Flood Control Channel and Rialto Avenue. The first extension is from the present terminus north of the Lytle Creek Flood Control, to the north about 240 feet, which will serve the existing houses on the west side of the street. The second extension is from Belleview Avenue to a point about 337 feet to the north, which will provide sewer service to all parcels abutting "K" Street, from Belleview Avenue to Rialto Avenue. The estimates of the cost for the sewer extensions are as follows: 1. 2. North of Flood Control Channel North of Belleview Avenue $ 21,000.00 28.000.00 $ 49,000.00 Total Cost of Extensions These estimates do not include installation of the laterals or the payment of any fees. On May 7, 1992, the Community Development Citizen Advisory Committee reviewed this item and recommended to the Mayor and Common Council approval of this item. Staff has reviewed the above request for CDBG funds and finds the request by the Department of Public Works to be eligible for CDBG funding under the area benefit analysis. Inc. Bmu10vment Linkaae breement The Employment Linkage Program was approved by the Community Development Commission to provide employer incentives sufficient to foster the hiring of economically disadvantaged persons. Participation is limited to San Bernardino residents and administration of the program is largely performed by the San Bernardino Employment and Training Agency (SBETA). Under the rules of the Employment Linkage Program, each newly created job which is maintained for a period of nine (9) months (and which otherwise meets program criteria) qualifies the participating employer for a bonus of $500.00. Similarly, each new employee hired pursuant to a SBETA First Source Hiring Agreement and retained on the job for a minimum of nine (9) months qualifies the employer for an additional bonus of $500.00. Most bonus payments are for both a job and an employee and thus amount to $1,000.00 per qualified employee. An additional $500.00 bonus is payable if the employer is located in a target area, but since there are only a handful of these, few employers qualify for the maximum bonus of $1,500.00 per new employee. Incentive payments under the program are limited to not more than $100,000.00 per participating employer. Lucky Farms, Inc. ("Lucky") has acquired the old Kaney Foods facility at 1194 Brier Drive and begun an agricultural produce distribution operation. Staff is particularly heartened by this development since the old Kaney Foods facility has been vacant for years and, until recently, the owners had allowed the landscaping to deteriorate, thus contributing to blight in the Southeast Industrial Park Redevelopment Project Area. Staff is hopeful that, now that Lucky has acquired the property, landscape maintenance will no longer be a problem. Lucky currently employs one hundred (100) persons in San Bernardino and satellite locations, and plans to hire a minimum of eighty (80) more within a one (1) year period. The majority of the workforce consists of field agricultural workers who, because of Lucky's established wage rates, do not qualify under Employment Linkage Program criteria. In addition, an Employment Linkage Program Agreement has been executed by the company and approved as to form by Agency Counsel. A copy of said agreement is attached for your reference. In light of the current and potential jobs being generated by this new business, as well as its occupancy of a previously vacant and neglected building in a redevelopment project area, it seems appropriate to provide financial assistance to Lucky by entering into the subject Employment Linkage Agreement. Staff is also seeking approval of an increase in the Development Department budget of $15,000.00, the amount needed to cover the Department's obligations under the agreement. Shortly before the Redevelopment Committee meeting of May 7, 1992, during which this item was considered, SBETA informed staff that the number of employees to be covered by the subject agreement had been increased from thirteen (13) to fifteen (15). The Redevelopment Committee was verbally informed of this change and of staff's intention to have a new agreement executed by Lucky Farms, Inc. and brought forward to the Community Development Commission. With this understanding, the Redevelopment Committee recommended that the Community Development Commission approve execution of the agreement, along with increasing the Development Department budget by $15,000.00, to cover the cost thereof. A copy of the revised, executed agreement has been attached for your reference. Also attached for your reference is a site map showing the location of Lucky's new facility. Staff recommends adoption of the form motion. EUOR, Executive Director De artment ------------------------------------------------------------------------------- KJH:JMW:0019g eOMMISSIOB MBE"lIBG AGDDA Meeting Date: 05/18/1992 .Agenda Itea IhD.ber: 4- ( REVISED) EMPLOYMENT LINKAGE PROGRAM AGREEMENT THIS AGREEMENT, made and entered into the day of ,19_, by and between THE ECONOMIC DEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO (hereinafter '.Agencyll), and Lucky Farms, Inc., 1194 Brier Drive, San Bernardino. CA 92408 (hereinafter "Contractor"), sets forth the agreement between the parties /, concerning the establishment of an employment linkage program to be conducted by Contractor with financial assistance from the Agency. This program is jointly sponsored by the Agency, the Private I ndustry Council of the City of San Bernardino through its administrative entity, the San Bernardino Employment and Training Agency (SBET A), and the San Bernardino Economic Development Council (EDC). The Parties hereto agree as follows: 1 · Contractor agrees that it will undertake to employ persons certified by SBET A, who meet specified requirements, for entry level positions to be created by Contractor. Such employees shall be termed "Certified Employees". Contractor agrees to establish 15 new job positions for Certified Employees, subject to Contractor's good faith business needs, and will in good faith attempt to maintain the employment of such Certified Employees. Certified Employees shall be deemed to include those long-term, economically disadvantaged, unemployed persons and handicapped persons who are bona fide residents of the City of San Bernardino at the time of their employment and who are certified as eligible by SBET A, using that entity's standard criteria for handicapped or long-term unemployed. Contractor agrees that all recruitment for new employees in such positions shall be . (1) Jp. 11 . attempted through SBET A, which shall have exclusive referral rights during . . the first ten (1 Q) days. that any vacancy shall exist in any such position; after ten (10) days, If SBETA has not referred a candidate reasonably satisfactory to Contractor, Contractor shall be authorized to recruit through other means, but shall still consider any referrals from SBETA. Only persons who are certified as eligible under the SeET A standards, and who are residents of the City of San Bernardino at the time of their employment, shall enable Contractor to qualify for the compensation provisions of this agreement. Nothing shall prevent Contractor from referring prospective employees to SBET A for possible certification. 2. Agency agrees that it will pay to Contractor, for each new job created as herein provided, the sum of five hundred dollars ($500), payable at such time as the job has been in existence continuously for nine (9) months. In addition, Agency agrees that it will pay to Contractor, for each new Certified Employee who completes nine (9) months of service In a newly created job, the sum of five hundred dollars ($500), payable upon completion of nine (9) months of continuous service by each such individual Certified Employee. 3. All payments to Contractor under this agreement shall be in the form of a check issued by Agency within twenty (20) days after SBETA certification of job creation or duration of employment of a Certified Employee, as outlined in Paragraph 6 hereof. The aggregate total of payments to be made under this agreement shall not exceed $15.000.00 4. The parties acknowledge that, for the purposes of this agreement, employment beginning on the date that this agreement is fully executed (lithe (2) I/) Commencement Datell) shall be considered as qualifying under the terms of the agreement, provided that any employee employed as of the Commencement Date, or subsequent thereto, is otherwise a Certified Employee under this agreement. The Commencement Date shall constitute the first day of a one- year period during which creation of new jobs or employment of Certified Employees shall entitle Contractor to compensation. No compensation shall be paid as to a position unless the job remains in place for the required nine (9) months and no compensation shall be paid as to any individual Certified Employee until the employee remains continuously employed for nine (9) months. Any temporary IIbreak in service" under Contractor's existing personnel policies for pregnancy leaves, illness, military leave, or similar short term leaves of absence, shall not constitute a disqualification as to th~t employee. ;1"", 5. No job created more than one year after the Commencement Date, and no employee first hired for continuous employment more than one year after that date, shall qualify for the compensation provided for herein. 6. SSET A shall be the sole judge as to certification, and Agency and Contractor agree to be bound by a certification by that entity as determining eligibility for payment under the provisions of this agreement, both as to job creation and duration of employment of a Certified Employee. 7 · Selection of employees shall be the sole province of Contractor, subject only to the ten (10) day first referral privilege of SBETA. 8. Contractor shall fully comply with Title VI and Title III of the Civil Rights Act of 1964, and with the policy of the State of California, regarding discrimination in employment, and Contractor specifically agrees that no person shall be excluded from participation In, denied the benefits of, . ( 3) /() subjected to discrimination under, or denied employment or promotion in connection with this program, because of race, color, religion, sex, national origin, age, marital status, handicap, or political affiliation or belief. 9. The parties acknowledge that Agency shall play no role in the selection of employees, nor in any matter relating to retention, promotion, layoff or dismissal, but Agency shall have the right to terminate this agreement for non-compliance with the non-discrimination provisions of this agreement. Agency shall not be regarded as an "employer" of any person whose employment may earn Contractor compensation hereunder, and Agency shall play no role in the direction of the work of any employee. Agency is not responsible for any Injuries sustained by employees of Contractor, nor any losses sustained by employees hired pursuant to this agreement. :10. Contractor covenants that it will fully comply with all laws, rules /) and regulations of the State of California and of the United States which affect employment, and with the terms of any collective bargaining agreement between Contractor and any union or organization. Any such laws, regulations or collective bargaining agreements shall take precedence over the terms of this agreement, but only those Certified Employees hired pursuant to the terms of this agreement shall qualify the Contractor for payment hereunder. Contractor shall fully protect all employee rights and shall comply with all applicable I ndustrial Welfare Commission orders and Department of Industrial Relations, Division of Labor Standards, enforcement procedures. 11 · This agreement shall be assignable or transferable with the sale of the entire business entity known as Lucky Farms. Inc. but shall not be separately assignable, transferable or subject to attachment, except in conjunction with the sale of the entire business entity. (4) I? ,) 12. Contractor acknowledges that this is a program being undertaken by Agency in cooperation with the Private Industry Council of the City of San Bernardino and its administrative entity, SBET A, and also in cooperation with EDC. Contractor agree to cooperate fully with Agency, SBETA and EDC in their ongoing efforts to monitor and evaluate the program and the results thereof. Contractor agrees to provide information. to Agency, SSET A and EDC on an ongoing basis, extending not less than one year after payment has last been made or credit given under the provisions of this agreement. The information to be provided by Contractor shall relate 0 to determination of the sucess or failure of the program,. and no confidential information relating to the operations of. Contractor not directly. relevant to such determination shall be sought or required under this agreement. During the term of this agreement, AOgency and SBETA, through their authorized representatives, shall be granted access to ando the right to exami~e all records, books, papers or documents relating to this agreement, or to the employment of any employee certified under this agreement. 13. Contractor agrees that, during the term of this agreemen.t, no employee shall be discharged or demoted in order to create an opening for a Certified Employee. Contractor acknowledges that all positions created as certified jobs under this program, and all employees hired as Certified Employee, shall be bona fide jobs and employees, and that all employees so hired shall be regular members of Contractor's work force, subject to the same conditions of employment as the Contractor's other regular employees, and shall be subject to the same rules and regulations regarding termination, suspension or other discipline. 14. This agreement shall be subject to modification or amendment only by execution of a written amendment between the parties hereto.
