DescriPtion) Finance: Council Notes: 75-0262 Agenda I tern No. S -I CITY OF SAN BERNelDINO - REQUEST FeR COUNCIL ACTION STAFF REPORT The Water Department began the upgrades to the City's water system in 1990 in accordance with the Water System Master Plan. One of the major components of the master plan is the installation of a major water transmission facility to move water from the lower end of the basin to the higher elevations in the water system. The overall project also requires additional water storage reservoirs and pumping facilities. A portion of the capital funding for the transmission facilities and funds to acquire property for the additional water storage reservoir sites was included in the bonds issued in 1990 by the West End Water Conservation and Development Joint Powers Authority. Water Department staff conducted extensive investigations to find property at the required elevations and in close proximity to the transmission lines. There are very few parcels of land available along the transmission route that were not already developed. A site was found for the upper reservoir, elevation 1415'. In January, 1992, the Mayor and Common Council approved Resolution Number 92-43 declaring the necessity of the taking, in fee simple absolute, Lots 224, 225 and 226 of Tract No. 2258, Map Book 32, Pages 72-77 of the San Bernardino County Records, for the public use of a water storage reservoir and pumping facility. The resolution of necessity for the taking of these parcels of land was necessary for the Water Department to proceed with eminent domain should that action become necessary. Since that time staff has successfully negotiated with the property owners for the acquisition of the property. Attached is a map which shows the location of the parcels to be acquired. It .is recommended that the grant deed from William Lane and Cynthia Lancaster be accepted, and that the property be dedicated for Water Department use. URGENCY CLAUSE: It is requested.that this item be placed on the Supplemental Agenda for May 18, 1992 as the escrow cannot be closed until the Certificate of Acceptance by the City of San Bernardino has been received by the Title Company. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: The City of San Bernardino hereby accepts the Lancaster, an unmarried woman, as set forth in Exhibit "1" attached hereto and incorporated herein by reference as though fully set forth at length herein.
