Staff Report
SUBJECT:
Resolution approving and accepting the transfer of ownership of the Birch Street well building,
located in Lytle Creek Park, from the San Bernardino Municipal Water Department.
BACKGROUND:
In the mid 1930's, the San Bernardino Municipal Water Department ("Water Department")
developed a water well, known as the Birch Street Well. The well and the appurtenant building is
located within Lytle Creek Park, located on the northwest corner of "K" Street and Oak Street.
The well was shut down and abandoned in 1981. Since that time, the City Parks, Recreation &
Community Services Department ("Parks Department") has been utilizing the building for
storage of various maintenance items and to house the electrical service panel used for park
lighting and other park appurtenances.
The Risk Management Department had recently asked the Water Department to mitigate existing
potential hazardous conditions. As a result, the Water Department obtained a well abandonment
permit through the San Bernardino County Department of Public Health, and properly
abandoned and secured the well and two vaults. Since the Parks Department would like to
continue to use the building for storage, the Water Department has requested that the ownership
and maintenance responsibilities of the building be transferred to the City.
Since the underlying ownership of the land that the building is on is already in the City's name,
the Water Department requested that the transfer be accomplished formally by resolution. At
their May 20, 2008 meeting the Board of Water Commissioners approved the transfer of
ownership of the building to the City.
The Facilities Management Director has indicated that some initial repairs will need to be done
to bring the building up to standards; specifically new doors and a new roof, at an estimated cost
of $4,000, will need to be installed. Ongoing maintenance of the building is estimated at $200
per year. The Parks Department, Risk Management and Facilities Management have stated their
concurrence to the transfer.
FINANCIAL IMPACT:
Initial repairs not to exceed $4,000 will be paid from the Lytle Creek Center Renovation fund
(243-363-5504-7720, CIP Project No. PR 07-04) and ongoing maintenance, estimated to be $200
per year, will be absorbed in Facilities Management's maintenance budget.
RECOMMENDATION:
Adopt Resolution.

MAINTENANCE RESPONSIBILITIES OF THE ABANDONED BIRCH STREET
WELL BUILDING, LOCATED IN LYTLE CREEK PARK, FROM THE SAN
BERNARDINO MUNICIPAL WATER DEPARTMENT.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San Bernardino,
hereby approves and accepts the transfer of ownership and operation and maintenance
responsibilities of the abandoned Birch Street well building, located in Lytle Creek Park, as
shown on Exhibit "A" attached hereto and made a part hereof, from the San Bernardino
