Synopsis of Previous Council Action:
04-07-2008 - Resolution No. 2008-112 was adopted, approving the vacation ofa portion of
Crescent Street, between Huff Street and College Drive.
04-21-2008 - Authorization was given for the temporary establishment of diagonal parking on
"H" Street between College Drive and Huff Street.
Recommended Motion:
1. That the Director of Development Services and the City Clerk be authorized to proceed
with the proposed vacation of a portion of "H" Street between Huff Street and College
Drive; and
2.
That Plan No. 12456 showing the proposed vacation of a portion of"H" Street,
between Huff Street and College Drive, be approved.

Staff Report
SUBJECT:
Authorization to Proceed and Approval of Plan No. 12456 - Proposed vacation of a portion of
Crescent Avenue between Huff Street and College Drive.
BACKGROUND:
As part of the 1-215 freeway widening, Caltrans is acquiring the property on the west side of this
portion of "H" Street, which includes Chaparral Motorsports' parking lot. David Damron, the
property and business owner, has submitted an application requesting the vacation of the portion
of "H" Street, between Huff Street and College Drive, to use as repla,cement on-site parking for
his business. On April 21, 2008, authorization was given for the temporary establishment of
diagonal parking until the street vacation is considered and approved.
The applicant has also previously submitted a request to vacate Crescent Street, also between
Huff Street and College Drive, which was approved on April 7, 2008 by Resolution No. 2008-
112.
Since Caltrans has permanently closed "H" Street at its northerly terminus at Mill Street, traffic
circulation will be minimal in this area. The vacation of this portion of"H" Street will not impact
the properties along Huff Street, since they will still have access from Cresecent Street north of
Huff Street. The properties along College Drive and along "H" Street, south of College Drive,
will have access from Inland Center Drive.
Attached is Plan No. 12456, showing the proposed vacation. If authorization to proceed is given,
the various utility companies and City departments will be given notice of the proposed vacation,
as well as any affected property owners, for comments or conflicts. In the likely event that
utilities are located in the proposed vacation area, easements will be reserved. The results of the
notification will be presented at a future date with the Resolution of Intention.
FINANCIAL IMPACT:
None. The petitioner has paid the first half of the processing fee of $1,000. Once the
investigative proceedings are complete, the second half of the processing fee of$l,OOO will be
paid.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation is given and that Plan
No. 12456 be approved.

The vacation is requested for the following reason(s):
1 understand that a total non-refundable fee of $ 2.000.00 shall be paid by me as a cost of the
proceedings, one-half of which $1.000.00 is hereby enclosed. The remainder of $1.000.00 shall be due and
payable after the investigative proceedings are complete and prior to the commencement of the legal
proceedings. I furtber understand tbat said fees are NOT payment for any real property or
improvements tbereon, but for tbe costs of tbe vacation proceedings ONLY and tbat tbe City of San
Bernardino does NOT determine underlying ownership of the area to be vacated oor does it guarantee
title to any property involved and I have been advised to consult a title company to determine such
ownership.
I understand that at the conclusion of the investigative proceedings. the City will notify me of its
findings including and conflicts with City facilities now located in the area proposed to be vacated. or the
request by any utility company for the reservation of any existing easements and that such conflicts or
reservations may affect the intended use of the proposed area, once vacated, and that I may elect to terminate or
continue the proceedings. If I elect to continue. the remaining unpaid fees shall be paid by me prior to the
continuance of said proceedings.
I understand that the requested vacation is subject to the approval ofthe Mayor and Common Council of
the City of San Bernardino and tbat tbere is no luarantee that sucb approval will be made.
