The Mayor and Common Council approved FY 2006-07 CIP Budget.
The Mayor and Common Council authorized the Director of Finance to amend the
FY 07-08 Sewer Line Maintenance Budget by appropriating $310,000 from the
Sewer Line Maintenance available fund balance for sewer improvements on Sierra
Way from 16th Street to 19th Street, per Project plan No. 12187.
Recommended Motion:
Authorize the Director of Development Services to execute Contract Change Order No. One in the
amount of $77,217.54 to the contract with Nikola Corporation for Sewer Improvements on Sierra
Way from 16th Street to 19th Street, per Project Plan No. 12187.

STAFF REPORT
Subject:
Authorize the Director of Development Services to execute Contract Change Order No. One to the
contract with Nikola Corporation for Sewer Improvements on Sierra Way from 16'h Street to 19th
Street, per Project Plan No. 12187.
Background:
On August 20, 2007, the Mayor and Common Council authorized the Director of Finance to amend the
FY 07-08 Sewer Line Maintenance Budget by appropriating $310,000 from the Sewer Line
Maintenance available fund balance for sewer improvements on Sierra Way from 16th Street to 19th
Street, per Project plan No. 12187 and adopted a Resolution awarding the contract to Nicola
Corporation.
The project consisted of a sewer main abandonment, installation of a new sewer main, installation of
new sewer laterals, and roadway improvements. The low bid submitted by Nicola Corporation was in
the amount of $238,956.00.
Change Order:
During construction, the contractor discovered portland cement concrete (P.C.C.) beneath the asphalt,
necessitating the removal of concrete to allow the installation of the sewer main. Subsequent to the
removal of the concrete, unsuitable surface material (i.e., wet clay soils) was found and the contractor
was directed to remove and replace it with suitable materials. Additionally, during construction, the
contractor encountered an unidentified drain line, which was later found to be a pump house drain line
for San Bernardino Municipal Water Department's water well. It was necessary to remove the existing
manhole, extend the drain line, and construct a new manhole to accommodate the drain line.
Change Order No. One, is recommended in the amount of $77,217.54, which consists of the following
changes:
Item No. 1-1 Remove unforeseen 7 inches ofP.C.C.
Item No. 1-2 Increase in Bid Quantity Items No.4, No.5, No.6, No.8, & No. 10 (see attached
Contract Change Order No. One).
Item No. 1-3 Remove buried Concrete Structure.

JUSTIFICATION:
Remove unforeseen 7 inches ofP.C.C.
Item 1-1 During construction, the contractor discovered 7 inches of Portland cement concrete
No. . beneath the asphalt concrete. It was necessary to remove the concrete to allow the
installation of the sewer main. This work was nerformed on time and materials.
Increase in Bid Ouantitv Items No.4. No.5. No.6. No.8 & No. 10
Increase Bid Item No.4: During construction, the contractor encountered unsuitable
materials (Le., wet clay soils). The contractor was directed to remove the soil and replace
with suitable materials. This is an extension of Bid Item No.4.
1-2 Increase Bid Items No.5. No. 6 & No. 10: During construction, the contractor
encountered an unidentified drain line. It was determined to be a pump house drain line
for SBWD's water well. It was necessary to remove the existing manhole, extend the
drain line, and construct a new manhole to accommodate the drain line.
Increase Bid Item No.8: The contractor was directed to extend an additional sewer lateral
bid nrice. These laterals were not identified on the annroved nlans or specifications.

Remove buried Concrete Structure
1-3 At station No. 13+69, the contractor encountered a buried manmade structure (i.e.,
concrete encasement). It was necessary to remove this encasement to allow the water
discharl!e line to be relocated.
