HomeMy WebLinkAbout1987-100 1 RESOLUTION NO. 87-100 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SEQUOIA PACIFIC SYSTEMS 3 CORPORATION RELATING TO ELECTION SUPPLIES AND SERVICES FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON MAY 5, 1987. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The Mayor of the City of San Bernardino is 7 hereby authorized and directed to execute on behalf of said 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 of City an agreement with Sequoia Pacific Systems Corporation relating to election supplies and services for the General Municipal Election to be held on May 5, 1987, a copy of which is attached hereto, marked Exhibit nAn and incorporated herein by reference as fully as though set forth at length. Recitals. (a) The Mayor and Common Council desire to enter into an agreement to procure election supplies and services for the General Municipal Election (hereafter the "election") to be held on May 5, 1987 in the City of San Bernardino. (b) Contractor is in the business of furnishing election supplies and services and has offered to furnish supplies and services upon the terms stated in this agreement. 2. City agrees to purchase certain election supplies and services required for the election from the Contractor at the prices and upon the terms stated in this agreement at a cost not to exceed $40,000.00. Contractor agrees to prepare and furnish necessary supplies and services in sufficient time to enable City to comply with all requirements of the California Elections Code, the California Government Code, the Constitution of the State of California, the Charter of the City of San Bernardino, and the San Bernardino Municipal Code. 3. Unit prices shall be as set forth in Contractor's 27 attached proposal, marked Exhibit "I". The required 28 quantities of supplies shall be determined after the total 3/16/87 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 number of registered voters in Wards Five, six and Seven of the City has been ascertained. Actual quantities required may vary from those estimated in the proposal. 4. In addition to the supplies and basic services set forth in Exhibit "I", Contractor shall, at no additional charge, furnish the following special services, if and when requested by the City Clerk of City: (a) Provide a detailed calendar of election events, setting out dates and requirements of the California Elections Code. (b) Assist in the conduct of election officers' instruction classes as to proper use of DATAVOTE Voting System and general polling place procedures. (c) Provide a qualified computer operator on election day for ballot tabulation, and supervise all counting center procedures. (d) Provide all materials (logs, seals, procedures, etc.) necessary for the central counting center. (e) Make arrangement for delivery of sample ballot booklets to the u.S. Post Office in San Bernardino. (f) Package official ballots, precinct supplies, and other necessary materials, ready for delivery to inspectors. (g) Furnish general guidance throughout the election process. 5. Payment for all supplies and services shall be made upon a bill or claim filed by Contractor with City's Director of Finance. The bill or claim shall show the quantity and 3/16/87 2 1 2 3 4 5 6 character of each supply and service furnished and the sum payable computed at the appropriate unit price. The bill or claim may be filed at any time after all of the particular supply or service has been furnished. The Director of Finance shall verify the claim. If it is correct, he shall pay it. 6. Contractor is not required to provide or pay for 7 indexes to the Great Register, precinct maps, postage expense 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 for mailing of election officer's forms, compensation of election officers, sums payable for use of polling places or costs of publication of notices. 7. Contractor agrees that it will place on file with the City Clerk of City, within ten days after the execution of this agreement, a corporation surety bond or an irrevocable instrument of credit in a form satisfactory to the City Attorney, in the amount of $15,000.00 to guarantee the performance of the work contracted to be performed. Ferris, Secretary RESOLVED that any of the Pres ident, the Vice President and Chief Financial Officer, the Vice President and Division Manager of the Election Services Division, the Vice President, Voting Systems and the Secretary of Sequoia Pacific Systems Corporation, be, and each of them hereby is, authorized and empowered to execute and deliver on behalf of Sequoia Pacific Systems Corporation any and all contracts, agreements, bonds and undertakings relating to the sale of election services, systems and supplies (including hardware and software) by Sequoia Pacific Systems Corporation to states, counties, municipalities and other governmental entities or other organizations, which contracts, agreements, bonds and undertakings may include performance bonds, bid bonds, bid proposals, contract proposals and contract documents; and further RESOVLED that the persons specified in the preceding resolution are also authorized to execute and deliver on behalf of Sequoia Pacific Systems Corporation any and all other documents and instruments, and to take any and all other actions, as they, or any of them, deem necessary or advisable in connection with the performance of such contracts, agreements, bonds or undertakings made in connec tion wi th the sale of such election services, systems and supplies; and further RESOLVED that the persons authorized in the foregoing resolutions to execute and deliver such contracts, agreements, bonds or undertakings are as follows: Title Name President David N.
