June, 1991 -- Allocation of $569,950.00 to finance expansion of
Nunez Park Phase I.
12-16-91 Plans approved and authorization given to advertise
for bids.
04-06-92 Resolution No. 92-119 adopted awarding a contract to
Allied Sprinkler Co., Inc. for Phase I of the
expansion of Nunez Park, for the low bid price of
$375,602.35, and granting authorization to readvertise
for bids for the pedestrian bridge.
Recommended motion:
Adopt resolution.

Bids for installation of the pedestrian bridge, for Phase
I of the expansion of Nunez Park, were opened at 2: 00 p.m.,
Tuesday, 4-28-92.
A total of 8 bids were received, ranging from $142,688.00
to $222,222.00. The low bid of $142,688.00 is 18.9% over the
Engineer's Estimate of $120,000.00.
The total estimated project cost, for the Basic Bid, was
$476,000. This amount included $62,317.65 for contingencies.
The total amount of funds that have been allocated for
the expansion of Nunez Park is $569,950. Therefore, the current
amount of unappropriated funds is $93,950.
Supplemental funds in the aI:lount of $48,738 will be
needed to fully finance the contract price for the pedestrian
bridge. It is recommended that these supplemental funds be
obtained from the $62,317.65 designated as contingencies. This
action will reduce the contingencies to $13,579.65, which is
only 2.4 % of the total contract price. Addi tional funds may,
therefore, be needed to fully finance the actual costs,
depending upon the situation encountered during construction.
Below is a list of the funds that have been allocated to
finance Phase I of the expansion of Nunez Park:

The pedestrian bridge was not included in the original
contract award, due to sOI:le of the bidders basing their price
upon a bridge that had not been approved by our office, as re-
quired by the special provisions. Some of the prices for Addi-
tive Alternate "A" (pedestrian bridgel were lower than the 10\~
bid price of $142,688.00. This was apparently due to the fact
that it was included as a part of the overall project.
We feel that the low bid price submitted by Mathis Con-
struction is the best that we can reasonably expect to receive.
Therefore, we recommend that a contract be awarded for the low
bid price of $142,688.00.

URGENCY CLAUSE:
Because this was originally an alternate to the basic bid and it
does affect the progress of the work on the park, staff
reconunends that it be taken as an urgency item to avoid delay
and conflict between the two contractors. Work can be better
coordinated if all work is done concurrently.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MATHIS CONSTRUCTION, INC., FOR THE INSTALLATION OF A
PRE-FABRICATED PEDESTRIAN BRIDGE AT NUNEZ PARK.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Mathis Construction, Inc., is the lowest
responsible bidder for:
Installation of a Pre-Fabricated
Pedestrian Bridge at Nunez Park, per Plan No. 8693.
A contract
is awarded accordingly to said bidder for the total amount of
$142,688.00, but such award shall be effective only upon the
contract being fully executed by both parties. All other bids,
therefore, are hereby rejected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the CitYl a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements,
amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
