STAFF REPORT
Bids for rehabilitation or replacement of the existing
sewer main in "D" Street, from 7th Street to 9th Street, were
opened at 2:00 p.m., Tuesday, 3-31-92. The contract documents
were prepared with the following alternates:
ALTERNATE I - Rehabilitate (install liner) Existing Sewer
Main
ALTERNATE II - Replacement - Existing Sewer Main
Only one bid was received for each alternate, in the
amounts of $70,197.60 and $72,190.00. The low bid for Alternate
I of $70,197.60 is 35.0% over the Engineer's Estimate of
$52,000.00, while the low bid of $72,190.00 for Alternate II is
18.3% over the Engineer's Estimate of $61,000.00.
Below is the total estimated project cost for both
alternates, based upon the actual low bid prices.

TOTAL ESTIMATED PROJECT COST $ 99,000.00 $ 102,000
Twelve bidders took out plans and special provisions. Two
apparently were for relining the sewer main, while the other 10
were for replacing the pipe. The second reline contractor
didn't bid because they were too busy with other projects. The
other 9 replacement contractors apparently did not submit a bid
due to concern over dealing with the existing railroad track or
an assumption that this couldn't complete with the two reline
bidders.
In view of the small differential in price, we recommend
that a contract be awarded to the bidder for Alternate II,
replace the existing sewer main.
An amount of $78,000 has been allocated, under Account No.
245-365-57886, to finance the costs that will be incurred for
this project. Supplemental funds, in the amount of $24,000 will
be needed to fully finance the total estimated project cost for
Alternate II. Therefore, we also recommend that the transfer of
$24,000, from Account No. 245-365-57704, "City's Share of Sewer
Extension," to Account No. 245-365-57886, "Replacement of Sewer
Main in 'D' Street," be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO T. L. PAVLICH CONSTRUCTION FOR REPLACEMENT OF
EXISTING SEWER MAIN IN "D" STREET, FROM SEVENTH S1'REET TO NINTH
STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
T. L. Pavlich Construction is the lowest
responsible bidder - for: Replacement of Existing Sewer Main in
8 "D" Street, from Seventh Street to Ninth Street, per Plan No.

A contract is awarded accordingly to said bidder for
Alternate II for the total amount of $72,190.00, but such award
shall be effective only upon the contract being fully executed by
both parties.
All other bids, therefore, are hereby rejected.
The Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is on file
15 in the office of the City Clerk and incorporated herein by
16 reference as fully as though set forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
