HomeMy WebLinkAbout1987-048 I RESOLUTION NO. 87-48 2 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF 3 SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE. (758 W. 23RD STREET, 747 W. 27TH STREET, 1605 w. 4 BASELINE, 2584 N. CEDAR STREET). 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. The City of San Bernardino, pursuant to its 8 authority under San Bernardino Municipal Code Chapters 8.30 9 and 15.28, and other laws, did lawfully cause public nuisance 10 abatements on the real property described in Exhibit nAn, 11 attached hereto and incorporated herein by reference as though 12 fully set forth. The last known owners of record as to each 13 such parcel are also specified in Exhibit nAn. 14 Due notice was given to the person or persons having an 15 interest in said property and a hearing was held by the Board 16 of Building Commissioners to hear protests and to assess the 17 costs of said abatements on said property. The Board of 18 Building Commissioners has entered its order determining the 19 costs to be reasonable and proper and imposing a lien upon the 20 land involved. Notice of the right to appeal to the Mayor and 21 Common Council has been issued to all affected property 22 holders. The Board of Building Commissioners now request that 23 the Mayor and Common Council confirm the imposition of the 24 lien. 25 SECTION 2. The matter having now come before the Mayor 26 and Common Council for confirmation of the imposition of the 27 lien imposed, the following costs are found to have been duly 28 incurred by the city pursuant to proceedings under said 2/5/87 1 1 2 3 4 5 6 provisions of the San Bernardino Municipal Code and the final statements of costs on file with the City Clerk are hereby confirmed and adopted as special assessments: Assessment Assessor's Address Amount of No. No. Assessment 1 149 192 16 758 W. 23rd st. $ 276.84 2 149 141 07 747 w. 27th street 278.04 3 139 033 33 1605 w. If said sum is not fully paid to the City 12 Clerk, City Hall, San Bernardino, within five (5) days after 13 the adoption of this resolution as to any such individual 14 parcel, then said sum shall be and become a lien on said 15 property pursuant to said Municipal Code provisions and ap- 16 plicable laws and shall be collected as a special assessment 17 thereon. 18 SECTION 4. In the event said sum is not paid as herein- 19 above provided, the City Clerk is hereby directed to file a 20 certified copy of this resolution with the Auditor of the 21 County of San Bernardino, state of California, directing that 22 said sum be entered as lien charges against said property as 23 it appears on the current assessment rolls, to be collected at 24 the same time and in the same manner, subject to the same 25 penalties and interest upon delinquencies, as the general 26 taxes for the City of San Bernardino are collected. 27 The City Clerk shall also present for recording appropriate 28 notices of the imposition of these liens with the County 2/5/87 2 1 Recorder. 2 I HEREBY CERTIFY that the foregoing resolution was duly 3 adopted by the Mayor and Common Council of the City of San 4 Bernardino at a regular meeting thereof, held on 5 the 16th day of 6 vote, to wit: February , 1987, by the following 7 AYES: Council Members Estrada, Reilly, Hernandez, 8 9 10 11 12 13 14 15 16 17 Strickler NAYS: None ABSENT: CounciJ Members Ouiel.
