BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute for and on behalf of said City a Memorandum of Understanding with the San Bernardino Municipal Water Department relating to the purchase of office furnishings for the renovation of City Hall. ('{:0r:""l~ Attorney 12/02/88 .' . . 1 MEMORANDUM OF UNDERSTANDING 2 RECITAL 3 WHEREAS, the City of San Bernardino (City) and the San 4 Bernardino Municipal Water Department (Department) agreed to 5 coordinate and select office furnishings for the renovation 6 of City Hall; and 7 WHEREAS, the Board of Water Commissioners, City of San 8 Bernardino, control and authorize all expenditures from the 9 Water and Sewer Funds; and 10 WHEREAS, the City of San Bernardino has entered into 11 financing arrangements to spread the cost of office furnish- 12 ings and other items over a three year period for office 13 furnishings with the Association of Bay Area Governments; and 14 WHEREAS, the total principal financed is $530,000 of 15 which $468,401 represents available proceeds and the Water 16 Department utilized $83,054 of the available proceeds; and 17 is WHEREAS, it is mutually agreed that the Department 18 allocated 17.73% of the total debt service requirement; and 19 WHEREAS, a debt service schedule has been prepared, and 20 is attached hereto and marked Exhibit "A", which sets forth 21 the net debt service and fees for the financing; 22 THEREFORE, the City and Department agree as fol- NOW, 23 lows: 24 25 26 27 28 1. The Department will make quarterly payments to the City as set forth in Exhibit "B" which is attached hereto; 2. The payments made by Department to the City repre- 1 2 3 4 5 6 7 8 sents the allocation of all costs for the purchase of furnishings financed under the Agreement with the Association of Bay Area Governments; 3.
