HomeMy WebLinkAbout1988-467 F , ~ 1 RESOLUTION NO. 88-~~_ 2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE APPLICATION FOR STATE GRANT FUNDS FOR DEVELOPMENT AND REFURBISHMENT OF PARK AND PLAYGROUND 3 FACILITIES AT BLAIR, LYTLE CREEK, NICHOLSON, NUNEZ, PERRIS HILL AND WILDWOOD PARKS, UNDER THE PROVISION OF THE PER CAPITA GRANT PROGRAM OF THE CALIFORNIA 4 tJILDLIFE, COASTAL AND PARK LAND CONSERVATION ACT OF 1988 AND AUTHORIZING THE DIRECTOR OF PARKS, RECREATION AND COMMUNITY SERVICES TO EXECUTE AND SUBMIT ALL 5 DOCUMENTS NECESSARY TO COMPLETE THE AFORESAID PROJECTS. 6 WHEREAS, the people of the State of California have enacted the California 7 Wildlife, Coastal, and Park Land Conservation Act of 1988, which provides funds 8 to the State of California and its political subdivisions for acquiring lands 9 and for developing facilities for public recreational and open space purposes; 10 and 11 WHEREAS, the State Department of Parks and Recreation has been delegated 12 the responsibility for the administration of the program within the state3 13 setting up necessary procedures governing application by local agencies under 14 the program; and 15 WHEREAS, said procedures established by the State Department of Parks and 16 Recreation require the applicant to certify by resolution the approval of 17 applications prior to submission of said applications to the state; and 18 WHEREAS, said applications contain assurances that the applicant must 19 comply with; and 20 WHEREAS, the applicant agency will enter into an agreement with the State 21 of California for the acquisition, development, rehabilitation or restoration 22 of the projects; 23 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 24 OF SAN BERNARDINO AS FOLLOWS: 25 SECTION 1. Rehabilitation of Security Lights at Lytle Creek, Nicholson, Perris Hill, and Wildwood Parks. $140,000 Blair Park - Rehabilitation of the Jog/Walk/ Exercise Course and surrounding turf areas. $107,000 Nunez Park - Development of 4 new acres at Westend of Park and Rehabilitation of Ballfield lighting. $200,000 SECTION 2. The Mayor and Common Council certify that the City understands the assurances and certification in the application; SECTION 3. The Mayor and Common Council certify that the City has or will have sufficient funds to operate and maintain the projects; SECTION 4. The Mayor and Common Council certify that the City will complete the projects within three years from date of approval by the state; SECTION 5. The Mayor and Common Council certify that the City has reviewed and understands the General Provisions contained in the state/local agreement; and appoints the Director of Parks, Recreation and Community Service as agent of the City to conduct all negotiations, execute and submit all documents, including but not limited to applications, agreements, amendments, payment requests, and so on, which may be necessary for the completion of the aforementioned projects. All State requirements must be met and an agreement signed before any funds will be disbursed. An audit may be performed before or after final payment. An Application for grant funds consists of one copy each of the following: 1. Application Form. 2. Authorizing Resolution from governing body. 3. Environmental Impact Report or Negative Declaration along with a response from the State Clearinghouse; and a copy of the Notice of Determination filed with, end stamped by, the County Clerk; or if applicable, a copy of the Notice of Exemption on file with the County Clerk if the project is categorically exempt. 4. Project location map (city or county) with enough detail to allow a person unfamiliar with the area to locate the project. 5. ASSURANCES Applicant possesses legal authority to apply for the grant, and to finance, acquire, and construct the proposed project; that a resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body authorizing the filing of the application, including all understandings aDd assurances contained therein, and directing and authorizing the person identified as the official representative of the applicant to act in connection with the application and to provide such additional information as may be required. Applicant will maintain and operate the property ecquired, developed, rehabilitated, or restored with the funds in perpetuity. With the approval of the granting agency. the applicant or its successors in interest in the property may transfer the responsibility to maintaLn and operate the property in accordance with section 5919 of the Public Resources Code. Applicant will use the property only for the purposes of the Wildlife, Coastal, & Park Land Conservation Act and to make no other use, sale. or other disposition of the property except as authorized by specifiC act of the Legislature.
