The City has received, through the offices of the Mayor and the Council
office, a number of complaints sbout enforcing Section 1106(d) of Title 25 of
the California Code of Regulations. The section states that:
"no roadway ahall be less than thirty-two (32) feet in width if car
parking is permitted on one aide of the roadway and not less than forty
(40) feet in width if car parking is permitted on both sides of a roadway
wi thin a mobilehome park."
California law (Title 25) takes precedence over local ordinance.
Conaequently, the Mobilehome lent Board Coordinator was asked to find a way
that the City of San Bernardino could make it possible to park on the streets
in those parka where inadequate parking is creating a hardship. lnapectors of
the Fire Department, along with Ua!! of the Planning and Building Services
Department, met to discuss solutions to this problem.
The California Health and Safety Code Section l8420(d) may be helpful in
resolving the problem due to the following code text:
The Code "requires the enforcement agency to record all violations
including thoae violations that are technical in nature (that do not
constitute a danger to life, .limb, health, or safety) and do DQl require
correction. The notice of violations, Housing and Community Development
(HCD) 558 and 559, have been designed to allow for the recording of auch
technical violations and the waiver of the correction requirements".
Procedures were recommended for park inspections and determining the
feasibility of parking on the street. They are summarized below:
1. Parks with streets that are 32 feet or larger in width would not
require correction.

2. Park streets that are under 32 feet in width would:
a. Receive a violation notice;
b. Require no correction;
c. Meet with the Fire Marshall's Office to make sure that there is no
danger to health and aafety and that the Fire Department is
assured access throuahout the park.
