STAFF REPORT
The Water Department began the upgrades to the City's water system
in 1990 in accordance with the Water System Master Plan. One of
the major components of the master plan is the installation of a
major water transmission facility to move water from the lower end
of the basin to the higher elevations in the water system. The
overall project also requires additional water storage reservoirs
and pumping facilities.
A portion of the capital funding for the transmission facilities
and funds to acquire property for the additional water storage
reservoir sites was included in the bonds issued in 1990 by the
West End Water Conservation and Development Joint Powers Authority.
Water Department staff conducted extensive investigations to find
property at the required elevations and in close proximity to the
transmission lines. There are very few parcels of land available
along the transmission route that are not already developed.
A site was found for. the lower reservoir, elevation 1249', and
Water Department staff has tried to negotiate with the property
owners to acquire the property. Attached is a map which shows the
location of the parcel to be acquired. It may be necessary to
take the property through eminent domain proceedings if successful
negotiations of value cannot be accomplished with the property
owners.
The resolution of necessity for the taking of this parcel of land
is necessary for the Water Department to proceed with eminent
domain should that action become necessary;
It is recommended that the resolution be approved.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL, CITY OF SAN
4 BERNARDINO, DECLARING THE NECESSITY OF THE TAKING, IN FEE SIMPLE
ABSOLUTE, ASSESSOR'S PARCEL NUMBER 148-122-01 PTN., THAT PORTION
5 OF THE NORTH TWENTY-FOUR (24) ACRES OF LOT 2, BLOCK 83, OF RANCHO
SAN BERNARDINO, AS PER PLAT RECORDED IN BOOK 7, PAGE 2 OF MAPS,
6 OFFICIAL RECORDS OF THE COUNTY OF SAN BERNARDINO, STATE OF
CALIFORNIA, CONSISTING OF 6.33 NET ACRES, FOR THE PUBLIC USE OF A
7 WATER STORAGE RESERVOIR AND PUMPING FACILITY.
8 WHEREAS, the Board of Water Commissioners, City of San
9 Bernardino, has found and determined that public interest and
10 necessity require the development of a water storage reservoir and
11 pumping facility at this particular location by reason of elevation
12 and general access, as part of the larger planned extension of the
13 water system of the City of San Bernardino: and
14 WHEREAS, this project is planned and located in a manner that
15 is most compatible with the greatest public good and the least
16 private injury in that the property to be taken is vacant and no
17 existing structures will be damaged: and
18 WHEREAS, said parcel of land, Parcel Number: 148-122-01 ptn.,
19 also known as that portion of the North twenty-four (24) acres of
20 Lot 2, Block 83, of Rancho San Bernardino, as per plat recorded in
21 Book 7, Page 2 of Maps, Official Records of the County of San
22 Bernardino, State of California, consisting of 6.33 net acres, are
23 required for the public use of a water storage and pumping
24 facility, authorized for public use by Streets and Highways Code
25 Section 510l(h): and
26 WHEREAS, an offer has been made to the owners of said property
27 as determined from the public records, in accordance with the
28 requirements of Government Code Section 7267.2: and

WHEREAS, the Board of Water Commissioners, as lead agency, has
said property in accordance with the California Environmental
Quality Act.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL,
CITY OF SAN BERNARDINO THAT:
SECTION 1. There is a necessity for the taking, in fee simple
absolute, Parcel Number: 148-122-01 ptn., also known as that

portion of the North twenty-four (24) acres of Lot 2, Block
83, of Rancho San Bernardino, as per plat recorded in Book 7,
Page 2 of Maps, Official Records of the County of San
Bernardino, State of California, consisting of 6.33 net acres,
more fully set forth in Exhibit "A", which is attached hereto
and incorporated herein by reference.
SECTION 2.
Said parcel of property is required for the
pUblic use of a water storage reservoir and pumping facility,
authorized for public use by Streets and Highway Code Section
5101(h).
SECTION 3.
That all actions necessary to acquire said parcel
of property shall be by and through the Board of Water
Commissioners, City of San Bernardino.

CHRONOLOGY OF EVEII'l'S IN WATER DEPARTMENT ATTEMPT TO PURCHASE
6.66 ACRE PARCEL FROM SCOTT LABS
APRIL 20, 1992
. The CDH Water System Haster Plan recommends the installation
of 13.5 million gallons of storage constructed in two phases
at elevation 1249' in the vicinity of Cajon Boulevard and
Hedical Center Drive which is in the route of a large diameter
water transmission main-reservoir-boosting station route.
. The project (transmission-reservoir-boosting) currently under
construction will provide San Bernardino with a reliable
method of pumping, boosting, and storing domestic water
throughout the middle and upper portions of San Bernardino.
. Water Department staff field verified all potential reservoir
sites at the appropriate elevation, and determined that this
vacant parcel best met all of the City's criteria, l.e.,
elevation, proximity to Cajon Boulevard, nonresidential
zoning, and required no relocation of residential dwellings.
. November 1990 we began negotiations with Scott Labs for a
reservoir site at elevation 1249' to match the elevation of
two existing lower zone reservoirs.
. The Scott Labs on-site manager has been cooperative and
recognizes the Department's need for a reservoir site.
. December 1990 Hr. Edward Hill, at our expense, appraised the
6.66 acre parcel at $1.75 per square foot ($507,000.00).
. The owners of the property, who are located in New Jersey,
retained Hr. Bob Cooley to appraise the property. Hr.
Cooley's appraisal valued the property at $2.00 per square
foot plus severance which equals $680,000.00.
. To void Obtaining the property through eminent domain, we met
with our Attorney, Hr. Carpelan, Hr. Jacobson, Attorney for
Scott Labs, and Hr. Hill, in an attempt to negotiate a sale.
. Subsequent to this meeting (April 7, 1992), this same group
met with Hr. Cooley to further
price. It was decided at this
court action (eminent domain
agreeable price for the parcel.
. As a public agency, it has been our stance that we cannot
offer more than the appraised value. Hr. Kersey has, however,
recently in a further attempt to negotiate the sales price,
submitted a written offer at $2.00 per square foot. It is Hr.
Kersey's opinion that no severance damages are appropriate.
