ESTABLISHING 50% OF THE CURRENT RATES FOR USE OF PARK AND RECREATION FACILITIE: BY SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT. Synopsis of Previous Council action: November 19, 1986 - Resolution 86-480 adopted, amending Resolution 83-201 modifying fees for uses of recreation facilities. August 15, 1988 - Resolution 88-307 adopted, amending Resolution 86-480 modifying fees for uses of buildings, sport facilities, etc. and for alcohol permits. December 18, 1989 - Resolution 89-500 amending Resolution 88-307 modifying fees for use of buildings and setting fees for use of parks and park parking lots. DescriPtion) Finance: Council Notes: Jr ClTY.OF SAN BERNlhDINO - REQUEST lOR COUNCIL ACTION STAFF REPORT The amendment of Resolution 91-35 is to establish 50 percent of the current rate for San Bernardino City Unified School District for sturges Auditorium and other Park and Recreation Facilities. The district currently pays 100 percent of the established rates even though they were partners in the development of Sturges including providing portions of the parking lot and providing improvements to the facility. Modifications recommended by the Joint Use Committee, a committee comprised of council members and school board members is to charge the district 50 percent of the established rates for parks and recreation facilities. This is consistant with the school district's policies in charging the City for district facilities. District facilities are provided at the cost of operations only and consequently very often are without charge. Uses of Sturges by the school district are minimal and the reduction in revenue is estimated at $1,600 annually. The only other facility that is utilized by the district is Hernandez Center gymnasium and revenue reduction is estimated at under $700. Since the district's use of the gym is during regular operating hours it is not anticipated that actual cost of use will exceed the reduced rental rate. Approval is recommended. F., ESTABLISHING 50t OF THE CURRENT RATES FOR USE OF PARK AND RECREATION FACILITIES BY SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Findinas. The Mayor and Common Council hereby find: A. Hearing has been held by the Mayor and Common Council pursuant to the provisions of Government Code Section 54990, etc. seq., to consider the levy of fees and service charges for various services provided by the Parks, Recreation 11 and Community Services Department, and for uses of certain 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 buildings, facilities, and equipment, which hearing was held following public notice published in a newspaper of general circulation in the City of San Bernardino. B. None of the proposed fees exceed the actual cost of providing such services and facilities, and, for those services which are not completely paid for by the proposed fees, the additional expense to the city of providing the services shall be borne by the general fund of the City of San Bernardino. C. The proposed fees and charges are reasonable and necessary to enable the City of San Bernardino to more nearly meet the actual costs of providing such services and facilities. SECTION 3. "F. Groups in Category 1 and 2 shall pay no fee. The San Bernardino city Unified School District shall pay 50 percent of the established rates."
