Subject:
Final determination for Tentative Tract No. 15228, a
request to establish an 18-lot single family subdivision.
Mayor and Common Council Meeting of April 20, 1992
REOUEST
Pursuant to Development Code Section 19.66.070, the applicants
request approval of Tentative Tract No. 15228, to subdivide a
parcel into 18 single-family residential lots. The request is
before the Mayor and Common Council because a motion by the
Planning Commission to deny the project failed by a tie vote.
The subject property consists of 5.71 acres located at the
southwest corner of Magnolia Avenue and Ohio Avenue in the RL,
Residential Low, land use district.
BACKGROUND
November 19, 1991
The Planning Commission held a properly noticed public hearing on
Tentative Tract No. 15228 (See Exhibit 1, Certificate of Mailing
and Proof of Publication). After staff's presentation of the staff
report, the Commission was advised that Staff received comments by
telephone from Ms. Pat Smith, 3288 Meyers Road, on the day of the
hearing. Ms. Smith stated that her property abuts the subject
property and expressed concerns regarding the removal of trees, the
lack of sewers and asked if it would still be legal to stable her
stallions if the proposed subdivision is approved and occupied.
After the opening of the public hearing, Donald and Jean Hanson,
180 W. Fiesta Green, Port Hueneme, spoke in favor of the
application. Mr. Hanson stated that he and his wife own
approximately 10 acres across the street from the subject property
and they feel that the proposed subdivision would have a positive
effect.
Gary Smith, 3288 Meyers Road, then spoke in opposition to the
request. He stated that the proposed lot sizes and density are
incompatible with the existing development in the area, citing his
and three other one-acre residential proper:ties abutting the
subject property to the south, which are the result of a four-lot
subdivision approved in 1980. According to Mr. Smith, the recently
approved smaller lot, higher density developments are destroying
the quiet, low density character of the area. Mr. Smith also

claimed that the arborist report prepared for the subject property
was false.
June Reeves, 3414 Belmont Avenue, spoke in opposition to the
proposed subdivision, citing a lack of sewer service on Belmont
Avenue and drainage concerns on Magnolia Avenue.
steven Levy, 1398 Meyers Road expressed opposition to the
application, also citing drainage concerns.
Sam Zayed, 3308 Meyers Road, spoke in opposition to proposal. He
stated that he recently moved into the area and has invested in
improvements to his property under the impression that the area
would continue to be comprised of one-acre lots.
Eugene Ehe, civil engineer for the project, then responded to the
drainage and sewer issues. He stated that proper drainage could be
carried to Belmont Avenue: however, due to the lay of the land, a
drainage easement would be required along the neighboring property
to the east (A.P.N. 261-071-2, 3, 9). The proposed conditions of
approval require that the subdivider obtain the easement prior to
recordation of the final map, but the neighboring property owner is
unwilling to negotiate at this time. He also stated that all trees
removed as a result of the development of the subdivision shall be
replaced at a 2:1 ratio, as indicated in the proposed conditions of
approval.
A motion then carried to continue the hearing to December 10, 1991
so that a representative from the Engineering Division of the
Public Works Department could be present to answer questions
regarding drainage issues, the proposed street design, and policies
and procedures for the filing of final maps.

A quorum of the Planning commissioners who originally heard the
item on November 19, 1991 was not present, and the item was
continued to January 7, 1992.
January 7, 1992
The Planning Commission continued the item to March 3, 1992 at the
request of the Planning Director. The purpose of the continuance
request was to allow the applicant to make a final attempt to
negotiate for an off-site drainage easement through the neighboring
property to the east prior to taking action on the tentative map.
This request was made because, pursuant to Section 66462.5 of the
Subdivision Map Act, if the City imposes a condition of approval

requiring the subdivider to obtain an easement for offsite
improvements, and the subdivider is unable to obtain the drainage
easement by the time that the final map is filed, the city will be
compelled to acquire the easement through eminent domain: in turn,
the City would require the subdivider to pay the cost of acquiring
the easement.

Staff advised the Planning Commission that the owners of the
neighboring property are still unwilling to grant off-site drainage
easement rights to the applicant, so the proposed conditions of
approval will require the subdivider to obtain the easement prior
to recordation of the final map (Standard Requirement No. 18,
Exhibit 4, Attachment D), potentially compelling the city to
condemn the property.
commissioner stone then asked staff if the proposed temporary dead
end at the eastern end of the subject property would obligate the
owner of the neighboring property to the east to continue the
street if the adjacent parcels are ever developed. Staff responded
that the neighboring property owner would be obligated to continue
the street. Commissioner stone then expressed concern that the
neighboring, larger property would be "held hostage" by the subject
property.
A motion to deny Tentative Tract No. 15228 then failed by a tied 3-
3 vote. As a result of the failed motion, the application was
forwarded to the Mayor and Common Council for final determination.

It is the recommendation of Staff that the Mayor and Common

2. Approve Tentative Tract No. 15228 based upon the attached
Findings of Fact (Exhibit 4, Attachment B), and subject to the
attached Conditions of Approval (Exhibit 4, Attachement C) and
Standard Requirements (Exhibit 4, Attachment D).

BACKGROUND
The above referenced application was heard by the Planning
Commission on November 19, 1991. The hearing was continued to
December 10, 1991 so that a representative from the Engineering
Division of the Public Works Department could be present to answer
questions regarding drainage issues, the proposed street design,
and policies and procedures for the filing of final maps.
At the Planning Commission meeting of December 10, 1991, a quorum
of the Planning commissioners who originally heard the item on
November 19, 1991 was not present, and the item was continued to
January 7, 1992.
At the Planning Commission meeting of January 7, 1992, the Planning
Commission continued the item to March 3, 1992 at the request of
the Director of Planning & Building Services. The purpose of the
continuance request was to allow the applicant to make a final
attempt to negotiate for an off-site drainage easement through the
neighboring property to the east prior to approval of the tentative
map. The owners of neighboring property are still unwilling to
grant the easement, so conditions of approval will require that the
developer obtain the easement prior to recordation of the final
map (see Standard Requirement No. 18, Attachment OJ.
Pursuant to Section 66462.5 of the Subdivision Map Act, if the

Plan as RL, Residential Low.
SITE LOCATION
The subject property is a rectangular parcel consisting of
approximately 5.7 acres located at the southeast corner of Magnolia
and Ohio Avenues (Please see Attachment F, Tentative Map and
Attachment G, Location Map).
DEVELOPMENT CODE AND GENERAL PLAN CONSISTENCY
Tentative Tract No. 15228 is consistent with the standards and
guidelines of the Development Code and is consistent with the
goals, objectives and policies of the General Plan, as shown in
Attachment A.
SUBDIVISION MAP ACT
Tentative Tract No. 15228 was submitted in compliance with Section
66426 of the Subdivision Map Act. The subdivider has agreed to
comply with the provisions imposed by the City under the authority
of Chapter 4 of the Map Act.
CEOA STATUS
An Initial Study was prepared by Staff and presented to the
Environmental Review Committee (ERC) on September 26, 1991. The ERC
determined that no significant impacts would result from the
project and recommended a Negative Declaration. The proposed
Negative Declaration was advertised and available for public review
and comment from October 3, 1991 to October 23, 1991. As of this
writing, no comments have been received from the public.
BACKGROUND
The application for Tentative Tract No. 15228 was submitted on
February 19, 1991. The application was deemed incomplete on March
18, 1991 pending the submittal of an arborist report, a biological
report and an archaeological review fee. On May 22, 1991, all of
the requested information was received and the application was
deemed complete on June 18, 1991.

The 5.71 acre site is located within the boundaries of the
Verdemont area. The property slopes slightly from north to south
at an approximate natural grade of 8.5%. A row of eucalyptus trees
is located adjacent to the north property frontage along Ohio
Avenue and a row of olive trees is located to adjacent to the
Magnolia Avenue frontage on the west. The surrounding area is
characterized by vacant residential properties

southern tract boundary to be located at the toe of a slope. The
presence of a downward slope within a rear yard, depending on the
steepness, may lead to maintence and usability problems. The
elimination of the slope would require the construction of a 10-
foot retaining wall facing the exterior of the tract, which could
be visually imposing and obstruct scenic views currently enjoyed
by adjacent properties. Based on the circumstances, it is Staff's
recommendation that a maximum 3:1 slope be allowed, which would
reduce maintenance problems and eliminate the need for a retaining
wall.

new 767-foot street which will terminate at a temporary cul-de-

Section 19.30.200(6) of the Development Code requires a tentative
tract map to provide for at least two different standard routes for
ingress and egress. A standard route is a road which is dedicated
to the City and has a minimum paved width of 24 feet. The two
standard means of access for the subject property shall be provided
by Magnolia and Ohio Avenues. As a condition of approval, the
subdivider shall be required to improve Magnolia and Ohio so that
they become standard routes: that is, they shall be required to be
widened and paved from the tract entry to the point where they tie
into a standard street system.
Se.ers and Drainage
The site is currently isolated from development, and sewer service
does not reach the subject property. The nearest sewer line is
located in Chestnut Avenue, and terminates south of Belmont Avenue
--approximately 1,200 feet south of the subject property. The sewer
cannot be extended north along Chestnut due to a large dip in
Belmont. Hence, until contiguous development reaches the adjoing
parcels, the only way to provide sewer service to this subdivision
would be through securing an easement from the adjoining property
to the south or east. Additionally, the property drains to the east
and a drainage easement will be required.
At this time, the property owners to the east are not willing to
negotiate for easement rights. Therefore, conditions of approval
shall make final recordation of the map contingent upon the
acquisition of an easement for sewer and drainage purposes from the
easterly terminus of the subject property southerly to Belmont
Avenue. The easement shall be 15 feet wide. Sewer and drainage
improvements shall be installed in the easement to serve the
development as approved by the city Engineer. Additional sewer
and/or drainage improvements may be required to reach an adequate
outlet.
Traffic I:mpacts
The City Traffic Engineer has determined that additional trips from
the proposed project are not sufficient to cause a significant
impact on the adjacent street system. Total traffic volume will be
less than the street design capacity. However, a traffic systems
fee, estimated in the amount of $2,383 shall be collected prior to
the final recordation of the map.

The site is located within the Biological Resources Management
overlay (BRMO), as identified in section 10, Figure 41, Resources
of the City's General Plan. A biological assessment was conducted
by John Wear and Timothy J. Wade of the Lilburn Corporation on
April 19, 1991. The consultants concluded that no significant
biological resources occur on the site; thus, no mitigation was
recommended.
Tree. on site
There are currently 48 standing trees on the subject property,
primarily consisting of a wind row of 34 eucalyptus trees along
Ohio Avenue and a row of 13 olive trees adjacent to MagnOlia
Avenue. The subdivision has been designed to preserve these trees
as much as possible; however, construction of the new street
(Blackhawk Road) and right-of-way dedications will displace several
of the olive trees.
A California Certified Arborist report was prepared on April 26,
1991 by James F. Bridges (I.S.A. Certificate No. 386). The trees
were identified and catalogued in the report and plotted on a map,
which is on file with the Planning Division.
The report concluded that only 14 of the 48 trees were SUfficiently
viable to be saved in place or transplanted. The report identified
the remaining trees as diseased or dead and recommended their
removal.
The report and recommendations have been reviewed by Planning and
Parks and Recreation staff. Additionally, Parks and Recreation
staff physically inspected the trees on site and concluded that All
of the trees on site are sufficiently viable to be retained in
place, relocated or replaced. Based upon these analyses, if the
project is approved, Staff recommends the following mitigation
measures:
1. All trees not affected by construction shall be retained in
place; and
2. All trees affected by construction shall be transplanted or
replaced with 36-inch box native trees at a two-to-one
replacement ratio. These trees shall be planted on-site or on
public lands in accordance with the recommendations and
requirements of the Parks and Recreation Department.

CUltural Resources
The subject property is located within an area of concern for
archaeological resources, as identified in the Historical Element
of the City's General Plan (Section 3.0, Figure 8). A preliminary
cultural resources review was conducted by Lester Ross, coordinator
at the Archaeological Information Center of the San Bernardino
County Museum. Mr. Ross determined that the potential for the
presence of cultural resources within the project area is low. As
a result of the negative findings, a field reconnaisance for
cultural resources was not undertaken.

COUDcilman Tom Kinor (Ward 5)
In comments submitted to Staff, Councilman Minor stated that his
support is strictly contingent upon the project making adequate
provisions for infrastructure. It is the opinion of Staff that the
conditions of approval and standard requirements fully address
these issues.
San Bernardino Unified School District
The project will be subject to school impact fees in effect at the
time of building permit issuance.
United States Postal Service
The Postal Service requests that the final map shall show easements
or other mapped provisions for the placement of centralized mail
delivery units. A condition of approval has been proposed for the
inclusion of such easements. The specific locations for such units
shall be to the satisfaction of the Postal Service and Public Works
Department.

CONCLUSION
Tentative Tract No. 15228 complies with all of the development
standards of the Development Code and is consistent with the
General Plan. Tentative Tract No. 15228 is in compliance with the
Subdivision Map Act. To address potential environmental impacts and
infrastructure deficiencies, mitigation measures have been
incorporated into the project design and conditions of approval.
It is the conclusion of Staff that, based upon the project design
and proposed conditions of approval, the project will not pose a
detriment to the peace, health, safety and general welfare of the
citizens of San Bernardino.
RECOMMENDATION
It is recommended that the Planning Commission:

The proposed map is consistent with the General Plan, in that

single-family homes at a density of 3.1 dwelling units per
acre, as permitted within the RL, Residential Low, General

The design of the proposed subdivision is consistent with the
General Plan in that the minimum proposed lot size is 10,800

The site is physically suitable for the type of development
proposed, in that the tentative map conforms to the

No tree shall be removed, replaced or relocated prior to the
issuance of a Tree Removal Permit. The removal, replacement
or relocation of any tree shall be subject to the provisions
established by the mitigation measures contained in the
Initial study for Tentative Tract No. 15228.
Downward facing slopes abutting the southerly subdivision
boundary shall not exceed 3: 1. Perimeter walls or fences shall
be located at the bottom of said slopes, abutting the
subdivision boundary.
Walls and Fences:
a. The perimeter walls adjacent to Ohio Avenue and Magnolia
Avenue shall be constructed of either slumpstone, split-
faced block or stuccoed block with decorative caps. The
walls shall have articulated planes, by providing at a

This Initial Stud, Involves the subdivision of approximately 5.71
vacant acres into 18 single family residential lots. The subject
site is located at the southeast corner of Magnolia and Ohio
Avenues in the RL Residential Low General Plan land use
desianation.
The subject site is relatively flat with natural slopes ranging up
approximately 8.5%. A row of eucalyptus trees is located to the

1. EARTH RESOURCES

29.199 cubic vards of cut and 23.597 cubic yards of fill
(balance due to sbrinkage factorl. Grading in tbis quantity
may potentially result in various impacts related to soi 1
erosion and dust. However. compliance witb Public liorks/
Engineering standard requirements for grading sball serve to
reduce potential impacts to a level of insignificance.
Specifically. if an~' de'.elopment is scbeduled to be done
between October 15tb and April 13th tbe Engineer shall submit
a detailed erosion control plan including desilting basins or
otber temporary drainage or control measures. or botb. as .ay
be necessary to protect adjoining public and private property
from damage by erosion. flooding or tbe deposition of mud or
debris which may originate from tbe site or result from such
development. In addition. dust wi 11 be controlled by frequent
watering of soil as deemed necessary by the Department of
Public Works/Engineering.
b) Tbe proposed project will not result in development and/or
grading on a slope greater tban 15% natural grade. The
subject site bas a natural grade up to approximately 8.5%.
2. AIR RESOURCES
e) The site is located in a bigh wind hazard area as identified
in tbe City's General Plan. Standard requirements and
conditions of approval pertaining to building construction
will be placed at tbe Development permit stage.
3. WATER RESOURCES
a) Drainage
Development of t!le vacant site will reduce tbe amount of
impermeable top soil which will increase surface water runoff.
Tbis surface runoff is considered to be insiinificant and will
be carried b~ off-site improve.e~ts into existing storm drains
as required by tbe Department of Public Works/ Engineering.

Resource Specialist. The biologist concluded that no
significant biological resources occur on the site and the

An arborist report prepared by James Bridaes identified
48 trees on site and 16 trees on adjacent land. A row of
eucalyptus trees are situated along Ohio Avenue and a row
of olive trees are located along :'Ia&nolia Avenue. The
Tract has been desi&ned to preserve these trees a~ much
as possible. however some disturbance is necessary to
accommodate Blackhawk Road.
The current condition of most trees is &ood to dead.
Seven trees are recommended for preservation in place or
transplanting and the rellainin& trees are rO!collmO!ndO!d tor
removal due to damage or future liability of failure or
death. The Parks and Recreation OO!partmO!nt had evaluated
the arborist report and the trees. ThO! Parks and
Recreation DepartmO!nt's recommO!ndations arO! to preserve
all trO!O!s not affected by construction in placO! and to
transplant treO!s affectO!d by construction or replace the
re.ovO!d trO!O!s with 36" box native trees at a 2:1 ratio.
ThesO! treO!s shall be planted on-sitO! or on public lands
in accordancO! with recommendations and requirements of
thO! Parks and RO!creation DO!partment. Compliance with the
recommendations or the Parks and Recr..ation Department
shall serve to reduce all impacts to a le,""l of

the Archaeological Information Center concluded that no
cultural resources are known to exist within or adjacent to
the project area. However. if during grading or construction
such materials are encountered grading/construction shall be
temporarily stopped. The Planning Department shall be
notified. the material shall be evaluated by a qualified
archeologist. and appropriate data recovery/protection
measures shall be implemented.
