Recommended motion:
That the award of a contract for construction of a concrete
block soundwa11 along State Routes 30/330, at Buckeye Street, in
accordance with Plan No. 8645, be continued to 5-4-92, and the City
Clerk and City Engineer be directed to proceed with the formation
of an assessment district to finance the $31,000 required
supplemental funding.
OR
1. That the transfer of $31,000, from Account No. 129-309-
57837, "Widen Tippecanoe Avenue (east side) from I-10 to Hardt
Street," to Account No. 129-309-57769, "Soundwall, Route 30/330 @
Buckeye Street," be approved.
2. Adopt resolution.

STAFF REPORT
Bids for construction of a concrete block soundwall along
State Routes 30/330, at Buckeye Street, were opened at 2:00 p.m.,
Tuesday, 3-17-92.
A total of seven (7) bids were received, ranging from
$87,239.00 to $128,887.00. The low bid of $87,239.00 is 50.2%
over the Engineer's Estimate of $58,073.00.

A total amount of $66,000 has been allocated, under
Account No. 129-309-57769, from Measure "I" Local Funds, to
finance the cost of this project. Supplemental funds in the
amount of $31,000 will, therefore, be needed to fully finance
this project.
One resident has indicated that the residents would be
willing to participate in the cost, if necessary, to have the
soundwall installed. An assessment district could be formed for
the 20 lots where the wall is to be constructed. This would
amount to $1,550 per lot, which could be paid off over a period
of about 5 years.
Another option would be to transfer the required supple-
mental funding from the allocation for some other project. One
possibility is the widening of Tippecanoe Avenue (East Side) from
1-10 to Hardt Street, Account No. 129-309-57769. Since construc-
tion on this project will be starting on about 7-1-92, any
shortfall resulting from the transfer of these funds would be
replaced in the 1992/93 Budget.
One resident has requested that the soundwall be extended
along the lot at the northwest corner of Pacific Street, which is
owned by Cal trans. Extension of the wall along this lot would
increase the contract price by about $5,934.00. In view of the
funding shortfall, we are unable to recommend this extension.
Based upon the bid prices submitted, it is obvious that
the Engineer's Estimate did not fully reflect current pricing
trends. We do not feel that a better price could be obtained by
re-advertising for bids. Therefore, we recommend that a contract
be awarded to the low bidder, subject to the necessary supple-
mental financing being identified.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO PACIFIC CITY GENERAL CONTRACTING, INC. , FOR
CONSTRUCTION OF A CONCRETE BLOCK SOUNDWALL ALONG STATE ROUTES
30/330 AT BUCKEYE STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Pacific City General Contracting, Inc., is
the lowest responsible bidder for: Construction of a Concrete
Block Soundwa11 along State Routes 30/330 at Buckeye Street, per
Plan No. 8645. A contract is awarded accordingly to said bidder
for the total amount of $87,239.00 for the Basic Bid, but such
11 award shall be effective only upon the contract being fully
12 executed by both parties. All other bids, therefore, are hereby
13 rejected. The Mayor is hereby authorized and directed to execute
14 said contract on behalf of the City; a copy of the contract is on
15 file in the office of the City Clerk and incorporated herein by
16 reference as fully as though set forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or" authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.

The City has received, through the offices of the Mayor and the Council
office, a number of complaints about enforcina Section 1106(d) of Title 25 of
the California Code of Regulations. The section states that:
"no roadway shall be less than thirty-two (32) feet in width if car
parkina ia permitted on one side of the roadway and not less than forty
(40) feet in width if car parkina is permitted on both sides of s roadway
wi thin a mobilehome park."
California law (Title 25) takes precedence over local ordinance.
Consequently, the Mobilehome Rent Board Coordinator was asked to find a way
that the City of San Bernardino could make it possible to park on the streets
in those parks where inadequate parkina is creatina a hardship. Inspectors of
the Fire Department, alona with staff of the Plaanina and Buildina Services
Department, met to discuss solutions to this problem.
The California Health and Safety Code Section l8420(d) may be helpful in
resolvina the problem due to the followina code text:
The Code "requires the enforcement agency to rseord .11 violations
includina those violations that are technical in nature (that do not
constitute a danger to life, limb, health, or safety) and do D21 require
correction. The notice of violations, Housina and COIIIIII\IIlity Development
(HCD) 558 and 559, have been designed to allow for the recordina of such
technical violations and the waiver of the correction requirements".
Procedures were recoDlDlended for park inspections and determinina the
feasibility of parkina on the street. They are sUDlDlarized below:
1. Parks with streets that are 32 feet or larger in width would not
require correction.

2. Park streets that are under 32 feet in width would:
a. Receive a violation notice;
b. Require no correction;
c. Meet with the Fire Marshall's Office to make sure that there is no
danaer to health and safety and that the Fire Department is
assured access throuahout the park.

AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER
15.55 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO LOCAL
ENFORCEMENT OF LAWS AND REGULATIONS RELATING TO MOBILE HOME PARKS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 15.55 is hereby added to the San
Bernardino Municipal Code to read as follows:
15.55.010 Authority.
This Chapter is adopted pursuant to the authority of
Health and Safety Code 518300 and Section 1004 of Title 25
of the California Code of Regulations.
15.55.020 Assumption of Responsibility.
The
City
of
San
Bernardino
hereby
assumes
responsibili ty for enforcement of the Health and Safety
Code, Division 13, Part 2.1, (beginning with 518200), and
the related administrative regulations as are adopted from
time to time. This assumption of responsibility shall be
effective sixty ( 60) days after the adoption of this
Chapter.
15.55.030 Enforcement Responsibility.
The Planning and Building Services Department of the
City shall have the responsibility to enforce the statutes
and regulations referred to in this Chapter. The Department
shall be assisted by any other City officer, employee, board
or commission in bringing deficiencies or violations to the
attention of the Department while in the process of
fulfilling their statutory responsibilities.

1 15.55.040 Qualified Personnel.
2 The City will provide qualified personnel adequate to
3 enforce the provisions of the statutes and regulations
4 referred to in this Chapter. Currently, the City has four
5 (4) Code Enforcement Officers with one (1) supervising
6 personnel and five (5) Building Inspectors with four (4)
7 supervising personnel to enforce these provisions, which
8 total numbers may be adjusted from time to time.
9 15.55.050 Fees.
10 The Mayor and Common Council shall from time to time by
11 resolution adopt a schedule of fees consistent with those
12 established from time to time in Health and Safety Code,
13 Division 13, Part 2.1, and related administrative
14 regulations.
15 15.55.060 Objectives.
16 The City hereby adopts and approves the State program
17 and obj ecti ves as contained in Health and Safety Code,
18 Division 13, Part 2.1, and related administrative
19 regulations.
20 15.55.070 Existing Mobile Home Parks.
21 There are currently forty-two (42) mobile home parks in
22 the City ranging from excellent condition with few
23 violations to poor condition with numerous building
24 violations. Generally, these are at or near maximum
25 occupancy.
26 15.55.080 Local Findings and Inspection.
27 The Mayor and Common Council of the City hereby find
28 that those living in mobile home parks are often on fixed

The low bidder has quoted a contract price of $57,865 for a 6-
foot block wall, in lieu of the 8-foot wall shown on the plans.
This represents a reduction of $29,374 in the contract price.
Below is an estimate of the total project cost, based upon the
quoted price for a 6-foot wall.
