DescriDtion) Finance: Council Notes: 75.0262 A"OftI"45 I+a_ A.I.... l./ J CITY OF SAN BQNARDINO - REQUEO FOR COUNCIL ACTIOI STAFF REPORT The Water Department began the upgrades to the City's water system in 1990 in accordance with the Water system Master Plan. One of the major components of the master plan is the installation of a major water transmission facility to move water from the lower end of the basin to the higher elevations in the water system. The overall project also requires additional water storage reservoirs and pumping facilities. A portion of the capital funding for the transmission facilities and funds to acquire property for the additional water storage reservoir sites was included in the bonds issued in 1990 by the West End Water Conservation and Development Joint Powers Authority. Water Department staff conducted extensive investigations to find property at the required elevations and in close proximity to the transmission lines. There are very few parcels of land available along the transmission route that are not already developed. A site was found for. the lower reservoir, elevation 1249', and Water Department staff has tried to negotiate with the property owners to acquire the property. Attached is a map which shows the location of the parcel to be acquired. It may be necessary to take the property through eminent domain proceedings if successful negotiations of value cannot be accomplished with the property owners. " " . ./ c o 1 2 RESOLUTION NO. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 as 28 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL, CITY OF SAN BERNARDINO, DECLARING THE NECESSITY OF THE TAKING, IN FEE SIMPLE ABSOLUTE, ASSESSOR'S PARCEL NUMBER 148-122-01 PTN., THAT PORTION OF THE NORTH TWENTY-FOUR (24) ACRES OF LOT 2, BLOCK 83, OF RANCHO SAN BERNARDINO, AS PER PLAT RECORDED IN BOOK 7, PAGE 2 OF MAPS, OFFICIAL RECORDS OF THE COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, CONSISTING OF 6.33 NET ACRES, FOR THE PUBLIC USE OF A WATER STORAGE RESERVOIR AND PUMPING FACILITY. WHEREAS, the Board of Water Commissioners, City of San Bernardino, has found and determined that public interest and necessity require the development of a water storage reservoir and pumping facility at this particular location by reason of elevation and general access, as part of the larger planned extension of the water system of the City of San Bernardino; and WHEREAS, this project is planned and located in a manner that is most compatible with the greatest public good and the least private injury in that the property to be taken is vacant and no existing structures will be damaged; and WHEREAS, said parcel of land, Parcel Number: 148-122-01 ptn., also known as that portion of the North twenty-four (24) acres of Lot 2, Block 83, of Rancho San Bernardino, as per plat recorded in Book 7, Page 2 of Maps, Official Records of the County of San Bernardino, State of California, consisting of 6.33 net acres, are required for the public use of a water storage and pumping facility, authorized for public use by Streets and Highways Code Section S10l(h); and WHEREAS, an offer has been made to the owners of said property determined from the pUblic records, in accordance with the requirements of Government Code Section 7267.2; and 3/27/92 1 RESOLUTIOQECLARING THE NECESSITY O~HE TAKING, IN FEE SIMPLE ABSOLUTE, R THE PUBLIC USE OF A "-otER STORAGE RESERVOIR AND PUMPING FACILITY. 1 WHEREAS, the Board of Water commissioners, as lead agency, has 2 adopted a mitigated negative declaration for the acquisition of 3 said property in accordance with the California Environmental 4 Quality Act. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL, CITY OF SAN BERNARDINO THAT: SECTION 1. There is a necessity for the taking, in fee simple absolute, Parcel Number: 148-122-01 ptn., also known as that portion of the North twenty-four (24) acres of Lot 2, Block 83, of Rancho San Bernardino, as per plat recorded in Book 7, Page 2 of Maps, Official Records of the County of San Bernardino, State of California, consisting of 6.33 net acres, more fully set forth in Exhibit "A", which is attached hereto and incorporated herein by reference. SECTION 2. Said parcel of property is required for the public use of a water storage reservoir and pumping facility, authorized for public use by Streets and Highway Code Section 5101(h). SECTION 3. That all actions necessary to acquire said parcel of property shall be by and through the Board of Water Commissioners, City of San Bernardino.
