STAFF REPORT
As part of its accountability to manage the City's community access
channels, the Telecommunications Division production facility was
established in 1988 for the purpose of producing community access
programning. The Division has consistently produced a variety of
local origination programning at no cost for replay on the City's
channel. Existing local access guidelines permit any resident to
submit programs for playback on the City's public access channel.
In addition, many requests are received relating to requests for
productions. If these requests are consistent with local origination
programning guidelines, and assuring resources are available to accOlllllOdate
them, they are generally accOlllllOdated; e.g. Black History Parade,
Mexican Independence Day.
other types of requests for production have been received in the
past. These include:
1. PRIVATE CXMmRCIAL
Projects produced for playback on conmercial stations, not the
access channel.
2. PAID PCLlTICAL
Projects produced for political candidates for use on other programning
systems, rather than community access.

3. PRIVM.'E l!I:I!I-~n'S
Projects for non-profit organizations, which are not community
access in nature (i.e., United Way Prom:>tion CaIrpaign) or which
require a major comnitment of City resources to conplete (the St.
Bernardine's Telethon).

Special projects produced at the request of other governmental
agencies such as CALTRANS, SANBAG, and Inland Valley Development
Agency.
Since these types of requests are not consistent with the mission
of the Division in terms of providing community access programning,
it is recomnended that the attached fee structure be adopted to recover
costs associated with these productions.
Attached is a listing of projects which have been completed during
the past year in the above-listed categories.
The attached resolution establishes fees for remote camera shoots,
studio production services, video cassette purchases, and duplication
services. The fees are based on actual costs, which include camera
and video equipment as well as personnel costs.

It is estimated that approximately $10,000 per year in revenue will
be generated through this fee structure.
NOTE: The attached ordinance and resolution were reviewed at the
March 3, 1992 Conmunity Cable Television CoIIInission meeting. A motion
was made and carried to endorse fees (the ordinance), with a provision
to review the fee structure (resolution).

WHEREAS, the City of San Bernardino desires to establish
easonable service fees to assist local individuals, agencies
nd organizations in producing video programming: and

WHEREAS, Chapter 3.73 of the Municipal Code of the City

WHEREAS, the fees hereinafter established do not exceed

Section 1. That the following fees and charges shall be

(A) USER FEES:
(1) SINGLE CAMERA REMOTE SHOOT
$75.00jhour with a two-hour minimum
(2) TWO-CAMERA REMOTE SHOOT
$100.00jhour with a two-hour minimum
(3) THREE-CAMERA REMOTE SHOOT
$200.00jhour with a four-hour minimum

$300.00/hour with a two-hour minimum
(5) THREE-CAMERA COUNCIL CHAMBERS PRODUCTION
$200.00/hour with a two-hour minimum
(6) GRAPHICS/POST PRODUCTION: $60.00/hour
(B) OTHER CHARGES
(1) Production Set-Up: $75.00/hour
(2) Additional Crew Members: $15.00/hour
(C) Videocassette Tape Purchase (which shall be limited
to videotapes as required to complete a production
agreement) :
(1) Scotch 3/4" 60 minute tape: $15.00
(2) Scotch 3/4" 30 minute tape: $11.00
(3) Scotch 3/4" 20 minute tape: $10.00
(D) Videocassette Duplication Fees (which shall be
limited to copies of local origination programming) :
(1) Scotch 3/4" 60 minute tape: $39.00
(2) Scotch 1/2" 120 minute tape: $22.00
The above rates apply to single set-up only: that
is, duplication of a single, continuous running
program. If more than one program is to be
duplicated per tape, there may be an additional set-
up charge of $7.50 per set up.
Minor editing,
including character generation and up to
three (3) additional set-ups is also available at a

A volume discount of 25% will be applied if a
single program is to be duplicated on 6 or more
tapes.
Postage and handling $3.50 per tape.

9 efundable deposit of 50% of costs as described in the
10 roduction agreement.
11 Section 3. That delinquent accounts for User Fees shall
12 e charged an additional 15% delinquency fee per month on the
13 alance due.

ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER
.73 TO THE MUNICIPAL CODE ENTITLED "USER FEES FOR VIDEO
ODUCTION SERVICES," AUTHORIZING THE COLLECTION OF USER FEES
OR VIDEO PRODUCTION SERVICES.

SECTION 1. Chapter 3.73, entitled "User Fees for Video
roduction Services" is hereby added to the Municipal Code of
e City of San Bernardino.
SECTION 2. Section 3.73.010 is
hereby added to the
Code of the City of San Bernardino as follows:

Authoritv to Contract for Production Services.
The Telecommunications Division, of the City of San

ernardino, may enter into an agreement to provide video
roduction services which shall be executed by the City

"3.73.020 User Fees
(A)
Any individual, agency or organization contracting
for video production services shall be charged a
user fee, as established by resolution of the Mayor and
Common Council.
(B)
User Fees shall be charges designed to recover
costs associated with the delivery of production
services.

Users may be required to pay a non-refundable

deposit of costs as set by resolution of the Mayor and
Common Council and as described in the production
agreement. Balance of payment shall be due within ten
(10) days of service completion.
(D) A charge for delinquent payment of fees for
services is hereby authorized, to be set by
resolution of the Mayor and Common Council.
