RESOLUTION NO. 88-255
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO, RELATING TO PLANNING
SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
execute on behalf of said City an Agreement with the Community
Development Commission of the City of San Bernardino, relating to
planning services, which Agreement is attached hereto, marked
Exhibi t "A", and incorporated herein by reference as fully as
though set forth at length.

THIS AGREEMENT is made and entered into effective as of the
\ . -de :to , 1988, by and between the REDEVELOPMENT AGENCY OF
THE ''ci .. - -OF SAN BERNARDINO, CALIFORNIA, a public agency of the
State of California, hereinafter referred to as the "Agency", and
the CITY OF SAN BERNARDINO, a charter city, hereinafter referred
to as the "City".
The parties do hereby agree:
1. Recitals.
( a) Agency periodically needs the assistance of
planning consultant and planners to render planning services,
assist in preparing redevelopment plans and reports to the
Community Development Commission and to the Mayor and Common
Council, to provide assistance in citizen advisory committees and
project area committees, to aid in preparation of environmental
impact reports, to prepare maps on various project related
matters, and similar planning services.
(b) Ci ty, through its Planning Department, is
prepared to provide services as planning consultants for Agency
and its governing body, the Community Development Commission.
2. Implementation.
( a )
Services.
Agency agrees to retain and City
agrees to provide the services of the Planning Department, and
various planners therein, who shall perform, or have performed,
except as limited herein, necessary services in connection with

projects undertaken by the Agency, or being considered by the
Agency, and shall render in a satisfactory and proper manner as
determined by the Agency, all planning services necessary and
desired, and shall confer when necessary with the Agency and with
any federal, state or municipal entity involved in planning
matters when requested; the planner shall perform all work of a
planning nature necessary and required by Agency or by any
federal agency or state agency as to any Agency project and
provide the Agency with the necessary planning services for the
proper preparation and presentation of all projects undertaken by
the Agency. The primary work shall be provided by a planner at
the level of Senior Planner or above, but support and additional
work may be performed by other members of the Planning staff as
directed by the Planning Director. The Planning Department shall
be consulted in the hiring of any outside planners or planning
services, but the Agency reserves the right to obtain such
outside planning services when necessary, and any outside
planning services obtained by Agency shall not be pursuant to
this Agreement.
(b) Time of Performance. The services of Planning
Department are to commence August 1, 1988, and shall be
undertaken and completed in such sequence as to assure their
expeditious completion in light of the purposes of this
agreement. This agreement shall continue until June 30, 1989,
unless sooner terminated by the action of either Agency or City.
(c) Compensation. Agency will pay City at a rate

representing the actual cost of providing the planning services,
including fringe benefits, on an hourly basis, for all work
performed on behalf of Agency. City shall provide to Agency an
invoice for payment specifying the work performed, the account
category representing the project or activity to which the
services are to be charged, and the actual hourly rate of
planners used, and shall submit such invoices on a monthly basis.
The total fees for planning services for the term of this
Agreement shall not exceed $60,000.00. Of this amount Agency
will compensate City for services provided to Project Area
Committees and Citizen Advisory Committees as outlined Paragraph
(d)(2) below in an amount not to exceed the following:
Northwest PAC $4,000
Uptown CAC 4,000
South Valle PAC 1,000
Tri-City CAC 1,000
(d)(l) Services to be Rendered to Agency. Services
to be rendered by the Planning Department shall include, but not
be limited to, preparation of redevelopment plans and reports to
the Community Development Commission and to the Mayor and Common
Council regarding Redevelopment Projects, administration of
environmental impact report contracts, preparation of
environmental impact reports, preparation of requested maps, and
such other planning services as are specifically requested by the
Agency. Only planning services directly related to Agency
business shall be included in invoices submitted hereunder. It

is anticipated that such services shall be the equivalent of one
full-time senior planner and one-quarter time senior secretary.
Although as noted above more than one employee of the Planning
Department may be utilized to provide such services, Department
shall designate one individual as a primary contact.
(d)(2) Service to be Rendered to Project Area
Committees and Citizen Advisory Committees. When
requested by the Northwest Project Area Committee, the Uptown
Citizens Advisory Committee, South Valle Citizens Advisory
Committee or the Tri-City Citizens Advisory Committee, the
Planning Department will provide such project area committees and
citizen advisory committees the following services, but which may
not exceed the amount specified above:
(i) Participate in or put on a workshop either
for an individual PAC or CAC or jointly on
the General Plan update and the redevelopment
plans to assist the PAC or CAC in participating
effectively in the General Plan update process.
Such workshops shall be scheduled by or at times
agreeable to the Planning Department.
(ii) Put on educational workshops as staff time
permits on other aspects of planning, such as
zoning, CEQA, etc. These will also be performed
either for an individual PAC or CAC or jointly.
(iii) Meet with an individual PAC or CAC or jointly
to review a significant planning issue when

requested by the Chairman and approved by the
Agency. In such instances, the Planning
Department will attend such meetings, unless
prevented by other circumstances (illness,
conflicting meetings, etc.). It shall be the
obligation of the PAC's and CAC's to review
the Active Case List in order to ascertain
which items are significant so that such
meetings may be scheduled in advance.
(iv) Any of the meetings specified in paragraphs
(i), (ii) and (iii) which are held after
5:00 p.m. shall be limited to four (4) per
year for any individual PAC and CAC.
(d)(3) Additional Services to be Rendered to Project
Area Committees and Citizen Advisory Committees-=
Without Charge. The following services shall be
provided to all PAC's and CAC's and the members
thereof during normal working hours and subject to
scheduled appointments, where necessary, without
charge:
(i) Mail staff reports for discretionary projects
in the subject area at the time they are
mailed to the applicant and delivered to the
Planning Commission.
(ii) Mail the Active Case List (when it is available
to the public) with any staff reports.

(iii) Mail Notice of Intent to Adopt Negative
Declaration for any initial study prepared in
the subject area.
(iv) Give each PAC and CAC the name of a single
contact person in the department to whom
questions may be directed.
(v) Place the PAC or CAC on the General Plan
mailing list to receive materials.
(e) Terms and Conditions. This agreement is subject
to and incorporates the provisions of any and all federal
regulations concerning the provision of planning services to
Agency in regards to any federally funded activities.
(f) Termination. This agreement may be terminated by
either Agency or City upon thirty (30) days' notice.
(g)
Extension.
This agreement may be extended for
two successive one-year periods at the option of the Executive
Director of Agency to be conveyed to the Planning Department in
writing prior to the expiration of this agreement or any
previous extension.
Both this agreement and any extension
thereof shall be subject to the budgetary constraints of both the
Agency and the Department.
IN WITNESS WHEREOF the parties hereto have executed this
agreement effective on the day and date first above shown.
