RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AND
3 ADOPTING A MOBILEHOME PARK RENTAL ASSISTANCE PROGRAM.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Recitals:
7 WHEREAS, a significant portion of the City of San
8 Bernardino's very low income households live in mobilehome parks;
9 and,
10 WHEREAS, many of these residents are older, on limited,
11 fixed incomes and pay over fifty percent (50%) of their income
12 for housing; and,
13
WHEREAS, due to the limited availability to them of
14 affor~able housing and due to other financial circumstances,
15 little or no opportunity exists for such persons to ffiove Qr
16 otherwise adjust their housing and related expenses; and,
17
WHEREAS, it is determined that an unexpected emergency
18 expense could impact such persons in such a manner as to force
19 them into the ranks of the homeless,

NOW, the Mayor and Common Council of the City of San
Bernardino resolve to take the action hereinafter set forth:
SECTION 2: Implementation

(B) The City of San Bernardino hereby establishes a "City
4 of San Bernardino Mobilehome Park communications Task Force"
5 (Task Force) to function in the manner as set forth in Exhibit
6 "B" attached hereto and by this reference made a part hereof.

(C)
The Mobilehome Park Ad hoc Committee is hereby
8 specifically authorized to review and approve any agreement with
9 any party necessary for the implementation of the program and the
10 Task Force.
Such agreements shall be deemed to be approved by
11 the Mayor and Common Council.

Attached please find the above referenced program which has
been developed pursuant to the direction of the Mayor and
Common Council and the Mobilehome Ad Hoc Committee. The
program envisions actual administration of the grant compo-
nent of the program by the County of San Bernardino Community
Services Department (CSD), and that it be initially cap-
italized at a level of $50,000 ($40~000 from owners and
$10,000 from City General Fund). The reasons for the 4:1
ratio and the City contribution from its General Fund are as
follows:
a) The City has previously spent $26,812 to finance a study
of the rent control issue within its corporate boundaries.
b) A minimum of $10,000 in administrative expenses
(salaries/benefits, postage, reproduction, et. al.) has
been incurred by City exclusive of time spent by
Attorney's office.
c) Federal regulations prohibit the use of CDBG funds for
rent subsidies.
d) The city General Fund is the least restrictive revenue
source available to accomplish Council-adopted objectives.
It is possible for the block grant program to fund an
eligible activity up to $10,000 that is currently financed by
the General Fund. In this way the City could accomplish its
objectives using different funding sources.
The County presently receives $131.00 per month to administer

the Yucaipa community's rental assistance program. While the
proposed program differs from Yucaipa's in certain aspects,
it is anticipated the City would pay a monthly administrative
fee of roughly $150.00 per month. The program fund would
actually pay the cost on behalf of the City.
Your input and that of any of the individuals receiving a
copy of this memorandum is appreciated.

"Mobilehome Park Rental Assistance proqram"
Backqround
-A significant portion of the City of San Bernardino's very
io~-income households live in mobilehome-parks. lMany of
these residents are older, on limited, fixed incomes and some
pay over fifty percent (50%) of their income for housing. Due
to housing and financia~ circumseances, little or no
oppo~tunity exists to move or otherwise reduce housing and
related costs. A personal financial reversal, an expensive
illness, a rent increase or some combination of these factors
could be financially devastating and perhaps even force
certain households into the ranks of the homeless.
It is the desire of the City of San Bernardino to establish a
rental assistance program for these households. This program
will be a joint program of the City and the mobilehome park
owners. The program will provide monetary assistance for the
most needy cases and an opportunity for rent deferrals for
other households in need.
Program Components
(
The City of San Bernardino Mobilehome Park Rental Assistance
program will have two (2) components: (1) grants to the most
needy mobIlehome park residents; and (2) rent deferrals-for
others who have a temporary need for financial assistance.
Each of -these components is explained further below.
1. Grants -~ Giv~n fund availability, grants will be avail-
able for very low income households (defined as households
which earn fifty percent (Sot) or less of median income)
which pay fifty percent' (Sot) or more of their income for
~ousing (including space rent, rent or mortgage payment on
their coach and utilities).
After eligibility is determined, these households will
receive grants consisting of monthly payments to cover
that portion of their housing costs which exceed fifty
percent (Sot) of their income. The maximum grant will be
fifty dollars ($SO.OO) per month. Eligibility will be
reviewed annually.
2. Rent Deferrals -- Rent deferrals will be available to low
income households who are paying in excess of thirty
percent (30t) of its income for housing and related
expenses. In general, rent deferrals will involve
deferral of rent increases for these households. Other
arrangements may also be possible.

After eligibility is determined, individual arrangements
will be' negotiated by the specific mobilehome park owner
or his/her representative and the eligible tenant. Rent
deferrals will represent an obligation of the resident
receiving the deferral to the owner and will be repaid
when the mobilehome is sold or ownership is trans~erred,
voluntarily or involuntarily, or sooner if possible.
Repayment will be secured through a personal note from the
resident to the owner. Eligibility for continuing rent
deferrals will be reviewed-annuallY.
Proqram Administration
The grant component of the rent assistance program will be
--administered by the Community Services Department of the
County of San Bernardino. The Community Services Department
(CSD) is also administering a similar program for the Yucaipa
community. The Community Services Department will be paid an
administrative fee for administration of the program.

As to the rent deferral component of the rental assistance
program, Community Development Department staff will make
available to the mobilehome park owners household income
information, adjusted for family size, at eighty percent
(80%) and fifty percent (50%) of the median income for the
Riverside/San Bernardino Metropolitan Statistical Area. This
information is updated annually by the u.S. Department of
Housing and Urban Development (HUD). Owners would utilize
this information in calculating whether a household was__
spending thirty percent (30%) or more of its gross income on
-housing and related expenses, and thus, eligible for rent
deferral consideration.
Program Funding
Based on the experience of the Yucaipa Rental Assistance
Program, it is recommended that-.this program be capitalized
ini-tially-with -a $50,000 fund derived from the following
sources:
1. A $40,000.00 cash contribution from the mobilehome park
owners; and
2. A $10,000 contribution from the City of San Bernardino
(from General Fund Revenues).
These funds would be transferred to the Community Services
Department which would serve as fiscal agent for this pro-
gram. The fund balance would be deposited in an interest
bearing account with a local financial institution, and
interest earned would be added to the fund balance. In
addition to grant payments, CSD's administrative fee would be
paid out of the fund.

eligibility for grant payments (based on information supplied
by the mobilehome park resident), prepare and send out
monthly checks, re-determine eligibility annually, and
provide the mobilehome park~wners and the City of San
Bernardino Community ~evelopment Department with a monthly
statement of grant payments, interest earneg and fund
balance.
When the fund balance is depleted, additional contributions
to continue the program willoe necessary from the City and
the mobilehome park owners, in the same proportion as the
original grant if the City determines continuation of the
program is warranted.
~blicitv. Outreach and Referrals
The rental assistance program will be publicized by the City
through newspaper articles and fliers, the City Community
Access Channel and the Community Services Division of the
Parks, Recreation and Community Services Department. Local
tenant organizations will assist with outreach activities in
local mobilehome parks. In addition, announcements and
fliers will be posted in senior centers and other facilities
where mobilehome park residents are likely to see them.

qualify for assistance, the rejection notice will include an
attachment listing other organizations and prog~ams-which
might be able -to assist the mobilehome park resident.

Mobilehome Park Communications Task Force
Concept and Cost Estimates
Backqround
The Yucaipa Plan as implemented by Mobilehome Park Solu-
tions, Inc., has established a "Communications Team". The
Team is composed of one resident representative, one owner
representative, and the board chairman of Mobile Home Park
Solutions, Inc., who is a county employee. Whereas the
Communications Team has no formal authority for forging
agreements (such as mediation or binding arbitration), team
members assist in problem solving, aiding owner/resident
communications, organizing for and holding elections,
providing education, and conducting park meetings. A
Communications Team member may attend local park communica-
tions meetings and monitor the program, helping to
facilitate improvement for park relationships.
Proposal for the city
At the last meeting of the Common Council's Mobilehome Ad
Hoc Committee, it was suggested that a similar communi-
cations task force be established to complement the pro-
posed rental assistance program for income-deficient park
tenants. The task force might be called "The City of San
Bernardino Mobilehome Park Communications Task Force" and
chaired by one of the Mayor's key staff. There would also
be a park owner representative and two resident
representatives, one from Golden State Mobilehome Owners
League (GSMOL) and one from the Mobilehome Organized
Residents Enterprises (MORE). The Mayor's appointed
representative gives added credibility to the program,
which would not be the case if the Task Force were chaired
by a departmental representative.
Cost Estimates
It is envisioned that the Communications Task Force would
operate in a similar fashion to the Yucaipa Plan model
described above. The members of the task force would serve
to promote communication between park owners and park
residents. They would also strive to be impartial in
providing clarification of non-rent related issues affect-
ing either party.
In order to estimate the costs to the City of establishing
and operating this task force, it is necessary to make some
assumptions:
1. It is assumed that the task force would meet as a body
once a month, and that meeting notes would be prepared.

2. It is assumed that the City would provide meeting space
for the task force and necessary clerical support for
the preparation of agendas and minutes of task force
meetings.
3. Based on these assumptions, the following annual costs
are anticipated for the activities of the proposed
communications task force:

RECOMMENDA TION:
Approve agreement between City of San Bernardino Community Development
Department (CDD) and Community Services Department (CSD) whereby CSD
provides financial and accounting services for the City of San Bernardino
space rental assistance program for mobilehome residents in the City of San
Bernardino, in the amount of $3,475 for the period beginning September 1,
1988, and continuing until the fund balance of $50,000 is expended.
BACKGROUND:
The Ci ty of San Bernardino has formed a task force to fos ter improved
communications between mobilehome park owners and mobilehome residents in
the city limits of San Bernardino. Similar to the County's program of space
rental assistance run by Mobilehome Housing Solutions, Inc. (M.H.S.I.), the
City wants to implement a space rental assistance program for qualified
applicants and/or households within its boundaries. The "Mayor's Mobilehome
Communications Task Force" will oversee the operations of this mobilehome
rental assistance program.
CSD is the administering agency for the M.H.S.I. program. CSD reviews
applications, issues payments, provides monthly reports, and other duties as
outlined in the agreement. CSD will provide the same services for the City,
administering $50,000 in funds. In exchange for administration of this
program and its funds, CSD will be reimbursed as outlined in the contract.

This agreement is entered into ,by and between the City of San
Bernardino Community Development Department, hereinafter referred
to as "City" and the County of San Bernardino Community Services
Department, hereinafter referred to as "CSD".
I. Recitals.
(a) Whereas, the City desires to develop and implement
a program to provide rental assistance payments to qualified low
income mobilehome park tenants residing in mobilehome parks
located within the incorporated boundaries of the City of San
Bernardino.
(b) Whereas, the City desires to establish a special
13 fund which will serve as the source of this financial assistance.
14 (c) Whereas, the County currently administers a similar
15 program which operates in the Yucaipa area.
16 (d) Whereas, the City desires to retain the services of
17 the County, through its Community Services Department, to
18 administer the City's new rental assistance program and the
19 County agrees to undertake such administration.
20 The parties, therefore, mutually agree as follows:
21 II. Scope of Services. The CSD shall perform the following
22 tasks under this agreement:
23 (a) Work with the City to develop the appropriate
24 information, correspondence and application materials for the
25 Rental Assistance Program, which will be identified on all forms,
26 checks and correspondence as the "City of San Bernardino
27 Mobilehome Park Rental Assistance Program."
28 (b) Disseminate information and application material.

The CSD will maintain in its office copies of information and
application material for the City's rental assistance program and
3 will make that information available to mobilehome park tenants
4 upon request. The CSD will not be involved in any other outreach
5 or promotional activities regarding the program.
(c) Certify applicant eligibility. The CSD will

7 certify applicant eligibility for rental assistance payments,
8 given eligibility criteria established by the City based on, (i)
9 current income limits adjusted by family size (eligibility may be
10 certified bond or copies of checks and/or check stubs, signed tax
11 returns, investment and/or trust fund income and/or pension
12 statements or checks), and; (ii) amount the household currently
13 spends for housing (including a sworn statement of family size
14 and documentation of housing expenses including space rent, plus
15 rent or mortgage payment on the coach, plus utilities and
16 insurance).
(d) When eligibility is denied, CSD will send out a
17
18 notification to the applicant (using Rental Assistance Program
19 stationary) informing the applicant of the reason for denial.
20 Questions and review will be directed to the Mayor's Mobilehome
Park Communications Task Force.

(e) When eligibility is approved, CSD will send out a
23 notification of approval stating the amount of the grant payment,
when it will begin, and the requirement for annual

recertification of eligibility.
At least thirty (30) days prior
to the annual recertification date, CSD will inform the grantee
of the need to recertify information and proceed with
recertification and subsequent grant adjustment or termination,

as appropriate. Questions and review on recertification will be
directed to the Mayor's Mobilehome Park Communications Task
Force.

5 correspondence and information are received. CSO will also
6 maintain a computer-based file on each applicant with the

(g) The CSO shall prepare and distribute grant checks.
11 Special imprinted checks shall be ordered by CSO with the City of
12 San Bernardino Mobilehome Park Rental Assistance Program
13 identified thereon. CSO will require signature authority for
14 the checks and will use whatever name and title the City
15 designates. Checks will be prepared by CSO and distributed (by
16 mail) some time between the 14th and 26th of each month, to
17 coincide with CSO's other workload considerations. Checks will
18 be made payable directly to the homeowner.

(h) The CSO shall administer the Rental Assistance
20 Program Fund. Upon initiation of this program, the City will
21 deposit with CSO a sum not to exceed $10,000.00, with an
22 additional $40,000.00 contribution to be made by San Bernardino
23 Parkowners Association (SBPOA). The CSO will assume
24 responsibility for fund administration, including investing the
25 fund balance in a bank or bank branch within the City of San
26 Bernardino area for additional interest income, reconciling the
27 account and reporting on the fund balances monthly as indicated
28 below.

1 (i) Provide monthly reports. The CSO will provide a
2 monthly statement of fund activity to participating mobilehome
3 park owners and the city. The report will document the grant
4 payments made to individuals or families during the month
5 (without specific grantee names), fees paid to CSO for
6 administration, and indicate the fund's beginning and ending
7 balance, including any interest earned.
8 (j) Upon request, CSO will provide summary analytical
9 reports indicating grant activity trends, geographic distribution
10 of grantees by park, and other information of interest to the
11 City and/or CSO which may be generated from program operations.
12 (k) These funds will be audited under the Single Audit
13 Act of 1984.
14 III. Comnensation to CSO for Administration. The CSO agrees
15 to administer the City's Mobilehome Park Rental Assistance
16 Program, including the tasks described in section "II" above, for
17 the following compensation.
18 (a) Three-hundred dollars ($300.00) to cover initial
19 start-up costs, new stationary, checks, postage, and a pro-rated
share of CSO's audit costs.

21 (b) Amount not to exceed one-thousand six hundred
22 dollars ($1,600.00) for one-time reprogramming to adapt the CSO
23 computer program to the needs of the City's rental assistance
24 program.
25 (c) One-hundred, seventy-five dollars ($175.00) per
26 month for ongoing program administration and reporting, as
27 described in Section "II", items (a) through (k) above.
28 The CSO's fees will be paid out of the fund upon

presentation of invoice. since this is a new program, CSD

reserves the right to re-examine the fee structure after one (1)
year and propose revisions in 9omp~nsation arrangements.
IV.
Term and Termination of Aqreement. The term of this
Agreement will commence on September 1, 1988 and continue until
the fund balance is totally expended as determined by the
Director of Community Development of the City of San Bernardino.
7 This Agreement, may be terminated upon sixty (60) days written
8 prior notice by any party to the other.

V.
Relationship of Parties. Under this Agreement, CSD is
10 serving as an independent contractor to the City to provide the
11 services as described above. The CSD staff shall not be
12 supervised, directed, or under the control or authority of any
13 City officer or employee.

VI.
Amendment. This Agreement may be amended or modified
15 only by written agreement by both parties and failure on the part
16 of either party to enforce any provision of this Agreement shall
17 not be construed as a waiver of the right to compel enforcement
18 of such provision or provisions, nor act to release any surety
19 from its obligations under this. Agreement.
20 VII. Notices. All notices herein required shall be in
21 writing and delivered in person or sent by first class mail,
22 postage prepaid, addressed as follows:

Each party hereby agrees to save and hold harmless

each the other, their elected and appointed boards, commissions,

officers, agents and employees from liability resulting from, and
arising out of, or connected with the performances by each of its
duties and obligations arising hereunder.
IX. Rebate of Funds. If, at any time, during the life of
6 this agreement a rent control program is implemented within the
7 City of San Bernardino as a result of action by the City Council,
