RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING
IN PORTIONS OF RIAlTO AVENUE, MIll STREET, PEPPER AVENUE,
EUCALYPTUS AVENUE AND MERIDIAN AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOllOWS:
SECTION 1. Mentone Turf Supply is the lowest responsible
bidder for: Maintenance of landscaping in portions of Rialto
Avenue, Assessment District No. 974, in accordance with Plan
No. 6998; in portions of Mill Street, Pepper Avenue and
Eucalyptus Avenue, Assessment District No. 975, in accordance
with Plan No. 7118-A; and in portions of Meridian Avenue,
Assessment District No. 981, in accordance with Plan No. 7316,
for the total amount of $11,330.00, a contract is awarded to
said bidder accordingly, but such award shall be effective only
upon the contract being fully executed by the parties; all other
bids therefor are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of
the City; a copy of the contract is attached hereto, marked
Exhibit II All and incorporated herein by reference as fully as
though set forth at length.
SECTION 2. Execution and Amendments. This contract and
any amendments or modifications thereto shall not take effect or
become operative until fully signed and executed by the parties
and no party shall be obligated hereunder until the time of such
full execution. No oral agreements, amendments, modifications or
waivers are intended or authorized and shall not be implied from
any act or course of conduct of any party.
