REQUEST FOR COUNCIL ACTION
NOVEMBER 20, 1991
AUTHORIZATION TO HIRE CONSULTANT FOR EMS STUDY
On October 18, 1991, the city of San Bernardino solicited Request
for Qualifications (RFQ) to perform an analysis of the existing
emergency medical response system. The consultant will analyze
three operational options: privatization of all emergency medical
services, City-operated paramedic services with private ambulance
transport, and city-operated paramedic services and ambulance
transport. It is expected that the study will be completed by
January 30, 1992.
On November 18, 1991, the Mayor and Common Council authorized
funding of $10,000 from the non-governmental general fund account
to proceed with this study. Two consulting firms submitted
proposals and qualifications:

Copies of the proposals and the evaluation scores are in the
Council Office for your review. Both proposals have been evaluated
by a team consisting of peggy Ducey, Assistant to the city
Administrator, Chief Will Wright, and Lee Gagnon, Business License
Supervisor. All three evaluators chose ECIC as the most qualified
to perform the study. Though both firms have experience performing
EMS-related studies, ECIC has far more personnel and research
resources through its parent firm, JEMS Communications, and more
comprehensive experience in all facets of EMS delivery.
Furthermore, though EMS Concepts' bid is $35 less than ECIC, the
bid price includes payment for travel time from Bakersfield, where
EMS Concepts is located, making the actual contract cost higher
than ECIC. Staff also performed a reference check of studies
completed by the firms, and found ECIC to have an excellent track
record in performing this type of study.
RECOMMENDATION
Based on both experience and actual contract cost, it is
recommended that the Mayor and Common Council authorize the City
Administrator to hire Emergency Care Information Center (ECIC) to
perform an evaluation of our emergency medical response system.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the city of San Bernardino is hereby
authorized and directed to execute on behalf of said City an
Agreement with Emergency Care Information Center a copy of which is
attached hereto, marked Exhibit
"A" and
incorporated herein by
reference as fully as though set forth at length.
SECTION 2.
The authorization to execute the above-referenced
Agreement is rescinded if the parties to the Agreement fail to
execute
it within

of this

AGREEMENT
WITNESSETH
NOW THEREFORE, the parties hereto agree as follows:

Describe and compare the method of service delivery
between the following operational modes:
1. Privatization of emergency medical services,
including paramedic and ambulance service;
City-operated paramedic and ambulance services;
City-operated paramedic service with private
ambulance transport.
Compare the operational profile of the three identified
modes, including vehicles, equipment, EMS staffing, field
supervision, documentation procedures, quality
assurance, response times, and agreements with other
agencies.
Perform a cost analysis of the current City-franchised
ambulance rates and compare with other local ambulance
services. Review costs to provide service. Analyze long-
term viability of privatization of paramedic services.
Determine feasibility of medical priority dispatching.

1 2. Consultant shall be paid at the rates as specified in
2 Exhibit A. Maximum compensation shall not exceed $10,000.
3 3. Consultant shall maintain and file with the city
4 Administrator of City a record of all hours worked on assigned
5 study. supervision of Consultant shall be coordinated with the
6 City Administrator or her designee. Consultant shall at such time
7 intervals as directed by the City Administrator, submit a claim
8 based on such records to the City in the manner and form as
9 prescribed by the city Administrator.
10 4. This Agreement shall commence upon execution of this
11 contract by. both parties. This Agreement may be terminated by
12 either party upon thirty (30) days written notice to the other.
13 5. For all purposes Consultant shall be considered as an
14 independent contractor and not as an employee of the City.
15 6. Except as specifically provided herein, Consultant shall
16 not be entitled to any employee benefits, such as, but not limited
17 to, vacation leave or accrual, sick leave, retirement benefits,
18 paid vacation, seniority, etc. city shall not deduct from
19 Consultant's compensation any withholding except as is required for
20 such independent contractors. Consultant shall be responsible for
21 all taxes on said compensation.

2 city, its officers, agents and employees harmless from any claim or

Consultant agrees to defend, indemnify, save and hold
suits that may be brought by third persons on account of personal
injury, death, or damage to property, or a property or business or
personal interest, arising from any negligent act or omission by
Consultant while performing services under this Agreement.

Any notices to be sent pursuant to this Agreement from
one party to the other shall be deposited with the United states
Postal Service postage prepaid and addressed as follows:
