A fee of $750.00 is currently collected from persons
requesting that proceedings be initiated to vacate all, or a
portion, of an easement for street and highway purposes. These
proceedings are done in accordance with the 1941 Street Vacation
Act.
This fee was set through an administrative action by the
City Administrator. It is recommended that this fee be formally
established by resolution at $1,000, in order to reflect actual
costs incurred for these proceedings.
Below is an estimate of cost for a typical vacation
proceeding:
Salaries - 32 hours X $21/45/Hr. =

Overhead - $686.40 X 0.30

Items of work necessarily done to accomplish a vacation
are: preparation of map, notification of all utility companies
and City Department, secure authorization to proceed, have Reso.-
lution of Intention adopted, post notices along area requested to
be vacated, public legal notice, have Resolution Ordering Vaca-
tion adopted, record Resolution Ordering Vacation and amend
Street Vacation Index Maps to reflect vacation.
About 20 street vacation proceedings are processed each
year. Therefore, the additional annual revenue that will be
received from increasing this fee is $250 X 15 = $3,750.
This fee will not apply to City initiated vacations.
We recommend that a fee of $1,000.00 be established for
street and alley vacation proceedings.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A
FEE OF ONE THOUSAND DOLLARS ($1000) FOR PROCESSING AN APPLICATION
FOR A STREET OR ALLEY VACATION PURSUANT TO THE 1941 STREET
VACATION ACT.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Findings.
The Mayor and Common Council
hereby find:
A. A public meeting was set pursuant to the provisions
9 of Government Code Section 54990, et seq., to consider the
10 establishment of a new fee for processing applications for street
11 and alley vacations by the Department of Public Works.
12 B. The proposed fee of One Thousand Dollars ($1,000)
13 does not exceed the actual cost incurred by the City for
o 14 processing an application for a street or alley vacation in
15 accordance with the proceedings prescribed in the 1991 Street
16 Vacation Act, the additional expense to the City for providing
17 this service shall be borne by the General Fund of the City of
18 San Bernardino.
19 SECTION 2. Implementation. The fee of One Thousand
20 Dollars ($1,000.00) for processing a street or alley vacation
21 shall apply to all requests for vacations received after October
22 21, 1991. One half of the stipulated fee shall be submitted with
23 the request, and the remainder shall be remitted after responses
24 have been received from utilities and affected City Departments.

Exemptions.
proceedings initiated by the City of San Bernardino, or any other
governmental agency, shall be exempt from this fee.
