RESOLUTION NO. 88-46

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO SUMMIT GRADING & PAVING FOR RE-ALIGNING AND WIDENING
FORTIETH STREET, FROM ELECTRIC AVENUE TO MT. VIEW AVENUE
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Summit Grading & Paving is the lowest
responsible bidder for the re-alignment and widening of 40th
7 Street, Electric Avenue to Mt. View Avenue, in accordance with

Plan No. 7283, for the total amount of $102,064.80, and a
9 contract is awarded to said bidder accordingly, but such award
10 shall be effective only upon the contract being fully executed
11 by the parties; all other bids therefor are hereby rejected;
12 and the Mayor is hereby authorized and directed to execute said
13 contract on behalf of the City; a copy of the contract i s
14 attached hereto, marked Exhibit If A If and incorporated herein by
15 reference as fully as though set forth at length.
16 SECTION 2 . This contract and any amendments or
17 modifications thereto shall not take effect or become operative
18 until fully signed and executed by the parties and no party
19 shall be obligated hereunder until the time of such full execution.
20 No oral agreements, amendments, modifications or waivers are
21 intended or authorized and shall not be implied from any act or
22 course of conduct of any party.
