HomeMy WebLinkAbout1989-506 r- ~ . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 89-500 A RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC 2570 AND REPEALING RESOLUTION NO. 89-435 WHEREAS, on the 6th day of November, 1989, the Mayor and Common Council of the City of San Bernardino did adopt Resolution No. 89-435, determining the amount of property tax revenues to be exchanged between the City of San Bernardino and the County of San Bernardino, resulting from the jurisdictional change described in LAFC 2570; and WHEREAS, LAFC 2570 was amended on November 29, 1989, by the Local Agency Formation Commission to include additional territory. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change will negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. C. The Mayor and Common Council of the City of San Bernardino and 12-07-89 ~ . SECTION 2. Implementation. A. The negotiated exchange of property tax revenues between the City of San Bernardino and the County of San Bernardino attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above described jurisdictional change, is hereby approved and accepted. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the Local Agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code. SECTION 3. City of San Bernardino Resolution No. 89-435 is hereby repealed. SECTION 4.
