CITY OF SAN BERORDINO - REQUEST CYR COUNCIL ACTION
STAFF REPORT
Caltrans has determined that State Route 206 (Kendall
Drive) is no longer needed as an element of the State Highway
System, due to the completion of State Route 30 Freeway, from
Route 1-2l5 to Route 259.
State Route 206 has been deleted, effective 1-1-92, from
the State Highway System by action of the State Legislature.
Section 8330.5 of the Streets and Highways Code states
that the California Transportation Commission must give a local
agency 90 day notification of any proposed relinquishment of a
State Highway, unless waived by the local agency. The proposed
resolution waives the 90-day notification period.
Adoption of this resolution will allow this matter to be
acted upon by the California Transportation Commission at their
meeting of 11-14-91.
The relinquishment of Kendall Drive to the City has been
in process for a long time. We recommend that the 90-day notifi-
cation period be waived, in order to expedite this process.

RESOLUTION OF THE CITY OF SAN BERNARDINO WAIVING
MANDATED NINETY (90) DAY NOTIFICATION PERIOD RELATIVE
RELINQUISHMENT OF STATE ROUTE 206 (KENDALL DRIVE), BY
CALIFORNIA TRANSPORTION COMMISSION.
THE

WITNESSETH:
WHEREAS, State Route 206 (Kendall Drive) is no longer a
necessary component of the
State Highway System,
due to the
completion of the Route 30 Freeway, from Route I-215 to Route
259; and
WHEREAS, the California Department of Transportation is
proposing that State Route 206 (Kendall Drive), be relinquished
to the City of San Bernardino; and
WHEREAS, Section 8330.5 of the Streets and Highways Code
mandates that the California Transportation Commission give a
local agency ninety (90) days notification of a proposed
relinquishment of a State Highway, unless the requirement for
notification is waived by the local agency; and
WHEREAS, the City of San Bernardino desires to waive the
ninety (90) day notification period.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS:
SECTION ONE:
That the City of San Bernardino hereby
waives the ninety (90) day notification period, mandated by
Section 8330.5 of the Streets and Highways Code, relative to the
proposed relinquishment of State Route 206 (Kendall Drive).
SECTION TWO: That the proposed relinquishment of State
Route 206 (Kendall Drive) be accomplished by the California
Transportation Commission at the earliest possible date.
