STAFF REPORT
This resolution is to amend the M.O.U. for the East Valley AB
939 Coalition (the Source Reduction and Recycling Planning
Agreement Memorandum of Understanding). The M.O.U. is to be
amended to add an additional $71,200 to the original $220,000
contract and also to reimburse the City of Rialto 10% of the
entire contract for their administrative costs in acting as
lead agency in the administration of the agreement. The cost
to Rialto would be approximately $29,120.
The East Valley Coalition's consultant, EMCON and Associates,
has projected $71,200 additional costs to develop the State-
required environmental documents for the cities' compliance
with Assembly Bill 939. The increase is due mainly to
changes in the law which required separation of the Household
Hazardous Waste Element from the Source Reduction and
Recycling Element, and to a lesser extent, due to slow
response to information requests from jurisdictions. As the
lead agency, the City of Rialto has authorized the projected
cost increase.
The City of Rialto is also requesting reimbursement of their
costs as lead agency. They have supplied significant staff
and administrative time to this project, valued at 10% of the
contract cost.
The cost of the contract, and, if approved, the increase and
Rialto's administrative reimbursement, is paid from a $1.00
per ton landfill tipping fee surcharge. We have been paying
this surcharge since July 1990.
Approval of this resolution is recommended in order to
maintain progress on this project.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, CALIFORNIA, AMENDING THE SOURCE REDUCTION AND
RECYCLING PLANNING AGREEMENT MEMORANDUM OF UNDERSTANDING ALLOWING
THE CITY OF RIALTO TO AMEND THE PROFESSIONAL SERVICES CONTRACT
WITH EMCON ASSOCIATES TO COVER ADDITIONAL SERVICES REQUIRED BY THE
EAST VALLEY COALITION AND TO MEET THE REQUIREMENTS OF STATE LAW.
WHEREAS, jurisdictions within the State of California are
mandated by Assembly Bill 939 (Chapter 1095) and the State of
California to prepare a Source Reduction and Recycling Element
(SRRE) and a Household Hazardous Waste Element (HHWE); and,
WHEREAS, the City of San Bernardino has joined together with
other jurisdictions in the East San Bernardino Valley area to form
the East Valley Coalition with the City of Rialto acting as lead
agency on its behalf; and,
WHEREAS, the East Valley Coalition, through the competitive
bid process, chose EMCON Associates as the consultant to prepare
the SRRE's and HHWE's for the participating jurisdictions; and,
WHEREAS, there have been significant changes in the laws and
regulations governing the SSRE's and HHWE's which have affected
the time line and costs for the planning and preparation of these
elements; and,
WHEREAS, EMCON Associates estimates that these additional
costs will add up to $71,200; and
WHEREAS, the City of Rialto has administered the contract
and served as staff to the East Valley Coalition without
reimbursement for associated costs;
NOW, THEREFORE, the Mayor and Common Council of the City of
San Bernardino does hereby pass, approve and adopt this resolution
amending the Source Reduction and Recycling Planning Agreement
