Recommended motion:
1. That the Director of Public Works/City Engineer and the City Clerk are
authorized to proceed with the proposed vacation of a portion of the
North/South alley between 14th Street and Magnolia Avenue, West of "E"
Street.
2. That Plan No. 7950, showing the proposed vacation of a portion the
North/South alley between 14th Street "E"
Street, is approved.

STAFF REPORT

A request was received from Cook's Upholstery Supplies in December of 1989 to
vacate the Northerly portion of the subject alley. The vacation subsequently was
expanded to see if the entire "B" shaped alley should be vacated, however, the
existence of garages behind apartments on 14th Street made that an i~ssible
option. Therefore, the request for Authorization to Proceed was tabled at the
January 22, 1990 Council meeting.
Subsequent events have encouraged Mrs. Cook to again ask that the portion of the
alley lying behind the store property be vacated. This request is based on
several occasions of vandalism, graffiti. and theft over the past two years. In
September, 1991, Real Property staff received the current request to vacate only
that portion of the alley bisecting Mrs. Cook's properties (please see attached
plan). The petitioner has deposited the required $375.00, which represents one-
half of the total fee of $750.00. The remaining $375.00 will be due after the
investigative proceedings.
Mrs. Cook plans to fence the area in question. not only to provide better
security for her property but also to provide more off-street parking for those
customers who would normally park on "E" Street.
Staff hereby reco_ends Authorization to Proceed with the proposed vacation and
the approval of Plan No. 7950.
