RESOLUTION AUTHORIZING AMENDMENT NO. 1 STAFF REPORT
TO A WORKSITE AGREEMENT BETWEEN THE
SAN BERNARDINO CITY UNIFIED SCHOOL
DISTRICT SPECIAl EDUCATION DEPARTMENT
AND THE CITY OF SAN BERNARDINO PARKS,
RECREATION AND COMMUNITY SERVICES
DEPARTMENT.
The original worksite agreement has been in effect for one year and is in need of
amendment only to meet requirements for compensation based on task analysis.
This change will meet the requirements of the rules by which the School District
operates the program and does not affect the City's provision of worksites
nor does it effect any cost or additional supervision.
It is recommended that the amendment be approved.

DATED SEPTEMBER 6, 1990, BETWEEN THE SAN BERNARDINO CITY UNIFIED SCHOOL
3 DISTRICT SPECIAL EDUCATION DEPARTMENT AND THE CITY OF SAN BERNARDINO PARKS,
RECREATION AND COMMUNITY SERVICES DEPARTMENT FOR PROVIDING WORKSITES FOR A
4 SPECIAL EDUCATION CAREER AND VOCATIONAL TRAINING PROGRAM TO PROVIDE FOR TASK
5 ANALYSIS-BASED COMPENSATION.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City Addendum No.1 to

a worksite agreement authorized by Resolution No. 90-371, dated September 6,
10 1990, with the San Bernardino City Unified School District Special Education

12 tion and Community Services Department for a Special Education Career and
13
Department relating to the provision of worksites by the City Parks, Recrea-
Vocational Training Program to amend Paragraph C.3 to provide for task
14
analysis-based compensation per terms of the agreement as amended, a copy of
15 which is attached hereto, marked Exhibit "A" and incorporated herein by
16 reference as fully as though set forth at length.

All other terms and
conditions of the Worksite Agreement shall remain in full force and effect.
SECTION 2. The authorization to execute the above referenced
agreement is rescinded if the parties to the agreement fail to execute it
within sixty (60) days of the passage of this resolution.

ORIGINAL
ADDENDUM NO.1
THE WORKSITE AGREEMENT, covering the period from Auaust 8. 1990, to June 30.
1992, between:
The City of San Bernardino for its Parks.
Recreation. and Community Services DeDartment
and
San Bernardino city Unified School District
is hereby amended effective September 18, 1991, in the following manner:
1. Paraaranh C.3 is amended to read:
"Accurate time and attendance records will be kept by the
District staff worksite supervisor and will reflect the actual time
worked by the participant. Hours worked by participants will not
exceed 35 hours per week with exception of prior approval.
Standard time sheets will be used and shall be provided by the
District staff. The participants shall report or sign in when
reporting to the District staff worksite supervisor and sign out
at the end of the work day. Under no circumstances will the
participant sign in and out simultaneously. Time and attendance
records will be signed at the end of each pay period by the
participant and a District staff supervisor whose signature will
certify the accuracy thereof. Each participant's hourly rate will
be individually calculated based on a task analysis study of that
participant. Additional task analysis studies will be conducted
on a periodic basis to adjust the participant's rate according to
their performance. The participant will be paid no less than $1. 00
per hour and no more than $5.00 per hour by the District, and
participant payroll will follow the normal the District procedures.
Worker's compensation for participants will be provided by the
District. The District will provide a Certificate of Insurance to
the City of San Bernardino Risk Management Division showing proof
of Worker's Compensation Coverage. The participant shall be given
at least a one-half hour lunch break (unpaid) if a work shift lasts
for at least five (5) hours. If a work shift lasts for less than
five (5) hours, a participant shall receive one 15 minute (paid)
break. "
2. Any prior Addendum to this Agreement is hereby revoked to the extent it
is inconsistent with this Addendum No.1.
