RESOLUTION NO. 89-370

RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING
2 CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF
3 SAN BERNARDINO FOR THE COSTS OF ABATEMENT OF PUBLIC
NUISANCES ON SAID PROPERTIES (CASE NO. 89 YAP 328-08)

WHEREAS,
the City of San Bernardino, pursuant to its authority
5 under Chapter 8.36 of the San Bernardino Municipal Code, did lawfully give
6 notice of and thereafter abate public nuisances found to exist on the
7 properties described in Exhibit n A" attached hereto and incorporated in this
8 resolution; and

WHEREAS, pursuant to the San Bernardino Municipal Code, the
10 Superintendent of Public Buildings served notice to all property owners of
11 the abatement costs for removing abandoned, wrecked, dismantled, and/ or
12 inoperative vehicles or parts thereof from the property; and
13
WHEREAS, opportunity for a hearing before the Board of Building
14 Commissioners to protest the abatement costs was afforded the property
15 owners, with no response forthcoming;
16
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
17 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council confirm and adopt as
19 special assessments, the following abatement costs which have been incurred
20 by the City for the abatement of public nuisances found to exist on the
21 following properties:

SECTION 2,
The above assessments shall be paid to Public Buildigns/
3 Parking Control, basement of City Hall, 300 N. "D" Street, San Bernardino,
4 CA. 92418, within thirty (30) days after notice of this resolution is mailed to
5 all parties with an interest in the above properties. All assessments not
6 fully paid in thirty (30) days shall become a lien on the property pursuant
7 to the San Bernardino Municipal Code and shall be collected as a special
8 assessment thereon.

SECTION 3.
If the above assessment is not paid as hereinabove
10 provided, the City Clerk is directed to file a certified copy of this resolution
11 with the Auditor of the County of San Bernardino, State of California,
12 directing that said assessment be entered as a lien against the property as it
13 appears on the current assessment rolls. The assessment shall be collected
14 at the same time and in the same manner as the general property taxes for
15 the City of San Bernardino including penalties and interest for delinquent
16 payments.
17 The City Clerk shall also present for recording appropriate notices of
18 the imposition of these liens with the County Recorder.
19 I HEREBY CERTIFY that the foregoing resolution was duly adopted by
20 the Mayor and Common Council of the City of San Bernardino.
