RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN
PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNAR-
DINO FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES ON SAID
PROPERTIES (CASE NO. 89 VAP-189-05)
WHEREAS,
the City of San Bernardino, pursuant to its authority
under Chapter 8.36 of the San Bernardino Municipal Code, did lawfully
give notice of and thereafter abate public nuisances found to exist on
the properties described in Exhibit "A" attached hereto and incorporated
in this resolution; and
WHEREAS, pursuant to the San Bernardino Municipal Code, the
Superintendent of Public Buildings served notice to all property owners
of the abatement costs for removing abandoned, wrecked, dismantled,
and/ or inoperative vehicles or parts thereof from the property; and
WHEREAS, opportunity for a hearing before the City Administrator
to protest the abatement costs was afforded the property owners, with
no response forthcoming;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor and Common Council confirm and adopt
as special assessments, the following abatement costs which have been
incurred by the City for the abatement of public nuisances found to exist
on the following properties:

1 SECTION 2. The above assessments shall be paid to Public Buildings/
2 Parking Control, basement of City Hall, 300 N. "D" Street, San Bernardino,
3 Ca. 92418, within thirty (30) day after notice of this resolution is mailed
4 to all parties with an interest in the above properties. All assessments
5 not fully paid in thirty (30) days shall become a lien on the property
6 pursuant to the San Bernardino Municipal Code and shall be collected as
7 a special assessment thereon.
8 SECTION 3. If the above assessment is not paid as hereinabove
9 provided, the City Clerk is directed to file a certified copy of this
10 resolution with the Auditor of the County of San Bernardino, State of
11 California, directing that said assessment be entered as a lien against
12 the property as it appears on the current assessment rolls. The assessment
13 shall be collected at the same time and in the same manner as the general
14 property taxes for the City of San Bernardino including penalties and
15 interest for delinquent payments.
16 The City Clerk shall also present for recording appropriate notices
17 of the imposition of these liens with the County Recorder.
