The adoption of the attached Resolution is neeessary to conform with
aetiona taken by the Community Development Commission of the City of San
Bernardino, California, that directed Agency staff to take aetion to
terminate the applicability of lifetime medical benefits for Economic
Development Ageney staff.
On April 15, 1991, the Commission approved Resolution Number 5282
establi.hing the Economie Development Ageney Employee Compensation and
Benefit. Plana for Management/Confidential, Mid-Managers and General
Unit Employee.. These plans were designed as if Ageney staff would be
"City Employee.... Due to eertain eoncerna, the Commission deleted the
requirement for Agency staff to be "City Employees" and they eontinued
to be "Commisaion Employees". This action caused the Redevelopment
Agency eontraet with the Publie Employees Medieal and Care Act to
eontinue in full foree and effeet.
Staff eontacted the California Public Employees' Retirement Systems
Contracts Serviees in the Health Benefits Division to make inquiries
into the proeedures needed to effect changes to the Agency's eurrent
eontraet. Initial response from the Health Benefits Division staff
indieated that the Publie Employees Medieal and Hospital Care Act did
not allow for any reduetion of benefits. After research and further
eontaet. with PERS Health Benefits Division eontraet staff, it was
diseovered that Government Code Seetion 22825.6 provides that a
contraeting aleney eontribution shall be the amount fixed from time to
time by resolution of the governing body of the Aaeney.
Staff has been preparing new personnel policies that will eorrect
defieieneies and ommissions in the eurrent Employee Compensation and
Benefits Plans eaused by the eontinued status of staff being employed by
the Commission versus beeoming City employees. Staff had planned to
present this Resolution with the revised personnel polieies in order to
make the Health Benefits eontraet ehanges coineide with the new
personnel polieies. The revision to our personnel policies has been
delayed b reeent changes to the Fair Labor Standards Aet (FLSA) that
could im ae our revised personnel policies. Therefore, in order to
avoid fu r d 1 s, separate action is reeommended.

Resolution 1'0. 5278 directing staff to take any necessary action to
eliminate life time medical benefits.
On April 15, 1991, the Community Development Commission approved
Resolution No. 5282 establishing the Economic Development Agency Employee
Compensation and Benefits Plans which deleted life time health benefits
and established Agency health contributions for each employee and retiree
(annuitant) at $16.00 per month.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO ON BEHALF OF THE REDEVELOPMENT AGENCY OF
THE CITY OF SAN BERNARDINO FIXING THE EMPLOYER'S CONTRIBUTION
UNDER THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT AND
REPEALING A PORTION OF RESOLUTION NO. 5170.
5 WHEREAS, Government Code 522825.6 provides that a local
6 agency contacting under the Public Employees' Medical and Hospital
7 Care Act shall fix the amount of the employer's contribution at an
8 amount not less than the amount required under 522825 of the Act,
and
WHEREAS, the Redevelopment Agency of the City of San
Bernardino is a local agency contracting under the Act,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The employer's contribution for each employee or
annuitant shall be the amount necessary to pay the cost of his
enrollment, including the enrollment of his family members, in a
health benefit plan or plans, up to a maximum of $16.00 dollars
per month plus administrative fees and Contingency Reserve Fund
assessments.
SECTION 2. Paragraph 2 of Resolution No. 5170 is hereby
repealed.
