Request for Council Action @ 9/16/91 Council Meeting
(Resolution of the City of San Bernardino imposing an
additional surcharge of $8.00 for the recordation of
nuisance abatement liens pursuant to AB 3510).
Re:
On September 3, 1991, the City Clerk's Office received notice
from the San Bernardino County Recorder's Office stating that the
City will be charged $8.00 for the processing and recordation of
nuisance abatement liens. This action was taken pursuant to
Assembly Bill No. 3510 adopted in 1990. Assembly Bill No. 3510
further allows the city to recover from the property owner any
costs incurred for the processing and recording of nuisance
abatement liens.
Since the County Recorder's Office now charges the City $8.00 for
each notice processed and recorded and because the effective
date of Assembly Bill No. 3510 was January 1, 1991, it is
requested that the attached resolution imposing an additional
surcharge of $8.00 for the recordation of nuisance abatement
liens be adopted and become effective immediately upon adoption.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO IlIPOSING AN
ADDITIORAL SURCHARGE OF $8.00 FOR THE RECORDATION OF NUISANCE
ABATEIIENT LIENS PURSUANT TO AB 3510.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, Assembly Bill No. 3510 allows the County
Recorder to impose a fee on the city to reimburse the costs of
processing and recording nuisance abatement liens1 and
WHEREAS, Assembly Bill No. 3510 provides for the city to
recover from the property owner any costs incurred regarding
the processing and recording of nuisance abatement liens1 and
WHEREAS, Assembly Bill No. 3510 became effective on
January 1, 19911 and
WHEREAS, the Recorder's Office of the County of San
Bernardino charges the city $8.00 for each nuisance abatement
lien processed and recorded1 and
WHEREAS, a failure of the City of San Bernardino to
implement this change will result in a loss of revenue to the

NOW, THEREFORE, be it resolved as follows:
1. The City of San Bernardino hereby imposes an $8.00
surcharge for the processing and recordation of nuisance
abatement liens pursuant to provisions of Assembly Bill No.
3510.
2. This Resolution shall become effective immediately
upon enactment.
